lims:id="1169771">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169772" lims:id="1169772"><Text><DefinedTermEn>appropriate Minister</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169773" lims:id="1169773"><Label>(a)</Label><Text>with respect to a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister presiding over the department;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169774" lims:id="1169774"><Label>(b)</Label><Text>with respect to a division or branch of the federal public administration set out in column I of Schedule I.1 to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister set out in column II of that schedule;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169775" lims:id="1169775"><Label>(c)</Label><Text>with respect to a corporation named in Schedule II to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister designated as the appropriate Minister by order of the Governor in Council made under that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169776" lims:id="1169776"><Label>(d)</Label><Text>with respect to a <DefinitionRef>parent Crown corporation</DefinitionRef> as defined in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the <DefinitionRef>appropriate Minister</DefinitionRef> as defined in that subsection; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169777" lims:id="1169777"><Label>(e)</Label><Text>with respect to the Canadian Forces, the Minister of National Defence. (<DefinedTermFr>ministre compétent</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169778" lims:id="1169778"><Text><DefinedTermEn>department</DefinedTermEn> means, other than in subsection 42(2), a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, a division or branch of the federal public administration  —  other than a review body and the office of the Intelligence Commissioner —  set out in column I of Schedule I.‍1 to that Act, a corporation named in Schedule II to that Act, a <DefinitionRef>parent Crown corporation</DefinitionRef> as defined in subsection 83(1) of that Act or the Canadian Forces. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169779" lims:id="1169779"><Text><DefinedTermEn>deputy head</DefinedTermEn> means, except in section <XRefInternal>42</XRefInternal>,</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169780" lims:id="1169780"><Label>(a)</Label><Text>with respect to a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the deputy minister of that department;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169781" lims:id="1169781"><Label>(b)</Label><Text>with respect to the Canadian Forces, the Chief of the Defence Staff;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169782" lims:id="1169782"><Label>(c)</Label><Text>with respect to the Royal Canadian Mounted Police, the Commissioner of the Royal Canadian Mounted Police;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169783" lims:id="1169783"><Label>(d)</Label><Text>with respect to the Canadian Security Intelligence Service, the Director;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169784" lims:id="1169784"><Label>(e)</Label><Text>with respect to any other portion of the federal public administration, the person designated by order of the Governor in Council to be the deputy head of that portion of the federal public administration for the purposes of this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169785" lims:id="1169785"><Label>(f)</Label><Text>with respect to any inquiry established under the <XRefExternal reference-type="act" link="I-11">Inquiries Act</XRefExternal>, if there is a single commissioner, that commissioner or, if there is more than one commissioner, the commissioner designated by order of the Governor in Council to be the deputy head of that inquiry for the purposes of this Act. (<DefinedTermFr>administrateur général</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169786" lims:id="1169786"><Text><DefinedTermEn>Director</DefinedTermEn> means the Director of the Canadian Security Intelligence Service. (<DefinedTermFr>directeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169787" lims:id="1169787"><Text><DefinedTermEn>Review Agency</DefinedTermEn> means the National Security and Intelligence Review Agency established under section <XRefInternal>3</XRefInternal>. (<DefinedTermFr>Office de surveillance</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:id="1192179"><Label>(a)</Label><Text>the Civilian Review and Complaints Commission for the Royal Canadian Mounted Police established by subsection 45.29(1) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1192180" lims:id="1192180"><Label>(b)</Label><Text>the National Security and Intelligence Committee of Parliamentarians. (<DefinedTermFr>organisme de lims:fid="1169791" lims:id="1169791">Review Agency established</MarginalNote><Label>3</Label><Text>The National Security and Intelligence Review Agency is established, consisting of a Chair and no fewer than three and no more than six other members.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2022-07-26" lims:fid="1169792" members</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169794" lims:id="1169794"><Label>(1)</Label><Text>The Governor in Council is to appoint, on the recommendation of the Prime Minister, the members of the Review Agency.