scientific certainty regarding the risks posed by certain human pathogens and toxins is not to be used as a reason to postpone measures that protect the health, safety and security of the lims:fid="254970" lims:id="254970"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254971" lims:id="1572422"><Text><DefinedTermEn>controlled activity</DefinedTermEn>, in respect of a human pathogen or toxin, means any of the following activities:</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572423" lims:id="1572423"><Label>(a)</Label><Text>possessing, handling or using it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572424" lims:id="1572424"><Label>(b)</Label><Text>producing it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572425" lims:id="1572425"><Label>(c)</Label><Text>storing it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572426" lims:id="1572426"><Label>(d)</Label><Text>permitting any person access to it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572427" lims:id="1572427"><Label>(e)</Label><Text>transferring it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572428" lims:id="1572428"><Label>(f)</Label><Text>importing or exporting it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572429" lims:id="1572429"><Label>(g)</Label><Text>releasing or otherwise abandoning it; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572430" lims:id="1572430"><Label>(h)</Label><Text>disposing of it. (<DefinedTermFr>activité réglementée</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254972" lims:id="254972"><Text><DefinedTermEn>conveyance</DefinedTermEn> means a vessel, aircraft, train, motor vehicle, trailer or other means of transportation, including a cargo container. (<DefinedTermFr>véhicule</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254973" lims:id="254973"><Text><DefinedTermEn>disease</DefinedTermEn> includes intoxication. (<DefinedTermFr>maladie</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254974" lims:id="1572431"><Text><DefinedTermEn>human pathogen</DefinedTermEn> means a micro-organism, nucleic acid or protein that</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572432" lims:id="1572432"><Label>(a)</Label><Text>is listed in the registry or in Part 2 of the schedule; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572433" lims:id="1572433"><Label>(b)</Label><Text>is not listed in the registry or in Part 2 of the schedule but falls into Risk Group 2, Risk Group 3 or Risk Group 4. (<DefinedTermFr>agent pathogène humain</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254977" lims:id="254977"><Text><DefinedTermEn>licence</DefinedTermEn> means a licence issued under section <XRefInternal>18</XRefInternal>. (<DefinedTermFr>permis</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254978" lims:id="254978"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Health. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254979" lims:id="254979"><Text><DefinedTermEn>person</DefinedTermEn> means an individual or an organization as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>. (<DefinedTermFr>personne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254980" lims:id="254980"><Text><DefinedTermEn>personal information</DefinedTermEn> has the same meaning as in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>. (<DefinedTermFr>renseignements personnels</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254981" lims:id="254981"><Text><DefinedTermEn>possession</DefinedTermEn> has the same meaning as in subsection 4(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>. (<DefinedTermFr>possession</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254982" lims:id="254982"><Text><DefinedTermEn>produce</DefinedTermEn>, in respect of a human pathogen or toxin, means to create it by any method or process, including</Text><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="254983" lims:id="254983"><Label>(a)</Label><Text>by manufacturing, cultivating, developing, reproducing or synthesizing it; or</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="254984" lims:id="254984"><Label>(b)</Label><Text>by converting or refining a substance, micro-organism, nucleic acid or protein, or by using any other means of altering its physical or chemical properties. (<DefinedTermFr>production</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572441" lims:id="1572441"><Text><DefinedTermEn>registry</DefinedTermEn> means the registry established under subsection 9(1). (<DefinedTermFr>registre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254985" lims:id="254985"><Text><DefinedTermEn>release</DefinedTermEn> means any discharge, anywhere, and includes leaking, spraying, depositing, dumping or vaporizing. (<DefinedTermFr>rejet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254986" lims:id="1572434"><Text><DefinedTermEn>Risk Group 2</DefinedTermEn> means a category of human pathogens that pose a moderate risk to the health of individuals and a low risk to public health and includes the human pathogens listed under Risk Group 2 in the registry. They are able to cause serious disease in a human but are unlikely to do so. Effective treatment and preventive measures are available and the risk of spread of disease caused by those pathogens is low. (<DefinedTermFr>groupe de risque 2</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254987" lims:id="1572435"><Text><DefinedTermEn>Risk Group 3</DefinedTermEn> means a category of human pathogens that pose a high risk to the health of individuals and a low risk to public health and includes the human pathogens listed under Risk Group 3 in the registry. They are likely to cause serious disease in a human. Effective treatment and preventive measures are usually available and the risk of spread of disease caused by those pathogens is low. (<DefinedTermFr>groupe de risque 3</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254988" lims:id="1572436"><Text><DefinedTermEn>Risk Group 4</DefinedTermEn> means a category of human pathogens that pose a high risk to the health of individuals and a high risk to public health and includes the human pathogens listed under Risk Group 4 in the registry. They are likely to cause serious disease in a human. Effective treatment and preventive measures are not usually available and the risk of spread of disease caused by those pathogens is high. (<DefinedTermFr>groupe de risque 4</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-06-23" lims:fid="254989" lims:id="254989"><Text><DefinedTermEn>security clearance</DefinedTermEn> means a security clearance issued under section <XRefInternal>34</XRefInternal>. (<DefinedTermFr>habilitation de sécurité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="254990" lims:id="1572437"><Text><DefinedTermEn>toxin</DefinedTermEn> means a substance that is produced by, or derived from, a micro-organism and that</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572438" lims:id="1572438"><Label>(a)</Label><Text>may or may not be listed in the registry and poses a moderate to high risk to the health of individuals;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572439" lims:id="1572439"><Label>(b)</Label><Text>is listed in the registry and poses a moderate to high risk to the health, safety or security of the public due to a reasonable risk of intentional use as a biological weapon, with the risk and minimum quantity at which it poses that risk indicated in accordance with paragraph 9(2)(a); or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572440" lims:id="1572440"><Label>(c)</Label><Text>is listed in Part 1 of the schedule. (<DefinedTermFr>toxine</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="254991" lims:id="254991"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="254992" lims:id="254992">Included</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, a human pathogen or toxin includes</Text><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="254993" lims:id="254993"><Label>(a)</Label><Text>a substance that contains a human pathogen or toxin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="254994" lims:id="254994"><Label>(b)</Label><Text>any synthetic form of the human pathogen or toxin.