between the prior presence of aboriginal peoples and the assertion of sovereignty by the Crown is of significant social and economic importance to Canadians;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365209" lims:id="365209" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas Canadian courts have stated that this reconciliation is best achieved through negotiation and agreement, rather than through litigation or conflict;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365210" lims:id="365210" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas representatives of the Nisga’a Nation, Her Majesty in right of Canada and Her Majesty in right of British Columbia have negotiated the Nisga’a Final Agreement to achieve this reconciliation and to establish a new relationship among them;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365211" lims:id="365211" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Constitution of Canada is the supreme law of Canada;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365212" lims:id="365212" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Nisga’a Final Agreement states that the Agreement does not alter the Constitution of Canada;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365213" lims:id="365213" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Nisga’a Final Agreement states that the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> applies to Nisga’a Government in respect of all matters within its authority, bearing in mind the free and democratic nature of Nisga’a Government as set out in the Agreement;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365214" lims:id="365214" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And Whereas the enactment of federal legislation is required by the Nisga’a Final Agreement to give effect to the Agreement;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2002-12-31" lims:fid="365215" lims:id="365215"><Provision lims:inforce-start-date="2002-12-31" lims:fid="365216" lims:id="365216" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Now, Therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2002-12-31" lims:fid="365217" lims:id="365217"><Heading title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="N-23.3">Nisga’a Final Agreement Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365221" lims:id="365221" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365222" lims:id="365222"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365223" lims:id="365223">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365224" lims:id="365224"><Label>(1)</Label><Text>The definitions in this subsection apply in this Act.</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="365225" lims:id="365225"><Text><DefinedTermEn>Nisga’a Final Agreement</DefinedTermEn> means the Nisga’a Final Agreement signed on behalf of the Nisga’a Nation and Her Majesty in right of British Columbia on April 27, 1999 and on behalf of Her Majesty in right of Canada on May 4, 1999 and laid before the House of Commons on October 19, 1999, and includes any amendments made to that Agreement from time to time in accordance with its provisions. (<DefinedTermFr>Accord définitif nisga’a</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365226" lims:id="365226"><Text><DefinedTermEn>settlement legislation</DefinedTermEn> means the Acts of Parliament and the Acts of the Legislature of British Columbia that give effect to the Nisga’a Final Agreement, including this Act and the <XRefExternal reference-type="act" link="N-23.3">Nisga’a Final Agreement Act</XRefExternal> (British Columbia). (<DefinedTermFr>législation de mise en vigueur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365227" lims:id="365227"><Text><DefinedTermEn>Taxation Agreement</DefinedTermEn> means the Nisga’a Nation Taxation Agreement, laid before the House of Commons on October 19, 1999, and entered into on the effective date of the Nisga’a Final Agreement by the Nisga’a Nation, Her Majesty in right of Canada and Her Majesty in right of British Columbia, as provided for by paragraph 21 of the Taxation Chapter of the Nisga’a Final Agreement, and includes any amendments made to the Nisga’a Nation Taxation Agreement from time to time in accordance with its provisions. (<DefinedTermFr>accord fiscal</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365228" lims:id="365228"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365229" lims:id="365229">Expressions defined in Agreement</MarginalNote><Label>(2)</Label><Text>Words and expressions used in this Act have the same meaning as in the Nisga’a Final Agreement, unless the context requires otherwise.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365230" lims:id="365230"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365231" lims:id="365231"><XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal></MarginalNote><Label>3</Label><Text>The Nisga’a Final Agreement is a treaty and a land claims agreement within the meaning of sections 25 and 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365232" lims:id="365232" level="1"><TitleText>Nisga’a Final Agreement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365233" lims:id="365233"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365234" lims:id="365234">Nisga’a Final Agreement</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365235" lims:id="365235"><Label>(1)</Label><Text>The Nisga’a Final Agreement is approved, given effect and declared valid and has the force of law.