fundamental to shaping the country, particularly in light of the Truth and Reconciliation Commission of Canada’s Calls to Action;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151096" lims:id="1151096" format-ref="indent-0-0" language-align="no"><Text>Whereas the Government of Canada is committed to implementing the United Nations Declaration on the Rights of Indigenous Peoples, which affirms rights related to Indigenous languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151097" lims:id="1151097" format-ref="indent-0-0" language-align="no"><Text>Whereas 2019 has been proclaimed by the General Assembly of the United Nations as the International Year of Indigenous Languages to, among other things, draw attention to the critical loss of Indigenous languages and the urgent need to maintain, revitalize and promote Indigenous languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151098" lims:id="1151098" format-ref="indent-0-0" language-align="no"><Text>Whereas the Government of Canada recognizes that all relations with Indigenous peoples must be based on the recognition and implementation of their right to self-determination, including the inherent right of self-government;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151099" lims:id="1151099" format-ref="indent-0-0" language-align="no"><Text>Whereas First Nations, the Inuit and the Métis Nation have their own collective identities, cultures and ways of life and have, throughout history and to this day, continued to live in, use and occupy the lands that are now in Canada;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151100" lims:id="1151100" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous languages were the first languages used in the lands that are now in Canada and those languages have evolved over time;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151101" lims:id="1151101" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous languages played a significant part in the establishment of relations between Europeans and Indigenous peoples;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151102" lims:id="1151102" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous peoples have played a significant role in the development of Canada and Indigenous languages contribute to the diversity and richness of the linguistic and cultural heritage of Canada;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151103" lims:id="1151103" format-ref="indent-0-0" language-align="no"><Text>Whereas a history of discriminatory government policies and practices, in respect of, among other things, assimilation, forced relocation, the Sixties Scoop and residential schools, were detrimental to Indigenous languages and contributed significantly to the erosion of those languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151104" lims:id="1151104" format-ref="indent-0-0" language-align="no"><Text>Whereas the status of Indigenous languages varies from one language to another, including with respect to the vitality of those languages, and there is an urgent need to support the efforts of Indigenous peoples to reclaim, revitalize, maintain and strengthen them;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151105" lims:id="1151105" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous languages are fundamental to the identities, cultures, spirituality, relationships to the land, world views and self-determination of Indigenous peoples;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151106" lims:id="1151106" format-ref="indent-0-0" language-align="no"><Text>Whereas efforts to protect the vitality of Indigenous languages contribute to the enrichment of Indigenous knowledge as well as to the prevention of the loss of cultural diversity, biodiversity and spirituality;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151107" lims:id="1151107" format-ref="indent-0-0" language-align="no"><Text>Whereas a variety of entities in different regions across Canada have mandates to promote the use of Indigenous languages and to support the efforts of Indigenous peoples to reclaim, revitalize, maintain and strengthen them and there is a need for the Government of Canada to provide continuing support for those entities;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151108" lims:id="1151108" format-ref="indent-0-0" language-align="no"><Text>Whereas the Government of Canada is committed to providing adequate, sustainable and long-term funding for the reclamation, revitalization, maintenance and strengthening of Indigenous languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151109" lims:id="1151109" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous peoples are best placed to take the leading role in reclaiming, revitalizing, maintaining and strengthening Indigenous languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151110" lims:id="1151110" format-ref="indent-0-0" language-align="no"><Text>Whereas Indigenous-language media and lifelong learning of Indigenous languages, including education systems for Indigenous people, are essential to restoring and maintaining fluency in those languages;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151111" lims:id="1151111" format-ref="indent-0-0" language-align="no"><Text>Whereas a flexible approach that takes into account the unique circumstances and needs of Indigenous groups, communities and peoples is required in light of the diversity of identities, cultures and histories of Indigenous peoples;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151112" lims:id="1151112" format-ref="indent-0-0" language-align="no"><Text>And