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572443" lims:id="1572443" to</Text><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="254997" lims:id="254997"><Label>(a)</Label><Text>a human pathogen or toxin that is in an environment in which it naturally occurs if it has not been cultivated or intentionally collected or extracted, including a human pathogen or toxin that</Text><Subparagraph lims:inforce-start-date="2012-06-29" lims:fid="254998" lims:id="254998"><Label>(i)</Label><Text>is in or on a human suffering from a disease caused by that human pathogen or toxin,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-06-29" lims:fid="254999" lims:id="254999"><Label>(ii)</Label><Text>has been expelled by a human suffering from a disease caused by that human pathogen or toxin, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-06-29" lims:fid="255000" lims:id="255000"><Label>(iii)</Label><Text>is in or on a cadaver, a body part or other human remains; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255001" lims:id="1572445"><Label>(b)</Label><Text>a drug in dosage form or a device whose sale is permitted or otherwise authorized under the <XRefExternal reference-type="act" link="F-27">Food and Drugs Act</XRefExternal> or a human pathogen or toxin contained in such a by, or derived from, a micro-organism and poses a moderate to high risk to the health, safety or security of the public due to a reasonable risk of intentional use as a biological weapon; that it falls into Risk Group 2, Risk Group 3 or Risk Group 4, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572494" lims:id="1572494"><Label>(ii)</Label><Text>any substance if they are of the opinion that it is produced by, or derived from a micro-organism and it poses a moderate to high risk to the health of lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572496" lims:id="1572496">Minister’s obligation</MarginalNote><Label>(2)</Label><Text>The Minister must indicate in the registry</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572497" lims:id="1572497"><Label>(a)</Label><Text>in the case of a substance referred to in paragraph (1)(a), that</Text><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572498" lims:id="1572498"><Label>(i)</Label><Text>it poses a moderate to high micro-organism, nucleic acid or protein referred to in subparagraph (1)(b)(i), the risk group into which, in the opinion of the Minister, it falls.</Text></Paragraph></Subsection><Subsection lims:fid="1572502" lims:id="1572502">Minimum quantity</MarginalNote><Label>(3)</Label><Text>The Minister may, for any substance referred to in subparagraph (1)(b)(ii) that is listed in the registry, identify in the registry the minimum quantity at which, in the opinion of the Minister, the substance poses the risk referred to in that subparagraph.</Text></Subsection><Subsection lims:id="1572507"><Label>(a)</Label><Text>amend the risk group of a human pathogen if the Minister is of the opinion that it falls into a risk group that is different from the one under which it is listed in the registry;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572508" lims:id="1572508"><Label>(b)</Label><Text>add the references referred to in paragraph (2)(a) if the Minister is of the opinion that the toxin that is listed in the registry poses a risk referred to in paragraph (1)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572509" lims:id="1572509"><Label>(c)</Label><Text>remove the references referred to in paragraph (2)(a) if the Minister is of the opinion that the toxin that is listed in the registry does not pose a risk referred to in paragraph (1)(a); and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572510" lims:id="1572510"><Label>(d)</Label><Text>amend the minimum quantity that is listed for a toxin if the Minister is of the opinion that it is not the minimum quantity at which the toxin poses a risk referred to in paragraph (1)(a) or subparagraph (1)(b)(ii).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:fid="1572514" lims:id="1572514">Accessibility of the registry</MarginalNote><Label>(7)</Label><Text>The Minister must make the registry accessible to the public by electronic means and by any result of the update to the registry, no longer has lawful possession of a human pathogen or toxin must</Text><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255067" lims:id="255067"><Label>(a)</Label><Text>dispose of it in accordance with the regulations, if any;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255068" lims:id="255068"><Label>(b)</Label><Text>transfer it to a facility where controlled activities in relation to it are authorized; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255069" lims:id="255069"><Label>(c)</Label><Text>obtain from the Minister a licence, or a variation of the conditions of their existing licence, authorizing possession of it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255070" lims:id="1572550"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572551" lims:id="1572551">Prohibited possession — schedule</MarginalNote><Label>(2)</Label><Text>Within 14 days after the date of publication of a regulation made under subsection 10(1), every person who, as a result of the regulation, no longer has lawful possession of a human pathogen or toxin must dispose of it in accordance with the regulations, if any.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255072" lims:id="1572552"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572553" lims:id="1572553">No contravention</MarginalNote><Label>(3)</Label><Text>No person contravenes subsection 7(1) or section 8 by reason only that they possess a human pathogen or toxin in the circumstances described in subsection (1) or (2) if they transfer or dispose of it or obtain a licence or a variation of their existing licence authorizing possession of it, in accordance with subsection (1) or (2).</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572554" lims:id="1572554"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572555" lims:id="1572555">Defence</MarginalNote><Label>(4)</Label><Text lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572562" lims:id="1572562">If a human pathogen or toxin is listed in the registry, then no person may be convicted of an offence — in relation to that human pathogen or toxin — for the contravention of this Act or the regulations unless it is proved that, at the time of the alleged contravention,</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572556" lims:id="1572556"><Label>(a)</Label><Text>the registry with the human pathogen or toxin listed in it was reasonably accessible to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572557" lims:id="1572557"><Label>(b)</Label><Text>the human pathogen or toxin was listed in the registry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572558" lims:id="1572558"><Label>(c)</Label><Text>the registry indicated, in relation to the human pathogen or toxin,</Text><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572559" lims:id="1572559"><Label>(i)</Label><Text>the risk group into which the human pathogen falls,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572560" lims:id="1572560"><Label>(ii)</Label><Text>if the toxin poses a moderate to high risk to the health, safety or security of the public due to a reasonable risk of intentional use as a biological weapon, the references referred to in paragraph 9(2)(a), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572561" lims:id="1572561"><Label>(iii)</Label><Text>the minimum quantity at which the toxin poses a moderate to high risk to the health of individuals, if any.</Text></Subparagraph></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-03-26" lims:id="1572567"><Label>(1)</Label><Text>If a licence holder has reasonable grounds to suspect that a human pathogen or toxin has been released inadvertently from a facility in the course of a controlled activity authorized by the licence, the licence holder must, without delay, inform the Minister of the release and provide the Minister with the information referred to in subsection (3) that is under the licence holder’s control.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255078" lims:id="255078"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255079" lims:id="255079">Inadvertent production</MarginalNote><Label>(2)</Label><Text>If a person is in possession of a human pathogen or toxin in contravention of subsection <XRefInternal>7</XRefInternal>(1) or section <XRefInternal>8</XRefInternal> as a result of the inadvertent production of that human pathogen or toxin in the course of an activity that is otherwise lawful, the person shall</Text><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255080" lims:id="255080"><Label>(a)</Label><Text>without delay, inform the Minister of the inadvertent production and provide the Minister with the information referred to in subsection (3) that is under the person’s control; and</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255081" lims:id="1572568"><Label>(b)</Label><Text>dispose of the inadvertently produced human pathogen or toxin in accordance with the regulations, if any, or, if it is not listed in the schedule, transfer it to a facility where controlled activities in relation to that human pathogen or toxin are authorized.