Workers were parties to two collective agreements, one that expired on December 31, 2017 and one that expired on January 31, 2018;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395681" lims:id="395681" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the parties have engaged, since November 2017, in collective bargaining to reach new collective agreements;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395682" lims:id="395682" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Minister of Labour and the Minister of Public Works and Government Services met with the parties on a number of occasions to encourage them to reach new collective agreements;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395683" lims:id="395683" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Minister of Labour appointed conciliation officers in July 2018 to assist the parties in their negotiations and the conciliation period expired without the parties having entered into new collective agreements;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395684" lims:id="395684" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Minister of Labour appointed mediators in September 2018 to further assist the parties in the negotiation of a settlement of their differences for the purpose of renewing their collective agreements;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395685" lims:id="395685" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas work stoppages commenced on October 22, 2018;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395686" lims:id="395686" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Minister of Labour appointed a special mediator on October 24, 2018, and then re-appointed the special mediator on November 7, 2018, to assist the parties in negotiating new collective agreements and in ending the work stoppages, and in each case the appointment ended without the parties having entered into new collective agreements and without the work stoppages having ended;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395687" lims:id="395687" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the work stoppages are disrupting the delivery of mail and parcels across Canada;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395688" lims:id="395688" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the work stoppages are having a significant adverse impact on Canadian workers, consumers and businesses as well as on those Canadians who rely on postal services;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395689" lims:id="395689" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Minister of Labour recognizes the importance of effective collective bargaining practices and the need for stable industrial relations for employees, unions and employers in the postal services sector;</Text></Provision><Provision lims:inforce-start-date="2018-11-26" lims:fid="395690" lims:id="395690" format-ref="indent-0-0" list-item="no" language-align="no"><Text>And whereas, having regard to the negative impact of the work stoppages, the public interest requires an exceptional solution to address the matters in dispute so that new collective agreements may be concluded;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2018-11-26" lims:fid="395691" lims:id="395691"><Provision lims:inforce-start-date="2018-11-26" lims:fid="395692" lims:id="395692" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2018-11-26" lims:fid="395693" lims:id="395693"><Heading lims:inforce-start-date="2018-11-26" lims:fid="395694" lims:id="395694" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395695" lims:id="395695"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395696" lims:id="395696">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="P-16.5">Postal Services Resumption and Continuation Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395697" lims:id="395697" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395698" lims:id="395698"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395699" lims:id="395699">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395700" lims:id="395700"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2018-11-27" lims:fid="395701" lims:id="395701"><Text><DefinedTermEn>collective agreement</DefinedTermEn> means the collective agreement between the employer and the union that expired on December 31, 2017 or the collective agreement between the employer and the union that expired on January 31, 2018. (<DefinedTermFr>convention collective</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-27" lims:fid="395702" lims:id="395702"><Text><DefinedTermEn>employee</DefinedTermEn> means a person who is employed by the employer and bound by a collective agreement. (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-27" lims:fid="395703" lims:id="395703"><Text><DefinedTermEn>employer</DefinedTermEn> means the Canada Post Corporation. (<DefinedTermFr>employeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-27" lims:fid="395704" lims:id="395704"><Text><DefinedTermEn>mediator-arbitrator</DefinedTermEn> means the mediator-arbitrator appointed under subsection <XRefInternal>8</XRefInternal>(2). (<DefinedTermFr>médiateur-arbitre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-27" lims:fid="395705" lims:id="395705"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Labour. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-27" lims:fid="395706" lims:id="395706"><Text><DefinedTermEn>union</DefinedTermEn> means the Canadian Union of Postal Workers, representing the Urban Postal Operations Unit or the Rural and Suburban Mail Carriers Unit. (<DefinedTermFr>syndicat</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395707" lims:id="395707"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395708" lims:id="395708">Words and expressions</MarginalNote><Label>(2)</Label><Text>Unless otherwise provided, words and expressions used in this Act have the same meaning as in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395709" lims:id="395709"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395710" lims:id="395710">Presumption</MarginalNote><Label>(3)</Label><Text>For the purposes of this Act, the union is deemed to be a person.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395711" lims:id="395711" level="1"><TitleText>Postal Services</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395712" lims:id="395712"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395713" lims:id="395713">Resumption or continuation of postal services</MarginalNote><Label>3</Label><Text>On the coming into force of this Act,</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395714" lims:id="395714"><Label>(a)</Label><Text>the employer must resume without delay, or continue, as the case may be, postal services; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395715" lims:id="395715"><Label>(b)</Label><Text>every employee must, when so required, resume without delay, or continue, as the case may be, the duties of their employment.</Text></Paragraph></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395716" lims:id="395716"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395717" lims:id="395717">Prohibitions</MarginalNote><Label>4</Label><Text>It is prohibited for the employer and for any of its officers and representatives to</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395718" lims:id="395718"><Label>(a)</Label><Text>in any manner impede any employee from complying with paragraph <XRefInternal>3</XRefInternal>(b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395719" lims:id="395719"><Label>(b)</Label><Text>discharge or in any other manner discipline, or authorize or direct the discharge or discipline of, any employee by reason of the employee having been on strike before the coming into force of this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395720" lims:id="395720"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395721" lims:id="395721">Obligations</MarginalNote><Label>5</Label><Text>The union and each of its officers and representatives must</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395722" lims:id="395722"><Label>(a)</Label><Text>without delay on the coming into force of this Act, give notice to the employees that, by reason of that coming into force, postal services are to be resumed or continued, as the case may be, and that the employees, when so required, are to resume without delay, or continue, the duties of their employment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395723" lims:id="395723"><Label>(b)</Label><Text>take all reasonable steps to ensure that employees comply with paragraph <XRefInternal>3</XRefInternal>(b).</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395724" lims:id="395724" level="1"><TitleText>Extension of Collective Agreements</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395725" lims:id="395725"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395726" lims:id="395726">Extension</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395727" lims:id="395727"><Label>(1)</Label><Text>The term of the collective agreement that expired on December 31, 2017 is extended to include the period beginning on January 1, 2018 and ending immediately before a new collective agreement between the parties comes into effect, except for any period during which there is</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395728" lims:id="395728"><Label>(a)</Label><Text>a strike against the employer in respect of the bargaining unit to which the collective agreement applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395729" lims:id="395729"><Label>(b)</Label><Text>a lockout against the union in respect of the bargaining unit to which the collective agreement applies.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395730" lims:id="395730"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395731" lims:id="395731">Extension</MarginalNote><Label>(2)</Label><Text>The term of the collective agreement that expired on January 31, 2018 is extended to include the period beginning on February 1, 2018 and ending immediately before a new collective agreement between the parties comes into effect, except for any period during which there is</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395732" lims:id="395732"><Label>(a)</Label><Text>a strike against the employer in respect of the bargaining unit to which the collective agreement applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395733" lims:id="395733"><Label>(b)</Label><Text>a lockout against the union in respect of the bargaining unit to which the collective agreement applies.