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169795" lims:id="1169795"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169796" lims:id="1169796">Consultation</MarginalNote><Label>(2)</Label><Text>A member may be appointed to the Review Agency only after consultation by the Prime Minister with</Text><Paragraph lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1169797" lims:id="1373067"><Label>(a)</Label><Text>the Leader of the Government in the Senate or Government Representative in the Senate and the Leader of the Opposition in the Senate;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1169798" lims:id="1373068"><Label>(b)</Label><Text>the Leader or Facilitator of every recognized party or parliamentary group in the Senate;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169799" lims:id="1169799"><Label>(c)</Label><Text>the Leader of the Opposition in the House of Commons; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169800" lims:id="1169800"><Label>(d)</Label><Text>the leader in the House of Commons of each party having at least twelve members in that House.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169801" lims:id="1169801"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169802" lims:id="1169802">Term of office</MarginalNote><Label>(3)</Label><Text>Each member of the Review Agency must be appointed to hold office during good behaviour for a term not exceeding five years.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169803" lims:id="1169803"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169804" lims:id="1169804">Reappointment</MarginalNote><Label>(4)</Label><Text>Each member of the Review Agency, on the expiry of their first term of office, is eligible to be reappointed for one further term.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169805" lims:id="1169805"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169806" lims:id="1169806">Designation of Chair</MarginalNote><Label>(5)</Label><Text>The Governor in Council is to designate, on the recommendation of the Prime Minister, the Chair of the Review Agency from among the members of the Agency.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169807" lims:id="1169807"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169808" lims:id="1169808">Designation of Vice-chair</MarginalNote><Label>(6)</Label><Text>The Governor in Council may designate, on the recommendation of the Prime Minister, the Vice-chair of the Review Agency from among the members of the full-time or part-time basis. Every member of the Review Agency who is not designated as the Chair or Vice-chair holds office on a part-time basis.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1373070" lims:id="1373070" lims:enactId="1357306" type="original">2019, c. 13, s. 2 “4”</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1373071" lims:id="1373071" lims:enactId="1357306">2022, c. 10, s. 253</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1169811" lims:id="1169811"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169812" lims:id="1169812">Acting Chair</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169813" lims:id="1169813"><Label>(1)</Label><Text>If the Chair is absent or incapacitated or if the office of Chair is vacant, the Vice-chair of the Review Agency is to act as the Chair; but if the Vice-chair is absent or incapacitated, or if that office is vacant, the Chair may designate another member of the Agency to act as the Chair or, if no such designation is made, the Agency must designate a member of the Agency to act as the Chair.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169814" lims:id="1169814"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169815" lims:id="1169815">Limit</MarginalNote><Label>(2)</Label><Text>No member designated under subsection (1) may act as the Chair for more that 90 days without the approval of the Governor in Council.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1169816" lims:id="1169816"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169817" lims:id="1169817">Remuneration and expenses</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169818" lims:id="1169818"><Label>(1)</Label><Text>Each member of the Review Agency who holds office on a part-time basis is entitled to be paid, for each day that the member exercises powers and performs duties and functions under this Act, the remuneration that is fixed by the Governor in Council and, in accordance with Treasury Board directives, reasonable travel and living expenses incurred in the exercise of their powers and the performance of their duties and functions while absent from their ordinary place of residence.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169819" lims:id="1169819"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169820" lims:id="1169820">Office held on full-time basis</MarginalNote><Label>(2)</Label><Text>The Chair and Vice-chair, if they are designated to hold office on a full-time basis, are entitled to be paid the remuneration that is fixed by the Governor in Council and, in accordance with Treasury Board directives, reasonable travel and living expenses incurred in the exercise of their powers and the performance of their duties and functions while absent from their ordinary place of work.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1169821" lims:id="1169821"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169822" lims:id="1169822">Acts and regulations applicable</MarginalNote><Label>7</Label><Text>Each member of the Review Agency is deemed to be an employee for the purposes of the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and to be employed in the federal public administration for the purposes of any regulations made under section 9 of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>. Each full-time member of the Agency is also deemed to be employed in the public service for the purposes of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1169823" lims:id="1169823"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169824" lims:id="1169824">Agency procedures</MarginalNote><Label>7.1</Label><Text>Subject to this Act, the Review Agency may determine the procedure to be followed in the exercise of its powers or the performance of any of its duties or functions.