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255082" lims:id="255082"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255083" lims:id="255083">Information</MarginalNote><Label>(3)</Label><Text>The information that is to be provided under subsections (1) and (2) is the following:</Text><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255084" lims:id="255084"><Label>(a)</Label><Text>any information that supports the conclusion that a human pathogen or toxin has been released or produced;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255085" lims:id="255085"><Label>(b)</Label><Text>the name of the human pathogen or toxin released or produced;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255086" lims:id="255086"><Label>(c)</Label><Text>the quantity released or produced;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255087" lims:id="255087"><Label>(d)</Label><Text>the place and time of the release or production; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255088" lims:id="255088"><Label>(e)</Label><Text>any other information relating to the release or production that the Minister may require.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255089" lims:id="255089"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255090" lims:id="255090">No contravention</MarginalNote><Label>(4)</Label><Text>No person contravenes subsection <XRefInternal>7</XRefInternal>(1) or section <XRefInternal>8</XRefInternal> by reason only that they possess a human pathogen or toxin in the circumstances described in subsection (2) if they transfer or dispose of it in accordance with that possession has, or may have, caused disease in an individual, the licence holder must, without delay, inform the Minister of the incident and provide the Minister with the following information that is under the licence holder’s control:</Text><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255093" lims:id="255093"><Label>(a)</Label><Text>a description of the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255094" lims:id="255094"><Label>(b)</Label><Text>the name of the human pathogen or toxin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255095" lims:id="255095"><Label>(c)</Label><Text>any other information relating to the incident that the Minister may human pathogen or toxin</MarginalNote><Label>14</Label><Text>If a licence holder has reasonable grounds to suspect that a human pathogen or toxin that was in their possession has been stolen or is otherwise missing, the licence holder must, without delay, inform the Minister and provide the Minister with any information relating to the incident that is under their control and that the Minister may require. information provided under sections 12 to 15 by a licence holder or a person conducting controlled activities under the authority of a licence may be used or received against that person in any criminal proceedings that are subsequently instituted against them, other than with respect to a contravention of section 17 or in respect of an allegation that the licence holder or person conducting controlled activities has shown wanton or reckless disregard for the health, safety or security of other persons.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-03-26" communicated to the Minister false or misleading information in relation to a matter under this Act or the regulations.</Text></Section><Heading lims:inforce-start-date="2015-12-01" lims:fid="255104" lims:id="255104" level="1"><TitleText>Licences</TitleText></Heading><Section lims:inforce-start-date="2015-12-01" lims:lastAmendedDate="2026-03-26" lims:fid="255105" lims:id="255105"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255106" lims:id="255106">Issuance</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255107" lims:id="1572591"><Label>(1)</Label><Text>The Minister may, in accordance with the regulations, if any, issue a licence that authorizes any controlled activity in any facility if the Minister is of the opinion that the conduct of the controlled activity in the facility poses no undue risk to the health, safety or security of the public.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572592" lims:id="1572592"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572593" lims:id="1572593">Conditions</MarginalNote><Label>(1.1)</Label><Text>Despite subsection (1), the Minister may issue a licence only if,</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572594" lims:id="1572594"><Label>(a)</Label><Text>in the case that the applicant is an individual, the applicant and the biological safety officer designated for the licence are ordinarily resident in Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572595" lims:id="1572595"><Label>(b)</Label><Text>in the case that the applicant is an organization, the applicant is incorporated, formed or otherwise organized in Canada and its representative and the biological safety officer designated for the licence are ordinarily resident in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572596" lims:id="1572596"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572597" lims:id="1572597">Debts due to His Majesty</MarginalNote><Label>(1.2)</Label><Text>In exercising the power conferred by subsection (1), the Minister may consider whether an applicant or any organization with which an applicant is or was affiliated owes an amount referred to in section 65.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255108" lims:id="255108"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255109" lims:id="255109">Licence application</MarginalNote><Label>(2)</Label><Text>An application for a licence must be filed with the Minister and made in the form and manner specified by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255110" lims:id="1572598"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572599" lims:id="1572599">Refusal to issue licence</MarginalNote><Label>(3)</Label><Text>If the Minister refuses to issue a licence, the Minister must notify the applicant in writing of the reasons for the refusal.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255112" lims:id="1572600"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572601" lims:id="1572601">Conditions</MarginalNote><Label>(4)</Label><Text>A licence authorizes the controlled activities that are specified in it and is subject to any conditions that the Minister considers appropriate to protect the health, safety and security of the public.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572602" lims:id="1572602"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572603" lims:id="1572603">Conditions — transportation</MarginalNote><Label>(4.1)</Label><Text>If the Minister considers it appropriate to impose licence conditions for the conduct of controlled activities to which the <XRefExternal reference-type="act" link="T-19.01">Transportation of Dangerous Goods Act, 1992</XRefExternal> applies, they must consult with the Minister of Transport and may consult with any other person the Minister considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572604" lims:id="1572604"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572605" lims:id="1572605">Failure to consult</MarginalNote><Label>(4.2)</Label><Text>The failure of the Minister to comply with the requirement to consult under subsection (4.1) does not exempt the licence holder and all persons conducting the controlled activities authorized by the licence from the obligation to comply with the licence conditions.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255114" lims:id="255114"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255115" lims:id="255115">Other conditions</MarginalNote><Label>(5)</Label><Text>A licence must also set out</Text><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255116" lims:id="1572606"><Label>(a)</Label><Text>the licence holder’s name and, if applicable, the name of the individual who is designated as a representative for the licence holder;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572607" lims:id="1572607"><Label>(a.1)</Label><Text>the biological safety officer’s name;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255117" lims:id="255117"><Label>(b)</Label><Text>the period during which the licence is in effect;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255118" lims:id="255118"><Label>(c)</Label><Text>a description of the facility in which controlled activities are authorized under it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255119" lims:id="255119"><Label>(d)</Label><Text>a description of each part of the facility that is subject to section <XRefInternal>33</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255120" lims:id="255120"><Label>(e)</Label><Text>the toxins, human pathogens, or the risk groups of the human pathogens, in respect of which controlled activities are authorized under it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255121" lims:id="255121"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255122" lims:id="255122">Obligation of licence holder</MarginalNote><Label>(6)</Label><Text>The licence holder shall inform all persons conducting the controlled activities authorized by the licence of its conditions.