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395734" lims:id="395734"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395735" lims:id="395735">Collective agreement binding for extended term</MarginalNote><Label>(3)</Label><Text>A collective agreement, as extended by subsection (1) or (2), is effective and binding on the parties to it for the period for which it is extended, despite anything in the collective agreement or in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>. However, that Part applies in respect of the collective agreement, as extended, as if that period were the term of the collective agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395736" lims:id="395736"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395737" lims:id="395737">Arbitration of discipline or discharge</MarginalNote><Label>(4)</Label><Text>Any person employed by the employer who is disciplined or discharged during any period that is excluded under subsection (1) or (2), and who, but for the exclusion, would have been bound by the collective agreement during that period, may submit the matter, for final settlement,</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395738" lims:id="395738"><Label>(a)</Label><Text>to an arbitrator selected by the employer and the union; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395739" lims:id="395739"><Label>(b)</Label><Text>if they are unable to agree on the selection of an arbitrator and either of them makes a written request to the Minister to appoint an arbitrator, to an arbitrator appointed by the Minister after any inquiry that the Minister considers necessary.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395740" lims:id="395740"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395741" lims:id="395741">Provisions applicable</MarginalNote><Label>(5)</Label><Text>Sections 58 to 61 and 63 to 66 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> apply, with any modifications that the circumstances require, in respect of an arbitrator to whom a matter is submitted under subsection (4).</Text></Subsection></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395742" lims:id="395742"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395743" lims:id="395743">Strikes and lockouts prohibited</MarginalNote><Label>7</Label><Text>Until a collective agreement, as extended by subsection <XRefInternal>6</XRefInternal>(1) or (2), expires, it is prohibited</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395744" lims:id="395744"><Label>(a)</Label><Text>for the employer and for any of its officers and representatives to declare or cause a lockout against the union in respect of the bargaining unit to which the collective agreement applies;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395745" lims:id="395745"><Label>(b)</Label><Text>for the union and for any of its officers and representatives to declare or authorize a strike against the employer in respect of that bargaining unit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395746" lims:id="395746"><Label>(c)</Label><Text>for an employee who is a member of that bargaining unit to participate in a strike against the employer.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395747" lims:id="395747" level="1"><TitleText>Mediator-Arbitrator</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395748" lims:id="395748"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395749" lims:id="395749">Lists of candidates</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395750" lims:id="395750"><Label>(1)</Label><Text>The employer and the union may, within two days after the day on which this Act comes into force, each provide to the Minister a list of the names of up to three individuals that the employer or union, as the case may be, considers qualified to act as mediator-arbitrator.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395751" lims:id="395751"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395752" lims:id="395752">Appointment of mediator-arbitrator</MarginalNote><Label>(2)</Label><Text>If the two lists have only one name in common, the Minister must appoint that individual as the mediator-arbitrator, and if they have more than one name in common, he or she must appoint one of those individuals. However, if the Minister does not receive both lists within the period referred to in subsection (1), or if the lists that are received within that period have no names in common, he or she must appoint the mediator-arbitrator after seeking advice from the Chairperson of the Canada Industrial Relations Board.</Text></Subsection></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395753" lims:id="395753"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395754" lims:id="395754">Referral of matters in dispute</MarginalNote><Label>9</Label><Text>The Minister must refer to the mediator-arbitrator all matters relating to the amendment or revision of each collective agreement that are, at the time of the appointment, in dispute between the parties.</Text></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395755" lims:id="395755"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395756" lims:id="395756">Powers and duties of mediator-arbitrator</MarginalNote><Label>10</Label><Text>The mediator-arbitrator has, with any modifications that the circumstances require, all the powers and duties referred to in paragraphs 60(1)(a) and (a.2) to (a.4) and sections 61 and 84 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395757" lims:id="395757"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395758" lims:id="395758">Duties of mediator-arbitrator</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395759" lims:id="395759"><Label>(1)</Label><Text>Within 90 days after the day on which he or she is appointed or any longer period that the Minister may allow, the mediator-arbitrator must</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395760" lims:id="395760"><Label>(a)</Label><Text>endeavour to mediate all the matters that were referred to him or her relating to the amendment or revision of each collective agreement and to bring about an agreement between the parties to it on those matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395761" lims:id="395761"><Label>(b)</Label><Text>if he or she is unable to bring about an agreement between the parties in respect of any such matter,</Text><Subparagraph lims:inforce-start-date="2018-11-27" lims:fid="395762" lims:id="395762"><Label>(i)</Label><Text>hear the parties on the matter, arbitrate the matter and render a decision in respect of the matter, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-27" lims:fid="395763" lims:id="395763"><Label>(ii)</Label><Text>ask each of the parties to submit, within the time and in the manner that he or she may specify, that party’s final offer in respect of the matter and, subject to subsection (7), select, in order to resolve the matter, either the final offer of the employer or the final offer of the union; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395764" lims:id="395764"><Label>(c)</Label><Text>report to the Minister on the resolution of each of the matters that were referred to the mediator-arbitrator and provide the parties with a copy of the report.