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169825" lims:id="1169825" level="1"><TitleText>Mandate</TitleText></Heading><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-13" lims:fid="1169826" lims:id="1169826"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169827" lims:id="1169827">Review and investigation</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169828" lims:id="1169828"><Label>(1)</Label><Text>The mandate of the Review Agency is to</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169829" lims:id="1169829"><Label>(a)</Label><Text>review any activity carried out by the Canadian Security Intelligence Service or the Communications Security Establishment;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169830" lims:id="1169830"><Label>(b)</Label><Text>review any activity carried out by a department that relates to national security or intelligence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169831" lims:id="1169831"><Label>(c)</Label><Text>review any matter that relates to national security or intelligence that a minister of the Crown refers to the Agency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169832" lims:id="1169832"><Label>(d)</Label><Text>investigate</Text><Subparagraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169833" lims:id="1169833"><Label>(i)</Label><Text>any complaint made under subsection <XRefInternal>16</XRefInternal>(1), <XRefInternal>17</XRefInternal>(1) or <XRefInternal>18</XRefInternal>(3),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169834" lims:id="1169834"><Label>(ii)</Label><Text>any complaint referred to the Agency under subsection 45.53(4.1) or 45.67(2.1) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169835" lims:id="1169835"><Label>(iii)</Label><Text>reports if</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169901" lims:id="1169901"><Label>(a)</Label><Text>the complainant has made a complaint to the Chief of the Communications Security Establishment with respect to that activity and the complainant has not received a response within a period of time that the Agency considers reasonable or is dissatisfied with the response given; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169902" evidence on oath and to produce the documents and things that the Agency deems requisite to the full investigation and consideration of the complaint in the same manner and to the same extent as a superior court of record;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1169943" lims:id="1169943"><Label>(b)</Label><Text>to administer Review Agency must suspend an investigation if, after consultation with the appropriate department, the Agency is of the opinion that continuing the investigation would compromise or seriously hinder intelligence and carried out by a department if, in the Agency’s opinion, the activity may not be in compliance with the law. For the purposes of that Part, the executive director is deemed to be a <DefinitionRef>deputy head</DefinitionRef>, and the Secretariat’s employees are deemed to be employees, as defined in subsection 2(1) of that Act.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170043" lims:id="1170043"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170044" lims:id="1170044">Powers of the executive director</MarginalNote><Label>46</Label><Text>In exercising his or her authority under subsection <XRefInternal>45</XRefInternal>(1), the executive director may</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170045" lims:id="1170045"><Label>(a)</Label><Text>determine the human resources requirements of the Secretariat and provide for the allocation and effective utilization of human resources in the Secretariat;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170046" lims:id="1170046"><Label>(b)</Label><Text>provide for the classification of positions in and employees of the Secretariat;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170047" lims:id="1170047"><Label>(c)</Label><Text>after consultation with the President of the Treasury Board, determine and regulate the pay to which Secretariat employees are entitled for services rendered, the hours of work and leave of those employees and any related matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170048" lims:id="1170048"><Label>(d)</Label><Text>after consultation with the President of the Treasury Board, determine and regulate the payments that may be made to Secretariat employees by way of reimbursement for travel or other expenses and by way of allowances in respect of expenses and conditions arising out of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170049" lims:id="1170049"><Label>(e)</Label><Text>determine the learning, training and development requirements of the Secretariat employees and fix the terms on which the learning, training and development may be carried out;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170050" lims:id="1170050"><Label>(f)</Label><Text>provide for the awards that may be made to Secretariat employees for outstanding performance of their duties, for other meritorious achievement in relation to their duties or for inventions or practical