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255123" lims:id="255123"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255124" lims:id="255124">Compliance with licence conditions</MarginalNote><Label>(7)</Label><Text>A licence holder and all persons conducting the controlled activities authorized by the licence shall comply with the licence conditions.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255125" lims:id="255125"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255126" lims:id="255126"><XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal></MarginalNote><Label>(8)</Label><Text>A licence is not a statutory instrument within the meaning of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments in accordance with the regulations, if any, on the Minister’s own initiative or on the application of a licence holder, vary a licence if the conditions referred to in subsections 18(1) and (1.1) are satisfied.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572614" lims:id="1572614"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572630" lims:id="1572630"><Label>(b)</Label><Text>a licence holder who is an individual or the biological safety officer designated for the licence is not ordinarily resident in Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572631" lims:id="1572631"><Label>(c)</Label><Text>a licence holder that is an organization is incorporated, formed or otherwise organized outside Canada or that its representative or the biological safety officer designated for the licence is not ordinarily resident in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255137" lims:id="255137"><MarginalNote lims:inforce-start-date="2015-12-01" lims:id="255143"><Label>(a)</Label><Text>dispose of the human pathogen or toxin in accordance with the regulations, if any; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255144" lims:id="255144"><Label>(b)</Label><Text>transfer the human pathogen or toxin to a facility where controlled activities in relation to the human pathogen or toxin are decision takes effect 31 days after the day on which the notice is received.</Text></Subsection></Section><Section lims:inforce-start-date="2015-12-01" lims:lastAmendedDate="2026-03-26" danger to the health, safety or security of the public, the Minister must notify the licence holder orally of the decision to suspend or revoke their licence.</Text></Subsection><Subsection date</MarginalNote><Label>(2)</Label><Text>The decision takes effect at the time that the licence holder is notified of it and the licence holder is advised that it is effective review, the Minister shall, within a reasonable time, refer the decision to which the request relates to a committee that is to consist of three individuals who have expertise in the area of human lims:id="255179">Designation of committee members</MarginalNote><Label>(2)</Label><Text>One of the members of the committee is to be designated by the Minister and another by the person who requests the review.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255180" lims:id="255180"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255181" lims:id="255181">Chairperson</MarginalNote><Label>(3)</Label><Text>The two members designated under subsection (2) shall designate a third member of the committee, who shall be its chairperson. If they are unable to designate the third member within a reasonable time, the Minister shall make the designation.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255182" lims:id="255182"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255183" lims:id="255183">Remuneration</MarginalNote><Label>(4)</Label><Text>The members of the committee may be paid for the carrying out of their functions any remuneration that the Governor in Council may determine.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255184" lims:id="255184"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255185" lims:id="255185">Travel, living and other expenses</MarginalNote><Label>(5)</Label><Text>The members of the committee are entitled to be paid, in accordance with Treasury Board directives, reasonable travel, living and other expenses incurred in the carrying out of their functions.</Text></Subsection></Section><Section lims:inforce-start-date="2015-12-01" lims:lastAmendedDate="2015-12-01" lims:fid="255186" lims:id="255186"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255187" lims:id="255187">Factors to be considered</MarginalNote><Label>26</Label><Text>A committee to which a decision is referred shall consider</Text><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255188" lims:id="255188"><Label>(a)</Label><Text>the reasons for the decision;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255189" lims:id="255189"><Label>(b)</Label><Text>the reasons stated by the person who requested the review; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-12-01" lims:fid="255199" lims:id="255199"><Label>(b)</Label><Text>send the Minister’s final decision by registered mail to the person who requested the review.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255200" lims:id="255200"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255201" lims:id="255201">Effect</MarginalNote><Label>(2)</Label><Text>The Minister’s final decision takes effect on the day after the day on which it is received.</Text></Subsection></Section><Section lims:inforce-start-date="2015-12-01" lims:lastAmendedDate="2015-12-01" lims:fid="255202" lims:id="255202"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255203" lims:id="255203">Duty to inform</MarginalNote><Label>30</Label><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255204" lims:id="255204"><Label>(1)</Label><Text>A person whose licence is suspended or revoked shall, without delay, inform all persons conducting controlled activities authorized by it of its suspension or revocation.</Text></Subsection><Subsection lims:inforce-start-date="2015-12-01" lims:fid="255205" lims:id="255205"><MarginalNote lims:inforce-start-date="2015-12-01" lims:fid="255206" lims:id="255206">Return of revoked licence</MarginalNote><Label>(2)</Label><Text>A person whose licence is revoked shall return it by registered mail to the Minister as soon as feasible after the Minister’s decision takes effect or, if the decision is reviewed, as soon as feasible after the Minister’s final decision takes effect.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-12-01" lims:fid="255207" lims:id="255207" level="1"><TitleText>Access to Facility to Which Licence Applies</TitleText></Heading><Section lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:lastAmendedDate="2026-03-26" lims:fid="255208" lims:id="1572646"><MarginalNote lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572647" lims:id="1572647">List of authorized persons</MarginalNote><Label>31</Label><Text>A licence holder must establish and maintain a list of all persons authorized by the licence holder to access the facility — including remote access by a means of telecommunication — to which the licence applies, including persons holding a security clearance for that facility and visitors. Minister may order an applicant, a licence holder or a biological safety officer to provide the Minister, in accordance with any conditions that the Minister may specify, with any information that is under that person’s control, including personal information and confidential business information, and that the Minister believes, on reasonable grounds, is relevant to the administration of this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255261" lims:id="1572677"><MarginalNote lims:id="1572682"><Label>(d)</Label><Text>regarding the controlled activities that are authorized by a licence or in respect of which an application for a licence has been lims:id="255268">Obligation to provide information</MarginalNote><Label>(3)</Label><Text>An applicant, a licence holder or a biological safety officer shall provide the Minister with the information, time that may be necessary any material, equipment or document found there, or any conveyance;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255293" lims:id="255293"><Label>(d)</Label><Text>open and examine any