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395765" lims:id="395765"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395766" lims:id="395766">Precision</MarginalNote><Label>(2)</Label><Text>For greater certainty, the choice of acting in accordance with subparagraph (1)(b)(i) or (ii) is at the discretion of the mediator-arbitrator.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395767" lims:id="395767"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395768" lims:id="395768">Guiding principles</MarginalNote><Label>(3)</Label><Text>In rendering a decision or selecting a final offer under paragraph (1)(b), the mediator-arbitrator is to be guided by the need</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395769" lims:id="395769"><Label>(a)</Label><Text>to ensure that the health and safety of the employees is protected;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395770" lims:id="395770"><Label>(b)</Label><Text>to ensure that the employees receive equal pay for work of equal value;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395771" lims:id="395771"><Label>(c)</Label><Text>to ensure the fair treatment of temporary or part-time employees, and other employees in non-standard employment, as compared to full-time, permanent employees;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395772" lims:id="395772"><Label>(d)</Label><Text>to ensure the financial sustainability of the employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395773" lims:id="395773"><Label>(e)</Label><Text>to create a culture of collaborative labour-management relations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395774" lims:id="395774"><Label>(f)</Label><Text>to have the employer provide high-quality service at a reasonable price to Canadians.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395775" lims:id="395775"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395776" lims:id="395776">Mediation period</MarginalNote><Label>(4)</Label><Text>Despite subsection (1), the mediator-arbitrator has a period of not more than seven days after the day on which he or she is appointed — that may be extended for an additional period of not more than seven days if the parties agree — within which to endeavour to mediate the matters referred to in paragraph (1)(a) and to bring about an agreement between the parties.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395777" lims:id="395777"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395778" lims:id="395778">Contractual language — decision</MarginalNote><Label>(5)</Label><Text>Every decision of the mediator-arbitrator under subparagraph (1)(b)(i) must be worded in appropriate contractual language so as to allow its incorporation into a new collective agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395779" lims:id="395779"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395780" lims:id="395780">Contractual language — final offer</MarginalNote><Label>(6)</Label><Text>The final offer of the employer and of the union referred to in subparagraph (1)(b)(ii) must be submitted with proposed contractual language that can be incorporated into a new collective agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395781" lims:id="395781"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395782" lims:id="395782">If no final offer submitted</MarginalNote><Label>(7)</Label><Text>If either party fails to submit to the mediator-arbitrator a final offer when requested to do so under subparagraph (1)(b)(ii), the mediator-arbitrator must select the final offer submitted by the other party.</Text></Subsection></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395783" lims:id="395783"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395784" lims:id="395784">New collective agreements not precluded</MarginalNote><Label>12</Label><Text>Nothing in this Act precludes the parties to a collective agreement from entering into a new collective agreement at any time before the mediator-arbitrator reports to the Minister under paragraph <XRefInternal>11</XRefInternal>(1)(c) and, if they do so, the mediator-arbitrator’s duties under this Act respecting the collective agreement cease as of the day on which the new collective agreement is entered into.</Text></Section><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395785" lims:id="395785"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395786" lims:id="395786">Costs</MarginalNote><Label>13</Label><Text>All costs incurred by Her Majesty in right of Canada relating to the appointment of the mediator-arbitrator and the performance of their duties under this Act are debts due to Her Majesty in right of Canada and may be recovered as such, in equal parts from the employer and the union, in any court of competent jurisdiction.