lims:id="222136"><Text><DefinedTermEn>conveyance</DefinedTermEn> means a vessel, aircraft, train, motor vehicle, trailer or other means of transportation, including a cargo container; (<DefinedTermFr>véhicule</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222137" lims:id="222137"><Text><DefinedTermEn>document</DefinedTermEn> means anything on which information that is capable of being understood by a person, or read by a computer or other device, is recorded or marked; (<DefinedTermFr>document</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222138" lims:id="222138"><Text><DefinedTermEn>environment</DefinedTermEn> means the components of the Earth and includes </Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222139" lims:id="222139"><Label>(a)</Label><Text>air, land and water,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222140" lims:id="222140"><Label>(b)</Label><Text>all layers of the atmosphere,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222141" lims:id="222141"><Label>(c)</Label><Text>all organic and inorganic matter and living organisms, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222142" lims:id="222142"><Label>(d)</Label><Text>the interacting natural systems that include components referred to in paragraphs (a) to (c); (<DefinedTermFr>environnement</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222143" lims:id="222143"><Text><DefinedTermEn>establishment</DefinedTermEn> means any place, including a conveyance, where a fertilizer or supplement is manufactured, stored, packaged or labelled; (<DefinedTermFr>établissement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222144" lims:id="222144"><Text><DefinedTermEn>fertilizer</DefinedTermEn> means any substance or mixture of substances, containing nitrogen, phosphorus, potassium or other plant food, manufactured, sold or represented for use as a plant nutrient; (<DefinedTermFr>engrais</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222145" lims:id="222145"><Text><DefinedTermEn>inspector</DefinedTermEn> means a person designated as an inspector pursuant to section 6; (<DefinedTermFr>inspecteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222146" lims:id="222146"><Text><DefinedTermEn>item to which this Act applies</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222147" lims:id="222147"><Label>(a)</Label><Text>a fertilizer or supplement,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222148" lims:id="222148"><Label>(b)</Label><Text>anything used in an activity regulated under this Act, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222149" lims:id="222149"><Label>(c)</Label><Text>a document that is related to a fertilizer or supplement or to any activity regulated under this lims:id="222153"><Text><DefinedTermEn>penalty</DefinedTermEn> means an administrative monetary penalty imposed under the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal> for a violation; (<DefinedTermFr>sanction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222154" lims:id="222154"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulation; (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222155" lims:id="222155"><Text><DefinedTermEn>sell</DefinedTermEn> includes sell, offer for sale, expose for sale, have in possession for sale and improvement of the physical condition of soils or to aid plant growth or crop yields; (<DefinedTermFr>supplément</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-15" lims:enacted-date="2012-11-22" lims:fid="222157" lims:id="1109997"><Text><DefinedTermEn>Tribunal</DefinedTermEn> means the Review Tribunal continued by subsection 27(1) of the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="222158" lims:id="222158"><Text><DefinedTermEn>violation</DefinedTermEn> means any contravention of this Act or the regulations that may be proceeded with in accordance with the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties lims:id="222192"><Label>(1)</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222193" lims:id="222193"><Label>(a)</Label><Text>respecting applications for registration or for approval of fertilizers or supplements and the information to be furnished with the applications;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222194" lims:id="222194"><Label>(b)</Label><Text>respecting the registration of fertilizers and supplements and prescribing fees for registration;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222195" lims:id="222195"><Label>(b.1)</Label><Text>respecting the approval of fertilizers and supplements;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222196" lims:id="222196"><Label>(c)</Label><Text>respecting the duration and cancellation of the registration or approval of fertilizers and supplements;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222197" lims:id="222197"><Label>(c.1)</Label><Text>respecting the manufacturing, sale, importation or exportation of any fertilizer or supplement that presents a risk of harm to human, animal or plant health or the environment;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222198" lims:id="222198"><Label>(c.2)</Label><Text>respecting the sending or conveying from one province to another or the importation or exportation of any fertilizer or supplement;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222199" lims:id="222199"><Label>(c.3)</Label><Text>respecting the manufacturing or sale of any fertilizer or supplement that is to be exported or to be sent or conveyed from one province to another;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222200" lims:id="222200"><Label>(c.4)</Label><Text>respecting the sale of any fertilizer or supplement that has been imported;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222201" lims:id="222201"><Label>(d)</Label><Text>exempting, with or without conditions, any item to which this Act applies, or a person