receptacle or package found there;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255294" lims:id="255294"><Label>(e)</Label><Text>take, or require any person in the place or conveyance to produce, free of charge, a sample of any material found there;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255295" lims:id="255295"><Label>(f)</Label><Text>direct the owner or the person having possession, care or control of any material, equipment or document found in the place or conveyance — or of the conveyance — to move it or, for any time that may be necessary, not to move it or to restrict its movement;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255296" lims:id="255296"><Label>(g)</Label><Text>conduct, or require any person in the place or conveyance to conduct, any test or analysis or take any measurement of any material or equipment found there;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255297" lims:id="255297"><Label>(h)</Label><Text>take photographs or make recordings or sketches;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255298" lims:id="1572714"><Label>(i)</Label><Text>use or cause to be used any <DefinitionRef>computer system</DefinitionRef>, as defined in subsection 342.1(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or any means of telecommunication found there to examine electronic data that is contained in or available to the computer system or means of telecommunication;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255299" lims:id="1572715"><Label>(j)</Label><Text>require any person in the place or conveyance to produce any document lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572739" lims:id="1572739">Withdrawal of order</MarginalNote><Label>(3)</Label><Text>An inspector who orders a measure to be carried out must withdraw the order if they no longer have reasonable grounds to believe that the licence holder or person is not compliant or not likely to comply with this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255332" lims:id="255332"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255333" lims:id="255333">Review by Minister</MarginalNote><Label>(4)</Label><Text>An inspector shall, without delay, refer any decision to make or withdraw an order to the Minister for review. After the review, the Minister may amend, replace or rescind the order if the Minister is of the opinion that it is necessary to do so.</Text></Subsection><Subsection suspended</MarginalNote><Label>(5)</Label><Text>The referral of a decision to the Minister for review does not suspend the application of the decision.</Text></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255336" lims:id="255336"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255337" lims:id="255337">Refusal to comply</MarginalNote><Label>(6)</Label><Text>If a licence holder or any other person who is ordered to carry out a measure fails to comply with the order, the inspector may carry out the measure or require another person to do so.</Text></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255338" lims:id="255338"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255339" lims:id="255339">Informing of action</MarginalNote><Label>(7)</Label><Text>After the measure is carried out, the inspector shall, as soon as feasible, advise the person who failed to comply with the order that the measure was carried out.</Text></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255340" lims:id="255340"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255341" lims:id="255341">Compliance not required</MarginalNote><Label>(8)</Label><Text>No person is required to carry out a measure ordered by an inspector if doing so would expose them to a danger, as defined in subsection 122(1) of the <XRefExternal reference-type="act" link="L-2">Canada Labour they are satisfied that the provisions of this Act and the regulations that apply to that thing have been complied with.</Text></Section><Section lims:inforce-start-date="2009-06-23" restoration</MarginalNote><Label>46</Label><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255353" lims:id="255353"><Label>(1)</Label><Text>On reasonable notice in writing to the Minister, the owner of a thing seized under this Act, or the person in possession of it at the time of its seizure, may, within 60 days after the day of its seizure, apply to a provincial court judge within whose jurisdiction the seizure was made for an order of restoration.</Text></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255354" lims:id="255354"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255355" lims:id="255355">Order of restoration</MarginalNote><Label>(2)</Label><Text>The provincial court judge may order that the seized thing be restored immediately to the applicant if, on hearing the application, the judge is satisfied that</Text><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255356" lims:id="255356"><Label>(a)</Label><Text>the applicant is entitled to possession of it;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255357" lims:id="1572743"><Label>(b)</Label><Text>it does not pose a serious and imminent danger to the health, safety or security of the public; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255358" lims:id="255358"><Label>(c)</Label><Text>it will not be required as evidence in a prosecution for an offence that is subsequently instituted under this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-06-23" lims:fid="255359" lims:id="255359"><MarginalNote lims:inforce-start-date="2009-06-23" lims:fid="255360" lims:id="255360">Order of later restoration</MarginalNote><Label>(3)</Label><Text lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1565454" lims:id="1572744">If, on hearing an application, the provincial court judge is satisfied that the applicant is entitled to possession of the seized thing and that it does not pose a serious and imminent danger to the health, safety or security of the public but is not satisfied with respect to paragraph (2)(c), the judge may order that the thing be restored to the applicant</Text><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255361" lims:id="255361"><Label>(a)</Label><Text>on the expiry of 180 days after the day of its seizure if no prosecution for an offence under this Act has been instituted before that day; or</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255362" lims:id="255362"><Label>(b)</Label><Text>on the final conclusion of lims:id="255377">Designation of analyst</MarginalNote><Label>50</Label><Text>The Minister may designate any individual, or class of individuals, as an analyst for the administration and enforcement of of material, equipment, places, conveyances and persons contaminated by human pathogens or toxins;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255459" lims:id="1572839"><Label>(b)</Label><Text>respecting licensing, including the conditions that must be met for a licence to be issued, the conditions that must be complied with under a licence, the renewal, suspension and revocation of a licence and the variation of an existing licence;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255460" lims:id="255460"><Label>(c)</Label><Text>respecting facilities in which controlled activities are authorized, including</Text><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255461" lims:id="255461"><Label>(i)</Label><Text>the location, design, construction, layout and upgrading of those facilities,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255462" lims:id="255462"><Label>(ii)</Label><Text>the material and equipment at those facilities,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255463" lims:id="1572821"><Label>(iii)</Label><Text>heating, ventilation, air conditioning and air handling systems,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255464" lims:id="1572840"><Label>(iv)</Label><Text>biological safety cabinets, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572822" lims:id="1572822"><Label>(v)</Label><Text>security requirements in relation to information technology;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255465" lims:id="255465"><Label>(d)</Label><Text lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1565459" lims:id="1572823">respecting access, including remote access by a means of telecommunication, to facilities in which controlled activities are authorized, including</Text><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255466" lims:id="255466"><Label>(i)</Label><Text>the conditions to be met by persons to obtain access to those facilities, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255467" lims:id="255467"><Label>(ii)</Label><Text>the screening of persons accessing those