suggestions for improvements;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170051" lims:id="1170051"><Label>(g)</Label><Text>establish standards of discipline and set penalties, including termination of employment, suspension, demotion to a position at a lower maximum rate of pay and financial penalties;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170052" lims:id="1170052"><Label>(h)</Label><Text>provide for the termination of employment, or the demotion to a position at a lower maximum rate of pay, of Secretariat employees for reasons other than breaches of discipline or misconduct;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170053" lims:id="1170053"><Label>(i)</Label><Text>establish policies respecting the exercise of the powers granted by this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170054" lims:id="1170054"><Label>(j)</Label><Text>provide for any other matters, including terms and conditions of employment not otherwise specifically provided for in this section, that the executive director considers necessary for effective human resources management in the Secretariat.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170055" lims:id="1170055"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170056" lims:id="1170056">Negotiation of collective agreements</MarginalNote><Label>47</Label><Text>Before entering into collective bargaining with the bargaining agent for a bargaining unit composed of Secretariat employees, the executive director must have the Secretariat’s negotiating mandate approved by the President of the Treasury Board.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170057" lims:id="1170057"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170058" lims:id="1170058">Technical assistance</MarginalNote><Label>48</Label><Text>The executive director may engage the services of persons having technical or specialized knowledge to advise and assist the Review Agency in the exercise of its powers and the performance of its duties and functions and, with the approval of the Treasury Board, may fix and pay their remuneration and expenses.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1170059" lims:id="1170059" level="1"><TitleText>Security and Confidentiality</TitleText></Heading><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170060" lims:id="1170060"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170061" lims:id="1170061">Oath or solemn affirmation</MarginalNote><Label>49</Label><Text>Each member of the Review Agency must take the following oath or make the following solemn affirmation:</Text><Oath>I, <Leader leader="dot" length="3pc" />, swear (solemnly affirm) that I will, to the best of my ability, discharge my responsibilities as a member of the National Security and Intelligence Review Agency and will not communicate or use without due authority any information obtained in confidence by me in that capacity.</Oath></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170062" lims:id="1170062"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170063" lims:id="1170063">Compliance with security requirements</MarginalNote><Label>50</Label><Text>Each member of the Review Agency, the executive director, each employee of the Secretariat and any person whose services the Secretariat engages under section 48 must</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170064" lims:id="1170064"><Label>(a)</Label><Text>maintain the security clearance required by the Government of Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170065" lims:id="1170065"><Label>(b)</Label><Text>follow established procedures or practices, including any requirement found in a Treasury Board policy, guideline or directive, for the secure handling, storage, transportation and transmission of information or documents.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170066" lims:id="1170066"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170067" lims:id="1170067">Disclosure prohibited</MarginalNote><Label>51</Label><Text>A member or former member of the Review Agency, the executive director or a former executive director of the Secretariat or a person who is or was engaged by the Secretariat may disclose information that they obtained, or to which they had access, in the course of exercising their powers or performing their duties and functions under this Act only for the purpose of exercising their powers or performing their duties and functions under this Act or as required by any other law.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170068" lims:id="1170068"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170069" lims:id="1170069">Protection of confidential information</MarginalNote><Label>52</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170070" lims:id="1170070"><Label>(1)</Label><Text>The Review Agency must consult with the deputy heads concerned in preparing any of the following, in order to ensure that they do not contain information the disclosure of which would be injurious to national security, national defence or international relations or is information that is subject to solicitor-client privilege or the professional secrecy of advocates and notaries or to litigation privilege:</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170071" lims:id="1170071"><Label>(a)</Label><Text>a statement under section <XRefInternal>22</XRefInternal> of this Act, subsection 45(6) of the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal> or subsection 19(5) of the <XRefExternal reference-type="act" link="C-29">Citizenship Act</XRefExternal>;