or activity in respect of a fertilizer or supplement, from the application of this Act or the regulations or a provision of this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222202" lims:id="222202"><Label>(e)</Label><Text>prescribing the form, composition and other standards for fertilizers and supplements;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222203" lims:id="222203"><Label>(f)</Label><Text>respecting the packaging of fertilizers and supplements and the labelling of packages thereof;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222204" lims:id="222204"><Label>(f.1)</Label><Text>respecting the evaluation of a fertilizer or supplement, including regulations respecting</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222205" lims:id="222205"><Label>(i)</Label><Text>the provision of samples of the fertilizer or supplement,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222206" lims:id="222206"><Label>(ii)</Label><Text>the provision of information in respect of the fertilizer or supplement, including information that</Text><Clause lims:inforce-start-date="2015-02-27" lims:fid="222207" lims:id="222207"><Label>(A)</Label><Text>permits the fertilizer or supplement to be distinguished from other fertilizers or supplements, and</Text></Clause><Clause lims:inforce-start-date="2015-02-27" lims:fid="222208" lims:id="222208"><Label>(B)</Label><Text>is required for evaluating the potential impact of the fertilizer or supplement on, and the risk of harm posed by the fertilizer or supplement to, human, animal or plant health or the environment, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222209" lims:id="222209"><Label>(iii)</Label><Text>the evaluation of the potential impact of the fertilizer or supplement on, and the risk of harm posed by the fertilizer or supplement to, human, animal or plant health or the environment;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222210" lims:id="222210"><Label>(g)</Label><Text>respecting the taking of samples and the making of analyses for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222211" lims:id="222211"><Label>(g.1)</Label><Text>requiring persons to take or keep samples of any fertilizer or supplement, or its package or label, and to provide the Minister or an inspector with, or with access to, those samples, and respecting the manner in which those samples are to be taken or kept and the manner in which they are to be provided or access to them is to be provided;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222212" lims:id="222212"><Label>(h)</Label><Text>providing that fertilizers registered under this Act and containing a pest control product as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="P-9">Pest Control Products Act</XRefExternal> are, in prescribed circumstances and subject to prescribed conditions, deemed to be registered under that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222213" lims:id="222213"><Label>(h.1)</Label><Text>respecting</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222214" lims:id="222214"><Label>(i)</Label><Text>the registration of persons or the issuing of licences to persons under section 5.2 or the registration of establishments under section 5.3,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222215" lims:id="222215"><Label>(ii)</Label><Text>the suspension, cancellation and renewal of those licences and registrations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222216" lims:id="222216"><Label>(iii)</Label><Text>the amendment of those licences and registrations or of any of the conditions to which they are subject by reason of subsection 5.2(3) or 5.3(4);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222217" lims:id="222217"><Label>(h.2)</Label><Text>respecting quality management programs, quality control programs, safety programs, preventive control plans or any other similar programs or plans to be implemented by persons who conduct any activity regulated under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222218" lims:id="222218"><Label>(i)</Label><Text>respecting the detention, preservation and safeguarding of anything seized under section 9;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222219" lims:id="222219"><Label>(j)</Label><Text>respecting the disposition of anything forfeited under section 9;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222220" lims:id="222220"><Label>(j.1)</Label><Text>requiring persons to prepare, keep or maintain documents and to provide the Minister or an inspector with, or with access to, those documents, and respecting</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222221" lims:id="222221"><Label>(i)</Label><Text>the information in those documents,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222222" lims:id="222222"><Label>(ii)</Label><Text>the manner in which they are to be prepared, kept or maintained,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222223" lims:id="222223"><Label>(iii)</Label><Text>the place where they are to be kept or maintained, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="222224" lims:id="222224"><Label>(iv)</Label><Text>the manner in which they are to be provided or access to them is to be provided;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222225" lims:id="222225"><Label>(j.2)</Label><Text>respecting the issuance of certificates or other documents for the purpose of section 5.5;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222226" lims:id="222226"><Label>(k)</Label><Text>prescribing anything else that by this Act is required to be prescribed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222227" lims:id="222227"><Label>(l)</Label><Text>generally, for carrying lims:inforce-start-date="2015-02-27" lims:fid="222229" lims:id="222229">Paragraphs (1)(c.1) and (c.2)</MarginalNote><Label>(1.1)</Label><Text>Regulations made under paragraph (1)(c.1) or (c.2) may, among other things, establish preclearance or in-transit requirements for any imported fertilizer or supplement or anything imported with it.