facilities;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255468" lims:id="255468"><Label>(e)</Label><Text>prescribing the time when a document sent under this Act is to be considered to have been received;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255469" lims:id="1572824"><Label>(f)</Label><Text>specifying the human pathogens and toxins for the purposes of subparagraphs 7(2)(c)(i) and (iii) and (d)(i) and (iii) and section 33;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255470" lims:id="255470"><Label>(g)</Label><Text lims:inforce-start-date="2009-06-23" lims:fid="255471" lims:id="255471"><Label>(i)</Label><Text>the conditions to be met by an applicant for a security clearance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255472" lims:id="255472"><Label>(ii)</Label><Text>the issuance of security clearances, as well as their suspension and revocation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-06-23" lims:fid="255473" lims:id="255473"><Label>(iii)</Label><Text>the reconsideration of a decision to refuse, suspend or revoke a security clearance;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255474" lims:id="255474"><Label>(h)</Label><Text>respecting the accompaniment and supervision, within the part of a facility described in section <XRefInternal>33</XRefInternal>, of persons who do not hold a security clearance;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255475" lims:id="1572825"><Label>(i)</Label><Text>respecting the qualifications, powers, duties and functions of biological safety officers;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="1572826" lims:id="1572826"><Label>(i.1)</Label><Text>specifying the powers, duties and functions of the representative for the purposes of subsection 36.1(2);</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255476" lims:id="1572827"><Label>(j)</Label><Text>respecting the establishment, content and maintenance of inventories of human pathogens and toxins, as well as the provision of reports on those inventories;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-06-23" lims:fid="255477" lims:id="255477"><Label>(k)</Label><Text>respecting the preparation, content and maintenance of any documents necessary for the administration of this Act and the regulations, as well as the provision of those documents to the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2026-03-26" lims:enacted-date="2026-03-26" lims:fid="255478" lims:id="1572828"><Label>(l)</Label><Text>respecting the provision of information to the Minister that is lims:id="255560" type="transitional"><Label>(c)</Label><Text>designate an individual with the appropriate safety training in the area of human pathogens and toxins or relevant work experience as the           — 2026, c. 3, ss. 415(3), (8), (9)</TitleText></Heading><Section type="amending"><Label>415</Label><Subsection type="amending"><Label>(3)</Label><Text>Section 18 of the Act is amended by adding the following after subsection (2):</Text><AmendedText include-in-TableOfProvisions="no"><Subsection><MarginalNote>Information</MarginalNote><Label>(2.1)</Label><Text>An application for a licence to authorize controlled activities in relation to human pathogens that fall into Risk Group 3 and are prescribed by regulation, human pathogens that fall into Risk Group 4 or toxins that are prescribed by regulation must include the information prescribed by regulation and make reference, in accordance with the regulations, to the following:</Text><Paragraph><Label>(a)</Label><Text>any contribution or other funding that originates from outside Canada that the applicant received or expects to receive in relation to their activities;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>if the applicant is an organization, any person or foreign entity that has or is seeking to have any direct or indirect ownership or influence over the organization that would result in control in fact of the organization; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>if the applicant is an individual, any person or foreign entity that has or is seeking to have any direct or indirect influence over any activities of the applicant that are governed by this Act or the regulations.</Text></Paragraph></Subsection></AmendedText></Subsection><Subsection type="amending"><Label>(8)</Label><Text>Subsection 18(5) of the Act is amended by adding the following after paragraph (d):</Text><AmendedText include-in-TableOfProvisions="no"><SectionPiece><Paragraph><Label>(d.1)</Label><Text>a description of each part of the facility that is prescribed by the regulations made for the purposes of section 33.1;</Text></Paragraph></SectionPiece></AmendedText></Subsection><Subsection type="amending"><Label>(9)</Label><Text>Section 18 of the Act is amended by adding the following after subsection (6):</Text><AmendedText include-in-TableOfProvisions="no"><Subsection><MarginalNote>Obligation of the licence holder — information</MarginalNote><Label>(6.1)</Label><Text>If a licence authorizes controlled activities in relation to human pathogens that fall into Risk Group 3 and are prescribed by regulation, human pathogens that fall into Risk Group 4 or toxins that are prescribed by regulation, the licence holder must provide the Minister with the information prescribed by regulation and inform them, in accordance with the regulations, of the following:</Text><Paragraph><Label>(a)</Label><Text>any contribution or other funding that originates from outside Canada that the licence holder received or expects to receive in relation to their activities;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>if the licence holder is an organization, any person or foreign entity that has or is seeking to have any direct or indirect ownership or influence over the organization that would result in control in fact of the organization; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>if the licence holder is an individual, any person or foreign entity that has or is seeking to have any direct or indirect influence over any activities of the licence holder that are governed by this Act or the regulations.</Text></Paragraph></Subsection></AmendedText></Subsection></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
          — 2026, c. 3, s. 421</TitleText></Heading><Section type="amending"><Label>421</Label><Text>Section 33 of the Act is replaced by the following</Text><AmendedText include-in-TableOfProvisions="no"><Section><MarginalNote>Access to facilities — security clearance</MarginalNote><Label>33</Label><Text>An individual must not enter — to conduct controlled activities — the part of a facility in which controlled activities are authorized in relation to human pathogens that fall into Risk Group 3 or Risk Group 4 and are prescribed by regulation or in relation to toxins prescribed by regulation unless they hold a security clearance for that part of the facility.</Text></Section><Section><MarginalNote>Access — compliance with regulations</MarginalNote><Label>33.1</Label><Subsection><Label>(1)</Label><Text>Except in accordance with the regulations, any individual who does not conduct controlled activities authorized in relation to human pathogens that fall into Risk Group 3 or Risk Group 4 and are prescribed by regulation or in relation to toxins prescribed by regulation is prohibited from</Text><Paragraph><Label>(a)</Label><Text>entering a facility in which controlled activities are authorized in relation to those human pathogens or toxins;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>remotely accessing that facility by a means of telecommunication; or</Text></Paragraph><Paragraph><Label>(c)</Label><Text>accessing by any means, sensitive information, as defined by regulation, in relation to those human pathogens or toxins.</Text></Paragraph></Subsection><Subsection><MarginalNote>Non-application</MarginalNote><Label>(2)</Label><Text>Paragraphs (1)(a) and (b) do not apply to an individual who holds a security clearance referred to in section 33 that authorizes entry to part of a facility referred to in paragraph (1)(a) in which controlled activities are authorized in relation to human pathogens that fall into Risk Group 3 or Risk Group 4 and are prescribed by regulation or in relation to toxins prescribed by regulation.</Text></Subsection><Subsection><MarginalNote>Restriction</MarginalNote><Label>(3)</Label><Text>Moreover, if an individual holds a security clearance that does not authorize them to enter certain parts of a facility referred to in paragraph (1)(a) in which controlled activities are authorized in relation to human pathogens that fall into Risk Group 3 or Risk Group 4 and are prescribed by regulation or in relation to toxins prescribed by regulation, the individual may enter those parts or remotely access them by a means of telecommunication only if they do so in accordance with the regulations.</Text></Subsection></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