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365236" lims:id="365236"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365237" lims:id="365237">Rights and duties</MarginalNote><Label>(2)</Label><Text>Without limiting the application of subsection (1), a person or body has the powers, rights, privileges and benefits conferred on the person or body by the Nisga’a Final Agreement and shall perform the duties and is subject to the liabilities imposed on the person or body by that Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365238" lims:id="365238"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365239" lims:id="365239">Saving</MarginalNote><Label>(3)</Label><Text>No provision made by this Act for a matter that is already provided for in the Nisga’a Final Agreement limits the application of this section.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365240" lims:id="365240"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365241" lims:id="365241">Agreement binding</MarginalNote><Label>5</Label><Text>The Nisga’a Final Agreement is binding on, and can be relied on by, all persons.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365242" lims:id="365242"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365243" lims:id="365243">Conflict between Agreement and laws</MarginalNote><Label>6</Label><Text>In the event of an inconsistency or conflict between the Nisga’a Final Agreement and the provisions of any federal or provincial law, including this Act, that Agreement prevails to the extent of the inconsistency or conflict.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365244" lims:id="365244"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365245" lims:id="365245">Aboriginal rights</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365246" lims:id="365246"><Label>(1)</Label><Text>Notwithstanding the common law, as a result of the Nisga’a Final Agreement and the settlement legislation, the aboriginal rights, including the aboriginal title, of the Nisga’a Nation, as they existed anywhere in Canada before the effective date of that Agreement, including their attributes and geographic extent, are modified, and continue as modified, as set out in that Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365247" lims:id="365247"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365248" lims:id="365248">Aboriginal title</MarginalNote><Label>(2)</Label><Text>For greater certainty, the aboriginal title of the Nisga’a Nation anywhere that it existed in Canada before the effective date of the Nisga’a Final Agreement is modified and continues as the estates in fee simple to those areas identified in that Agreement as Nisga’a Lands or Nisga’a Fee Simple Lands.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365249" lims:id="365249"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365250" lims:id="365250">Interpretation</MarginalNote><Label>(3)</Label><Text>The express derogation from the common law contained in subsection (1), which is also contained in paragraph 24 of the General Provisions Chapter of the Nisga’a Final Agreement, shall not be construed so as to limit the effect on the common law of any other provision of this or any other Act that does not contain an express derogation from the common law.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365251" lims:id="365251"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365252" lims:id="365252">Fee simple estate</MarginalNote><Label>8</Label><Text>On the effective date of the Nisga’a Final Agreement, the Nisga’a Nation owns the estate in fee simple, as set out in the Lands Chapter of that Agreement, in</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365253" lims:id="365253"><Label>(a)</Label><Text>the Nisga’a Lands identified in paragraphs 1 and 2 of the Lands Chapter of that Agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365254" lims:id="365254"><Label>(b)</Label><Text>Category A Lands and Category B Lands.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365255" lims:id="365255" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365256" lims:id="365256"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365257" lims:id="365257">Appropriation</MarginalNote><Label>9</Label><Text>There shall be paid out of the Consolidated Revenue Fund the sums that are required to meet the obligations of Canada under the Capital Transfer and Negotiation Loan Repayment Chapter and the Fisheries Chapter of the Nisga’a Final Agreement.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365258" lims:id="365258"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365259" lims:id="365259">Regulations</MarginalNote><Label>10</Label><Text>The Governor in Council may make any regulations or orders that the Governor in Council considers necessary or advisable for the purpose of carrying out any of the provisions of the Nisga’a Final Agreement or of the Taxation Agreement.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365260" lims:id="365260"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365261" lims:id="365261">Judicial notice of Agreements</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365262" lims:id="365262"><Label>(1)</Label><Text>Judicial notice shall be taken of the Nisga’a Final Agreement and the Taxation Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365263" lims:id="365263"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365264" lims:id="365264">Publication of Agreements</MarginalNote><Label>(2)</Label><Text>The Nisga’a Final Agreement and the Taxation Agreement shall be published by the Queen’s Printer.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365265" lims:id="365265"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365266" lims:id="365266">Evidence</MarginalNote><Label>(3)</Label><Text>A copy of the Nisga’a Final Agreement or the Taxation Agreement published by the Queen’s Printer is evidence of that Agreement, and a copy purporting to be published by the Queen’s Printer shall be deemed to be so published, unless the contrary is shown.