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222230" lims:id="222230"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222231" lims:id="222231">Paragraph (1)(j.1)</MarginalNote><Label>(1.2)</Label><Text>Regulations made under paragraph (1)(j.1) may, among other things, require persons who conduct any activity regulated under this Act and who become aware that a fertilizer or supplement presents a risk of harm to human, animal or plant health or the environment or does not meet the requirements of the regulations to provide written notice to that effect to the Minister or an inspector.</Text></Subsection><Subsection lims:inforce-start-date="2020-07-01" lims:enacted-date="2020-03-13" lims:fid="222232" lims:id="1253531"><MarginalNote lims:inforce-start-date="2020-07-01" lims:enacted-date="2020-03-13" lims:fid="1253532" lims:id="1253532">Regulations — international agreements</MarginalNote><Label>(2)</Label><Text>Without limiting the authority conferred by subsection (1), the Governor in Council may make any regulations the Governor in Council considers necessary for the purpose of implementing, in relation to fertilizers or supplements, any of the following provisions:</Text><Paragraph lims:inforce-start-date="2020-07-01" lims:enacted-date="2020-03-13" lims:fid="1253533" lims:id="1253533"><Label>(a)</Label><Text>Article lims:id="222303">Designation</MarginalNote><Label>(1.1)</Label><Text>The President of the Canada Border Services Agency may designate inspectors under paragraph 9(2)(b) of the <XRefExternal reference-type="act" link="C-1.4">Canada Border Services Agency Act</XRefExternal> for the purposes of enforcing this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" shall be given certificates in a form established by the President of the Canadian Food Inspection Agency or the President of the Canada Border Services Agency, as the case may be, attesting to their designation and, on entering any place under subsection 7(1), an inspector shall, if so required, produce the certificate to the person in charge of that and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222314" lims:id="222314"><Label>(d)</Label><Text>remove anything from that place for the purpose of examination, conducting tests or taking samples.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222315" lims:id="222315"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222316" lims:id="222316">Warrant required to enter dwelling-house</MarginalNote><Label>(1.1)</Label><Text>Where any place referred to in paragraph (1)(a) is a dwelling-house, an inspector may not enter that dwelling-house without the consent of the occupant except under the authority of a warrant issued under subsection (1.2).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222317" lims:id="222317"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222318" lims:id="222318">Authority to issue warrant</MarginalNote><Label>(1.2)</Label><Text>Where on <Language xml:lang="la">ex parte</Language> application a justice of the peace is satisfied by information on oath</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222319" lims:id="222319"><Label>(a)</Label><Text>that the conditions for entry described in paragraph (1)(a) exist in relation to a dwelling-house,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222320" lims:id="222320"><Label>(b)</Label><Text>that entry to the dwelling-house is necessary for any purpose relating to the administration or enforcement of this Act, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222321" lims:id="222321"><Label>(c)</Label><Text>that entry to the dwelling-house has been refused or that there are reasonable grounds for believing that entry thereto will be refused,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-27" lims:fid="222322" lims:id="222322"><Text>the justice of the peace may issue a warrant under his hand authorizing the inspector named therein to enter that dwelling-house subject to such conditions as may be specified in the warrant.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222323" lims:id="222323"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222324" lims:id="222324">Use of force</MarginalNote><Label>(1.3)</Label><Text>In executing a warrant issued under subsection (1.2), the inspector named therein shall not use force unless the inspector is accompanied by a peace officer and the use of force has been specifically authorized in the warrant.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222325" lims:id="222325"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222326" lims:id="222326">Assistance to inspectors</MarginalNote><Label>(2)</Label><Text>The owner or person in charge of any place described in subsection (1) and every person found in that place shall give an inspector all reasonable assistance to enable the inspector to carry out his duties and functions under this Act and shall furnish the inspector with any information he may reasonably require with respect to the administration of this Act and the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222327" lims:id="222327"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222328" lims:id="222328">Provision of documents, information or samples</MarginalNote><Label>(3)</Label><Text>An inspector may, for a purpose related to verifying compliance or preventing non-compliance with this Act, order a person to provide, on the date, at the time and place and in the manner specified by the inspector, any document, information or sample specified by the inspector.