</Text></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395787" lims:id="395787" level="1"><TitleText>New Collective Agreements</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395788" lims:id="395788"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395789" lims:id="395789">New collective agreement</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395790" lims:id="395790"><Label>(1)</Label><Text>Despite anything in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, but subject to subsection (2), beginning on the day after the day on which the mediator-arbitrator reports to the Minister under paragraph <XRefInternal>11</XRefInternal>(1)(c) in respect of the matters that were referred to them in respect of the amendment or revision of a collective agreement (in this subsection referred to as the “former collective agreement”), a new collective agreement consisting of the following is effective and binding on the parties:</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395791" lims:id="395791"><Label>(a)</Label><Text>every agreement entered into by the parties, before the appointment of the mediator-arbitrator, in relation to the amendment or revision of the former collective agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395792" lims:id="395792"><Label>(b)</Label><Text>every agreement entered into by the parties, after the appointment of the mediator-arbitrator, in relation to the matters that were referred to the mediator-arbitrator relating to the amendment or revision of the former collective agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395793" lims:id="395793"><Label>(c)</Label><Text>every decision made by, and every final offer selected by, the mediator-arbitrator under paragraph <XRefInternal>11</XRefInternal>(1)(b) in relation to the matters referred to in paragraph (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395794" lims:id="395794"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395795" lims:id="395795">Application</MarginalNote><Label>(2)</Label><Text>Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> applies in respect of the new collective agreement as if it had been entered into under that Part.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395796" lims:id="395796"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395797" lims:id="395797">Coming into effect of provisions</MarginalNote><Label>(3)</Label><Text>The new collective agreement may provide that any of its provisions are effective and binding as of a day that is before or after the day on which the new collective agreement becomes effective and binding.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395798" lims:id="395798"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395799" lims:id="395799">Amendments</MarginalNote><Label>(4)</Label><Text>Nothing in this Act is to be construed so as to limit or restrict the rights of the parties to the new collective agreement to amend any of its provisions and to give effect to the amendment.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395800" lims:id="395800" level="1"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2018-11-27" lims:lastAmendedDate="2018-11-27" lims:fid="395801" lims:id="395801"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395802" lims:id="395802">Individuals</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395803" lims:id="395803"><Label>(1)</Label><Text>An individual who contravenes any provision of this Act is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of not more than</Text><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395804" lims:id="395804"><Label>(a)</Label><Text>$50,000, if the individual was acting in the capacity of an officer or representative of the employer or the union when the offence was committed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-27" lims:fid="395805" lims:id="395805"><Label>(b)</Label><Text>$1,000, in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395806" lims:id="395806"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395807" lims:id="395807">Employer or union</MarginalNote><Label>(2)</Label><Text>If the employer or the union contravenes any provision of this Act, it is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of not more than $100,000.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395808" lims:id="395808"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395809" lims:id="395809">No imprisonment</MarginalNote><Label>(3)</Label><Text>Despite subsection 787(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, no term of imprisonment is to be imposed in default of payment of a fine that is imposed under subsection (1) or (2).</Text></Subsection><Subsection lims:inforce-start-date="2018-11-27" lims:fid="395810" lims:id="395810"><MarginalNote lims:inforce-start-date="2018-11-27" lims:fid="395811" lims:id="395811">Recovery of fines</MarginalNote><Label>(4)</Label><Text>If a person is convicted of an offence under subsection (1) or (2) and the fine that is imposed is not paid when required, the prosecutor may, by filing the conviction, enter as a judgment the amount of the fine and costs, if any, in a superior court of the province in which the trial was held, and the judgment is enforceable against the person in the same manner as if it were a judgment rendered against the person in that court in civil proceedings.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-26" lims:fid="395812" lims:id="395812" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2018-11-26" lims:lastAmendedDate="2018-11-26" lims:fid="395813" lims:id="395813"><MarginalNote lims:inforce-start-date="2018-11-26" lims:fid="395814" lims:id="395814">Noon of day after royal assent</MarginalNote><Label>16</Label><Text>This Act comes into force at noon Eastern Standard Time on the day after the day on which it receives royal