whereas there is a need to take into account the unique circumstances and needs of Indigenous elders, youth, children, persons with disabilities, women, men and gender-diverse persons and two-spirit persons;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151113" lims:id="1151113"><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151114" lims:id="1151114" format-ref="indent-0-0" language-align="yes"><Text>Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151115" lims:id="1151115"><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151116" lims:id="1151116" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151117" lims:id="1151117"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151118" lims:id="1151118">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="I-7.85">Indigenous Languages Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151119" lims:id="1151119" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151120" lims:id="1151120"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151121" lims:id="1151121">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151122" lims:id="1151122"><Text><DefinedTermEn>appropriate Minister</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>. (<DefinedTermFr>ministre compétent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151123" lims:id="1151123"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Commissioner of Indigenous Languages appointed under section <XRefInternal>13</XRefInternal>. (<DefinedTermFr>English version only</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151124" lims:id="1151124"><Text><DefinedTermEn>federal institution</DefinedTermEn> means an entity that is referred to in any of paragraphs (a) to (b) and (d) of the definition <DefinitionRef>department</DefinitionRef> in section 2 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> or a <DefinitionRef>Crown corporation</DefinitionRef>, as defined in subsection 83(1) of that Act. (<DefinedTermFr>institution fédérale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151125" lims:id="1151125"><Text><DefinedTermEn>Indigenous governing body</DefinedTermEn> means a council, government or other entity that is authorized to act on behalf of an Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>corps dirigeant autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151126" lims:id="1151126"><Text><DefinedTermEn>Indigenous organization</DefinedTermEn> means an Indigenous entity that represents the interests of an Indigenous group and its members or, other than in section <XRefInternal>45</XRefInternal>, that is specialized in Indigenous languages. (<DefinedTermFr>organisme autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151127" lims:id="1151127"><Text><DefinedTermEn>Indigenous peoples</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>aboriginal peoples of Canada</DefinitionRef> in subsection 35(2) of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>peuples autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151128" lims:id="1151128"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Canadian Heritage. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151129" lims:id="1151129"><Text><DefinedTermEn>Office</DefinedTermEn> means the Office of the Commissioner of Indigenous Languages established under section <XRefInternal>12</XRefInternal>. (<DefinedTermFr>English version only</DefinedTermFr>)</Text></Definition></Section><Section lims:inforce-start-date="2024-11-27" lims:enacted-date="2024-11-27" lims:lastAmendedDate="2024-11-27" lims:fid="1151130" lims:id="1497756"><Label>3</Label><Text><Repealed>[Repealed, 2024, c. 30, s. 29]</Repealed></Text></Section><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151132" lims:id="1151132"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151133" lims:id="1151133">Inconsistency or conflict</MarginalNote><Label>4</Label><Text>In the event of any inconsistency or conflict between this Act and a treaty — including a land claims agreement — or a self-government agreement, the treaty or self-government agreement prevails to the extent of the inconsistency or conflict.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151134" lims:id="1151134" level="1"><TitleText>Purposes of Act</TitleText></Heading><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151135" lims:id="1151135"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151136" lims:id="1151136">Purposes</MarginalNote><Label>5</Label><Text>The purposes of this Act are to</Text><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151137" lims:id="1151137"><Label>(a)</Label><Text>support and promote the use of Indigenous languages, including Indigenous sign languages;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151138" lims:id="1151138"><Label>(b)</Label><Text>support the efforts of Indigenous peoples to reclaim, revitalize, maintain and strengthen Indigenous languages, including their efforts to</Text><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151139" lims:id="1151139"><Label>(i)</Label><Text>assess the status of distinct Indigenous languages,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151140" lims:id="1151140"><Label>(ii)</Label><Text>plan initiatives and activities for restoring and maintaining fluency in Indigenous languages,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151141" lims:id="1151141"><Label>(iii)</Label><Text>create technological tools, educational materials and permanent records of Indigenous languages, including audio and video recordings of fluent speakers