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365267" lims:id="365267"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365268" lims:id="365268">Judicial notice of Nisga’a laws</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365269" lims:id="365269"><Label>(1)</Label><Text>Judicial notice shall be taken of Nisga’a laws.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365270" lims:id="365270"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365271" lims:id="365271">Evidence of Nisga’a law</MarginalNote><Label>(2)</Label><Text>A copy of a Nisga’a law purporting to be deposited in the public registry of Nisga’a laws referred to in the Nisga’a Government Chapter of the Nisga’a Final Agreement is evidence of that law and of its contents, unless the contrary is shown.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365272" lims:id="365272"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365273" lims:id="365273">Harvest Agreement</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365274" lims:id="365274"><Label>(1)</Label><Text>The Minister of Fisheries and Oceans has the authority, on behalf of Her Majesty in right of Canada, to enter into the Harvest Agreement described in the Fisheries Chapter of the Nisga’a Final Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365275" lims:id="365275"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365276" lims:id="365276">Not a treaty</MarginalNote><Label>(2)</Label><Text>The Harvest Agreement does not form part of the Nisga’a Final Agreement, and it is not a treaty or a land claims agreement within the meaning of section 25 or 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" Agreement is approved, given effect and declared valid and, during the period that the Taxation Agreement is, by its terms, in force, it has the force of law.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365292" lims:id="365292">Application of laws</MarginalNote><Label>15</Label><Text>To the extent that a law of British Columbia does not apply of its own force to the Nisga’a Nation, Nisga’a Villages, Nisga’a Institutions, Nisga’a Corporations or Nisga’a citizens, that law applies, subject to this Act and any other Act of Parliament, in accordance with the Nisga’a Final Agreement to the Nisga’a Nation, Nisga’a Villages, Nisga’a Institutions, Nisga’a Corporations or Nisga’a citizens, as the case may be.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365293" lims:id="365293" level="1"><TitleText>Application of Other Acts</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365294" lims:id="365294"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365295" lims:id="365295"><XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal></MarginalNote><Label>16</Label><Text>Subject to the Indian Act Transition Chapter and paragraphs 5 and 6 of the Taxation Chapter of the Nisga’a Final Agreement, the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal> does not apply to the Nisga’a Nation, Nisga’a Villages, Nisga’a Institutions or Nisga’a citizens as of the effective date of that Agreement, except for the purpose of determining whether an individual is an “Indian”.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365296" lims:id="365296"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365297" lims:id="365297">Section 126 of <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal></MarginalNote><Label>17</Label><Text>For greater certainty, section 126 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> does not apply in respect of anything required to be done or forbidden to be done by or under the Nisga’a Final Agreement.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:id="365307"><Label>(1)</Label><Text>If, in any judicial or administrative proceeding, an issue arises in respect of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365308" lims:id="365308"><Label>(a)</Label><Text>the interpretation or validity of the Nisga’a Final Agreement, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365309" lims:id="365309"><Label>(b)</Label><Text>the validity or applicability of any settlement legislation or any Nisga’a law,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="365310" lims:id="365310"><Text>the issue shall not be decided until the party raising the issue has properly served notice on the Attorney General of Canada, the Attorney General of British Columbia and the Nisga’a Lisims Government.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365311" lims:id="365311"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365312" lims:id="365312">Content of notice</MarginalNote><Label>(2)</Label><Text>The notice required under subsection (1) must</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365313" lims:id="365313"><Label>(a)</Label><Text>describe the judicial or administrative proceeding in which the issue arises;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365314" lims:id="365314"><Label>(b)</Label><Text>state whether the issue arises in respect of the matters referred to in paragraph (1)(a) or (b) or both;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365315" lims:id="365315"><Label>(c)</Label><Text>state the day on which the issue is to be argued;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365316" lims:id="365316"><Label>(d)</Label><Text>give particulars necessary to show the point to be argued; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365317" lims:id="365317"><Label>(e)</Label><Text>be served at least fourteen days before the day of argument, unless the subsection (1) applies, the Attorney General of Canada, the Attorney General of British Columbia and the Nisga’a Lisims Government may appear and participate in the proceeding as parties with the same