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-27" lims:fid="222330" lims:id="222330">R.S., 1985, c. F-9, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="222338" lims:id="222338"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222339" lims:id="222339">Seizure</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222340" lims:id="222340"><Label>(1)</Label><Text>Where an inspector believes on reasonable grounds that this Act or the regulations have been contravened, the inspector may seize any article by means of or in relation to which the inspector believes on reasonable grounds the contravention was committed.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222341" lims:id="222341"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222342" lims:id="222342">Release of seized article</MarginalNote><Label>(2)</Label><Text>If an inspector is satisfied that the provisions of this Act and the regulations that apply with respect to an article seized under this Act have been complied with, the article must be released.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222343" lims:id="222343"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222344" lims:id="222344">Forfeiture</MarginalNote><Label>(3)</Label><Text>Where the Tribunal decides that a person has committed a violation, or a person is convicted of an offence under this Act, the Tribunal or the convicting court, as the case may be, may, in addition to any penalty or punishment imposed, order that any article by means of or in relation to which the violation or offence was committed, be forfeited to Her Majesty in right of Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-27" lims:fid="222346" lims:id="222346">R.S., 1985, c. F-10, s. 9; 1995, c. 40, s. 51; 2015, c. 2, s. 69</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="222347" lims:id="222347"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222348" lims:id="222348">Removal or destruction of unlawful imports</MarginalNote><Label>9.1</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222349" lims:id="222349"><Label>(1)</Label><Text>An inspector who has reasonable grounds to believe that an imported fertilizer or supplement does not meet the requirements of the regulations or was imported in contravention of a provision of this Act or the regulations may, by notice, whether the fertilizer or supplement is seized or not, order its owner or importer or the person having possession, care or control of it to remove it from Canada or, if removal is not possible, to destroy it.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222350" lims:id="222350"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222351" lims:id="222351">Notice</MarginalNote><Label>(2)</Label><Text>The notice must either be delivered personally to the owner or importer of the fertilizer or supplement or to the person having possession, care or control of it or be sent by registered mail to the owner’s, importer’s or person’s address in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222352" lims:id="222352"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222353" lims:id="222353">Forfeiture</MarginalNote><Label>(3)</Label><Text>If the fertilizer or supplement is not removed from Canada or destroyed within the period specified in the notice — or, if no period was specified, within 90 days after the day on which the notice was delivered or sent — it is, despite subsection 9(2), forfeited to Her Majesty in right of Canada and may be disposed of as the Minister may direct.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222354" lims:id="222354"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222355" lims:id="222355">Suspension of application of subsection (3)</MarginalNote><Label>(4)</Label><Text>An inspector may, for a period that he or she specifies, suspend the application of subsection (3) if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222356" lims:id="222356"><Label>(a)</Label><Text>harm to human, animal or plant health or the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222357" lims:id="222357"><Label>(b)</Label><Text>the fertilizer or supplement will not be sold within that period;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222358" lims:id="222358"><Label>(c)</Label><Text>the measures that should have been taken for the fertilizer or supplement not to have been imported in contravention of a provision of this Act or the regulations will be taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222359" lims:id="222359"><Label>(d)</Label><Text>if the fertilizer or supplement does not meet the requirements of the regulations, it will be brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222360" lims:id="222360"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222361" lims:id="222361">Cancellation</MarginalNote><Label>(5)</Label><Text>An inspector may cancel the notice if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222362" lims:id="222362"><Label>(a)</Label><Text>harm to human, animal or plant health or the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222363" lims:id="222363"><Label>(b)</Label><Text>the fertilizer or supplement has not been sold within the period referred to in subsection (6);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222364" lims:id="222364"><Label>(c)</Label><Text>the measures referred to in paragraph (4)(c) were taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222365" lims:id="222365"><Label>(d)</Label><Text>if the fertilizer or supplement did not meet the requirements of the regulations when it was imported, it was brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="222366" lims:id="222366"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="222367" lims:id="222367">Period</MarginalNote><Label>(6)</Label><Text>The period for the purposes of subsection (5) is</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="222368" lims:id="222368"><Label>(a)</Label><Text>if the application of subsection (3) was suspended under subsection (4), the period of the suspension;