          — 2026, c. 3, s. 422</TitleText></Heading><Section type="amending"><Label>422</Label><Text>The Act is amended by adding the following after section 35:</Text><AmendedText include-in-TableOfProvisions="no"><Section><MarginalNote>Minister’s power — individual</MarginalNote><Label>35.1</Label><Subsection><Label>(1)</Label><Text>Despite sections 33 and 33.1, the Minister may, on any conditions that they consider appropriate, exempt any individual from the requirement to hold a security clearance under section 33 or to comply with the regulations referred to in section 33.1 if the Minister is of the opinion that the exemption</Text><Paragraph><Label>(a)</Label><Text>poses no undue risk to the health, safety or security of the public; and</Text></Paragraph><Paragraph><Label>(b)</Label><Text>is warranted by reason of exigent circumstances related to the health, safety or security of the public.</Text></Paragraph></Subsection><Subsection><MarginalNote>Duration of order</MarginalNote><Label>(2)</Label><Text>An exemption ceases to have effect on the earliest of the following days:</Text><Paragraph><Label>(a)</Label><Text>the day that is specified by the Minister in the exemption;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the day on which the Minister revokes the exemption; or</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the day that is one year after the day on which the exemption takes effect.</Text></Paragraph></Subsection><Subsection><MarginalNote>Report and review by committee</MarginalNote><Label>(3)</Label><Text>Within 30 days of exercising the power to exempt under subsection (1), the Minister must cause a report of the exercise, including the Minister’s reasons for granting the exemption, to be referred for review to the standing committee of each House of Parliament that normally considers matters related to national security.‍</Text></Subsection></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
          — 2026, c. 3, s. 431</TitleText></Heading><Section type="amending"><Label>431</Label><Text>The Act is amended by adding the following after section 52:</Text><AmendedText include-in-TableOfProvisions="no"><Heading level="1"><TitleText>Administrative Monetary Penalties</TitleText></Heading><Heading level="2"><TitleText>Violations</TitleText></Heading><Section><MarginalNote>Administrative monetary penalties</MarginalNote><Label>52.1</Label><Subsection><Label>(1)</Label><Text>Every person who contravenes a provision designated under paragraph (12)(a) commits a violation and is liable to an administrative monetary penalty of not more than $50,000 in the case of an individual and $250,000 in the case of any other person.</Text></Subsection><Subsection><MarginalNote>Purpose of penalty</MarginalNote><Label>(2)</Label><Text>The purpose of the penalty is to promote compliance with the provisions of this Act or the regulations and not to punish.</Text></Subsection><Subsection><MarginalNote>Minister’s powers — notice of violation</MarginalNote><Label>(3)</Label><Text>The Minister may</Text><Paragraph><Label>(a)</Label><Text>establish the form of notices of violations;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>designate individuals, or classes of individuals, who are authorized to issue notices of violations; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>establish, in respect of each violation, a short-form description to be used in notices of violation.</Text></Paragraph></Subsection><Subsection><MarginalNote>Notice of violation</MarginalNote><Label>(4)</Label><Text>If an individual designated under subsection (3) has reasonable grounds to believe that a person has committed a violation, the designated individual may issue a notice of violation and cause it to be served on the person. The notice of violation must include the information prescribed by regulation.</Text></Subsection><Subsection><MarginalNote>Continuing violation</MarginalNote><Label>(5)</Label><Text>A violation that is committed or continued on more than one day constitutes a separate violation in respect of each day on which it is committed or continued.</Text></Subsection><Subsection><MarginalNote>Limitation</MarginalNote><Label>(6)</Label><Text>Proceedings in respect of a violation may be instituted no later than two years after the day on which the subject matter of the proceedings becomes known to the Minister.</Text></Subsection><Subsection><MarginalNote>Publication</MarginalNote><Label>(7)</Label><Text>After proceedings in respect of a violation are ended, the Minister may make public the nature of the violation, the name of the person who committed it and the amount of the penalty imposed.</Text></Subsection><Subsection><MarginalNote>Directors, officers and agents or mandatries</MarginalNote><Label>(8)</Label><Text>If a person other than an individual commits a violation under this Act or the regulations, any of the person’s directors, officers or agents or mandataries who directed, authorized, assented to, acquiesced in or participated in the commission of the violation is a party to the violation, whether or not the person is proceeded against under this Act or the regulations.</Text></Subsection><Subsection><MarginalNote>Employees, agents or mandataries</MarginalNote><Label>(9)</Label><Text>In a proceeding for a violation under this Act or the regulations, it is sufficient proof of the violation to establish that it was committed by the employee of the person named in the notice of violation, who is acting within the scope of their employment, or the agent or mandatary of the person named in the notice of violation, who is acting within the scope of their authority, whether or not the employee, agent or mandatary is identified or proceeded against for the violation, unless the person named in the violation establishes that</Text><Paragraph><Label>(a)</Label><Text>the violation was committed without the persons’s knowledge or consent; and</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the person exercised all due diligence to prevent its commission.</Text></Paragraph></Subsection><Subsection><MarginalNote>Violation or offence</MarginalNote><Label>(10)</Label><Text>If any act or omission can be proceeded with as a violation or as an offence, the Minister may commence proceedings in respect of that act or omission as a violation or recommend that it be proceeded with as an offence, but proceeding with it as a violation precludes proceeding with it as an offence, and proceeding with it as an offence precludes proceeding with it as a violation.</Text></Subsection><Subsection><MarginalNote>Violation not offences</MarginalNote><Label>(11)</Label><Text>For greater certainty, a violation is not an offence and, accordingly, section 126 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> does not apply in respect of a violation.</Text></Subsection><Subsection><MarginalNote>Regulations</MarginalNote><Label>(12)</Label><Text>The Governor in Council may make regulations respecting an administrative monetary penalties scheme, including regulations</Text><Paragraph><Label>(a)</Label><Text>designating any of the following as violations:</Text><Subparagraph><Label>(i)</Label><Text>non-compliance with the requirements in subsection 12(1), paragraph 12(2)(a) or section 13, 14, 14.1 or 15 that are in respect of notification or the provision of information, as the case may be,</Text></Subparagraph><Subparagraph><Label>(ii)</Label><Text>the contravention of subsection 18(2.1), (6) or (6.1),</Text></Subparagraph><Subparagraph><Label>(iii)</Label><Text>the contravention of subsection 18(7) in relation to any licence conditions that are in respect of notification and the provision of information,</Text></Subparagraph><Subparagraph><Label>(iv)</Label><Text>the contravention of section 30, 31 or 32,</Text></Subparagraph><Subparagraph><Label>(v)</Label><Text>the contravention of the requirement in subsection 36(1) to designate an individual who holds the qualifications set out in regulations, as a biological safety officer,</Text></Subparagraph><Subparagraph><Label>(vi)</Label><Text>the contravention of subsection 36(3) in relation to any powers, duties and functions that are in respect of notification and the provision of information,</Text></Subparagraph><Subparagraph><Label>(vii)</Label><Text>the contravention of subsection 36(5) or 36.1(4),</Text></Subparagraph><Subparagraph><Label>(viii)</Label><Text>the contravention of subsection 38(3),</Text></Subparagraph><Subparagraph><Label>(ix)</Label><Text>the contravention of subsection 40.2(2), 41(3.1) or (5) or 44(2),</Text></Subparagraph><Subparagraph><Label>(x)</Label><Text>the contravention of a provision of a regulation made under paragraph 66(1)(k), and</Text></Subparagraph><Subparagraph><Label>(xi)</Label><Text>non-compliance with any other requirements that are in respect of notification and the provision of information that are prescribed by regulation;</Text></Subparagraph></Paragraph><Paragraph><Label>(b)</Label><Text>respecting the classification of each violation;</Text></Paragraph><Paragraph><Label>(c)</Label><Text>respecting the information referred to in subsection (4);</Text></Paragraph><Paragraph><Label>(d)</Label><Text>respecting the proceedings in respect of a violation; and</Text></Paragraph><Paragraph><Label>(e)</Label><Text>respecting the penalties, including in relation to</Text><Subparagraph><Label>(i)</Label><Text>the determination of, or the method of determining the penalty applicable for each violation, and</Text></Subparagraph><Subparagraph><Label>(ii)</Label><Text>the payment of the penalty imposed.