of the languages and written materials such as dictionaries, lexicons and grammars of the languages, for the purposes of, among other things, the maintenance and transmission of the languages,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151142" lims:id="1151142"><Label>(iv)</Label><Text>support Indigenous language learning and cultural activities — including language nest, mentorship and immersion programs — to increase the number of new speakers of Indigenous languages,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151143" lims:id="1151143"><Label>(v)</Label><Text>support entities specialized in Indigenous languages, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151144" lims:id="1151144"><Label>(vi)</Label><Text>undertake research or studies in respect of Indigenous languages;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151145" lims:id="1151145"><Label>(c)</Label><Text>establish a framework to facilitate the effective exercise of the rights of Indigenous peoples that relate to Indigenous languages, including by way of agreements or arrangements referred to in sections <XRefInternal>8</XRefInternal> and <XRefInternal>9</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151146" lims:id="1151146"><Label>(d)</Label><Text>establish measures to facilitate the provision of adequate, sustainable and long-term funding for the reclamation, revitalization, maintenance and strengthening of Indigenous languages;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151147" lims:id="1151147"><Label>(e)</Label><Text>facilitate cooperation with provincial and territorial governments, Indigenous governments and other Indigenous governing bodies, Indigenous organizations and other entities in a manner consistent with the rights of Indigenous peoples and the powers and jurisdictions of Indigenous governing bodies and of the provinces and territories;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151148" lims:id="1151148"><Label>(e.1)</Label><Text>facilitate meaningful opportunities for Indigenous governments and other Indigenous governing bodies and Indigenous organizations to collaborate in policy development related to the implementation of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151149" lims:id="1151149"><Label>(f)</Label><Text>respond to the Truth and Reconciliation Commission of Canada’s Calls to Action numbers 13 to 15; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151150" lims:id="1151150"><Label>(g)</Label><Text>contribute to the implementation of the United Nations Declaration on the Rights of Indigenous Peoples as it relates to Indigenous languages.</Text></Paragraph></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151151" lims:id="1151151" level="1"><TitleText>Rights Related to Indigenous Languages</TitleText></Heading><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151152" lims:id="1151152"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151153" lims:id="1151153">Recognition by Government of Canada</MarginalNote><Label>6</Label><Text>The Government of Canada recognizes that the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> include rights related to Indigenous languages.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1151154" lims:id="1151154" level="1"><TitleText>Powers, Duties and Functions of Minister</TitleText></Heading><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151155" lims:id="1151155"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151156" lims:id="1151156">Consultations — adequate, sustainable and long-term funding</MarginalNote><Label>7</Label><Text>The Minister must consult with a variety of Indigenous governments and other Indigenous governing bodies and a variety of Indigenous organizations in order to meet the objective of providing adequate, sustainable and long-term funding for the reclamation, revitalization, maintenance and strengthening of Indigenous languages.</Text></Section><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151157" lims:id="1151157"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151158" lims:id="1151158">Cooperation to support Indigenous languages</MarginalNote><Label>8</Label><Text>The Minister may cooperate with provincial or territorial governments, Indigenous governments or other Indigenous governing bodies, Indigenous organizations or other entities — including by entering into agreements or arrangements with them for purposes such as providing Indigenous language programs and services in relation to education, health and the administration of justice — to coordinate efforts to efficiently and effectively support Indigenous languages in Canada in a manner consistent with the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> and the powers and jurisdictions of Indigenous governing bodies and of the provinces and territories.</Text></Section><Section lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-29" lims:fid="1151159" lims:id="1151159"><MarginalNote lims:inforce-start-date="2019-08-29" lims:enacted-date="2019-06-21" lims:fid="1151160" lims:id="1151160">Agreements or arrangements — purposes of Act</MarginalNote><Label>9</Label><Text>Taking into account the unique circumstances and needs of Indigenous groups, communities and peoples and the research or studies referred to in section <XRefInternal>24</XRefInternal> and in a manner consistent with the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> and the powers and jurisdictions of Indigenous governing bodies and of the provinces and territories, the Minister and an appropriate Minister may enter into an agreement or arrangement to further the purposes of this Act with a provincial or territorial government, an Indigenous government or other Indigenous governing body or an Indigenous may, in accordance with the regulations, provide access to services in an Indigenous language, if the institution or its agent or mandatary has the capacity to do so and there is sufficient demand for Subject to any law, the Office must also make any document used in or produced for that research or study available to that Indigenous community, Indigenous government or other Indigenous governing body or Indigenous organization.</Text></Subsection><Subsection lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151238" lims:id="1151238"><MarginalNote lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151239" lims:id="1151239">Copy or use free of charge</MarginalNote><Label>(4)</Label><Text>The Office must authorize the Indigenous community, Indigenous government or other Indigenous governing body or Indigenous organization to copy or otherwise use the research or study free of charge for the purpose of reclaiming, revitalizing, maintaining or strengthening Indigenous languages. Subject to any law, the Office must also authorize any document used in or produced for that research or study to be copied or otherwise used by that Indigenous community, Indigenous government or other Indigenous governing body or Indigenous organization free of charge, for that purpose.</Text></Subsection></Section><Section lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2020-10-01" lims:fid="1151240" lims:id="1151240"><MarginalNote lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151241" lims:id="1151241">Support offered by Office</MarginalNote><Label>25</Label><Text>At the request of an Indigenous community or an Indigenous government or other Indigenous governing body, the Office may provide support to the community or the Indigenous government or other Indigenous governing body in its efforts to reclaim, revitalize, maintain and strengthen an Indigenous language, including its efforts to</Text><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151242" lims:id="1151242"><Label>(a)</Label><Text>create permanent records of the language, including audio and video recordings and written materials such as dictionaries, lexicons and grammars of the language, for the purposes of, among other things, its maintenance and transmission;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151243" lims:id="1151243"><Label>(b)</Label><Text>establish certification standards for translators and interpreters;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151244" lims:id="1151244"><Label>(c)</Label><Text>conduct research and studies and community assessments in respect of the use of the language;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151245" lims:id="1151245"><Label>(d)</Label><Text>develop and implement plans for reclaiming, revitalizing, maintaining and strengthening the language; lims:id="1151369"><Label>(i)</Label><Text>the filing of complaints, including the conditions that must be met before complaints may be filed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151370" lims:id="1151370"><Label>(ii)</Label><Text>the review of complaints, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151371" lims:id="1151371"><Label>(iii)</Label><Text>the reports made after conducting the review of complaints, including the type of recommendations that may be made in those reports, the period of time within which the reports must be completed and the persons or entities to which the reports must be lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151375" lims:id="1151375"><Label>(ii)</Label><Text>defining the expression “provide access to services”, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151376" lims:id="1151376"><Label>(iii)</Label><Text>defining the expressions “capacity” and “demand” and specifying the circumstances in which a federal institution or its agent or mandatary has the capacity to provide access to services in an Indigenous language and those in which demand for access to services in that language is sufficient;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151377" lims:id="1151377"><Label>(b)</Label><Text>specifying other information to be included in the annual report for the purposes of paragraph <XRefInternal>43</XRefInternal>(2)(d); and</Text></Paragraph><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151378" lims:id="1151378"><Label>(c)</Label><Text>generally, for carrying out the after the day on which this section comes into force and every five years after that, the Minister must cause to be conducted an independent review of this Act, of its administration and operation, of any agreements or arrangements made under section <XRefInternal>9</XRefInternal> and of the activities of the Office. The review must be conducted by a person or body appointed by the Minister in consultation with the Office.</Text></Subsection><Subsection lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151400" lims:id="1151400"><MarginalNote lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151401" lims:id="1151401">Report</MarginalNote><Label>(2)</Label><Text>The person or body that conducts the review must submit to the Minister a report setting out their conclusions and recommendations, including</Text><Paragraph lims:inforce-start-date="2020-10-01" lims:enacted-date="2019-06-21" lims:fid="1151402" lims:id="1151402"><Label>(a)</Label><Text>any measures that would contribute to the fulfilment of the objectives of this Act;