</Text></Subparagraph></Paragraph></Subsection><Subsection><MarginalNote>Right to request review</MarginalNote><Label>(13)</Label><Text>Any regulation made under any of paragraphs (12)(a) to (e) must provide that a person named in the notice of violation has the right to request a review of the decision that the person has committed a violation or of the penalty imposed, or both.</Text></Subsection></Section><Heading level="2"><TitleText>Penalties</TitleText></Heading><Section><MarginalNote>Payment</MarginalNote><Label>52.2</Label><Subsection><Label>(1)</Label><Text>If the person named in the notice of violation pays, in the time and manner specified in the notice, the amount of the penalty set out in the notice,</Text><Paragraph><Label>(a)</Label><Text>they are deemed to have committed the violation in respect of which the amount is paid;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the Minister must accept that amount as complete satisfaction of the penalty in respect of the violation; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the proceedings commenced in respect of the violation are ended.</Text></Paragraph></Subsection><Subsection><MarginalNote>Alternatives</MarginalNote><Label>(2)</Label><Text>Instead of paying the amount of the penalty set out in the notice, the person may, in the time and manner specified in the notice,</Text><Paragraph><Label>(a)</Label><Text>if the amount of the penalty set out in the notice is $5,000 or more, request to enter into a compliance agreement with the Minister that ensures the person’s compliance with the provision to which the violation relates; or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>request a review by the Minister, in accordance with the regulations, of the decision that the person has committed a violation or of the penalty imposed, or both.</Text></Paragraph></Subsection></Section><Heading level="2"><TitleText>Compliance Agreements</TitleText></Heading><Section><MarginalNote>Entering into compliance agreements</MarginalNote><Label>52.3</Label><Subsection><Label>(1)</Label><Text>After considering a request by a person named in the notice of violation, the Minister may enter into a compliance agreement with that person on any terms and conditions that are satisfactory to the Minister. The terms and conditions may</Text><Paragraph><Label>(a)</Label><Text>include a provision for the deposit of reasonable security, in a form and amount satisfactory to the Minister, as a guarantee that the person will comply with the compliance agreement; and</Text></Paragraph><Paragraph><Label>(b)</Label><Text>provide for the reduction, in whole or in part, of the penalty for the violation.</Text></Paragraph></Subsection><Subsection><MarginalNote>Deeming</MarginalNote><Label>(2)</Label><Text>A person who enters into a compliance agreement with the Minister is, on doing so, deemed to have committed the violation in respect of which the compliance agreement was entered into.</Text></Subsection><Subsection><MarginalNote>Notice of compliance</MarginalNote><Label>(3)</Label><Text>A notice from the Minister that they are satisfied that a person who has entered into a compliance agreement has complied with it ends the proceedings commenced in respect of the violation. Any security given by the person under the compliance agreement must then be returned to the person.</Text></Subsection><Subsection><MarginalNote>Notice of default</MarginalNote><Label>(4)</Label><Text>If the Minister is of the opinion that a person who has entered into a compliance agreement has not complied with it, the Minister must cause a notice of default to be provided to the person informing them that</Text><Paragraph><Label>(a)</Label><Text>instead of being liable to pay the amount of the penalty set out in the compliance agreement, the person is liable to pay, in the time and manner specified in the notice of default, an amount that is twice the amount of the penalty set out in the notice of violation, and for greater certainty, subsection 52.1(1) does not apply in respect of that amount; or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the security is forfeited to His Majesty in right of Canada.</Text></Paragraph></Subsection><Subsection><MarginalNote>Effect of notice of default</MarginalNote><Label>(5)</Label><Text>Once provided with the notice of default, the person may not deduct from the amount set out in the notice of default any amount they spent under the compliance agreement and</Text><Paragraph><Label>(a)</Label><Text>the person is liable to pay the amount set out in the notice of default in the time and manner specified in the notice of default; or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>if the notice provides for the forfeiture of the security given under the compliance agreement, that security is forfeited to His Majesty in right of Canada and the proceedings commenced in respect of the violation are ended.</Text></Paragraph></Subsection><Subsection><MarginalNote>Effect of payment</MarginalNote><Label>(6)</Label><Text>If the person pays the amount set out in the notice of default in the time and manner specified in the notice of default, the Minister must accept the amount as complete satisfaction of the amount owing in respect of the violation and the proceedings commenced in respect of the violation are ended.</Text></Subsection></Section><Section><MarginalNote>Refusal to enter into compliance agreement</MarginalNote><Label>52.4</Label><Subsection><Label>(1)</Label><Text>If the Minister refuses to enter into a compliance agreement is liable to pay, in the time and manner specified in the notice of violation, the amount of the penalty set out in the notice of violation.</Text></Subsection><Subsection><MarginalNote>Effect of payment</MarginalNote><Label>(2)</Label><Text>If a person pays the amount set out in the notice of violation in the specified time and manner,</Text><Paragraph><Label>(a)</Label><Text>they are deemed to have committed the violation in respect of which the amount is paid;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the Minister must accept the amount as complete satisfaction of the penalty in respect of the violation; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the proceedings commenced in respect of the violation are ended.</Text></Paragraph></Subsection><Subsection><MarginalNote>Default of payment</MarginalNote><Label>(3)</Label><Text>If a person does not pay the amount set out in the notice of violation in the specified time and manner, they are deemed to have committed the violation identified in the notice of violation.</Text></Subsection></Section><Heading level="2"><TitleText>Rules About Violations</TitleText></Heading><Section><MarginalNote>Due diligence</MarginalNote><Label>52.5</Label><Subsection><Label>(1)</Label><Text>A person must not be found to be liable for a violation under this Act if they establish that they exercised due diligence to prevent its commission.</Text></Subsection><Subsection><MarginalNote>Non-application</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), a person to whom the Minister causes a notice of default to be provided under subsection 52.3(4) does not have a defence by reason that the person exercised due diligence to comply with the compliance agreement.</Text></Subsection><Subsection><MarginalNote>Common law principles</MarginalNote><Label>(3)</Label><Text>Every rule and principle of the common law that renders any circumstance a justification or excuse in relation to a charge for an offence under this Act or the regulations applies in respect of a violation to the extent that it is not inconsistent with this Act and the regulations.</Text></Subsection></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
