in this Act.</Text><Definition lims:inforce-start-date="2012-03-16" lims:fid="400423" lims:id="400423"><Text><DefinedTermEn>employer</DefinedTermEn> means Air Canada. (<DefinedTermFr>employeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="400424" lims:id="400424"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Labour. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400425" lims:id="400425"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400426" lims:id="400426">Words and expressions</MarginalNote><Label>(2)</Label><Text>Unless otherwise provided, words and expressions used in this Act have the same meaning as in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400427" lims:id="400427" level="1"><Label>PART 1</Label><TitleText>Technical, Maintenance and Operational Support Employees</TitleText></Heading><Heading lims:inforce-start-date="2012-03-15" lims:fid="400428" lims:id="400428" level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400429" lims:id="400429"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400430" lims:id="400430">Definitions</MarginalNote><Label>3</Label><Text>The following definitions apply in this Part.</Text><Definition lims:inforce-start-date="2012-03-16" lims:fid="400431" lims:id="400431"><Text><DefinedTermEn>arbitrator</DefinedTermEn> means the arbitrator appointed under section <XRefInternal>11</XRefInternal>. (<DefinedTermFr>arbitre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="400432" lims:id="400432"><Text><DefinedTermEn>collective agreement</DefinedTermEn> means the collective agreement between the employer and the union that expired on March 31, 2011. (<DefinedTermFr>convention collective</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="400433" lims:id="400433"><Text><DefinedTermEn>employee</DefinedTermEn> means a person who is employed by the employer and bound by the collective agreement. (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="400434" lims:id="400434"><Text><DefinedTermEn>union</DefinedTermEn> means the International Association of Machinists and Aerospace Workers. (<DefinedTermFr>syndicat</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400435" lims:id="400435" level="2"><TitleText>Air Service Operations</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400436" lims:id="400436"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400437" lims:id="400437">Suspension of right to declare strike or lockout</MarginalNote><Label>4</Label><Text>If, before the coming into force of this Act, the employer has not declared or caused a lockout and the union has not declared or authorized a strike, on the coming into force of this Act the employer’s right to declare or cause a lockout and the union’s right to declare or authorize a strike are suspended until the day on which the collective agreement, as extended by subsection <XRefInternal>9</XRefInternal>(1), expires.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400438" lims:id="400438"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400439" lims:id="400439">Application of sections <XRefInternal>6</XRefInternal> to <XRefInternal>8</XRefInternal></MarginalNote><Label>5</Label><Text>Sections <XRefInternal>6</XRefInternal> to <XRefInternal>8</XRefInternal> apply if, before the coming into force of this Act, the employer has declared or caused a lockout or the union has declared or authorized a strike.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400440" lims:id="400440"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400441" lims:id="400441">Continuation or resumption of air service operations</MarginalNote><Label>6</Label><Text>On the coming into force of this Act,</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400442" lims:id="400442"><Label>(a)</Label><Text>the employer must continue, or resume without delay, as the case may be, air service operations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400443" lims:id="400443"><Label>(b)</Label><Text>every employee must, when so required, continue, or resume without delay, as the case may be, the duties of their employment.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400444" lims:id="400444"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400445" lims:id="400445">Prohibitions</MarginalNote><Label>7</Label><Text>It is prohibited for the employer and for any officer or representative of the employer to</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400446" lims:id="400446"><Label>(a)</Label><Text>in any manner impede any employee from complying with paragraph <XRefInternal>6</XRefInternal>(b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400447" lims:id="400447"><Label>(b)</Label><Text>discharge or in any other manner discipline, or authorize or direct the discharge or discipline of, any employee by reason of the employee having been on strike before the coming into force of this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400448" lims:id="400448"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400449" lims:id="400449">Obligations</MarginalNote><Label>8</Label><Text>The union and each officer and representative of the union must</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400450" lims:id="400450"><Label>(a)</Label><Text>without delay on the coming into force of this Act, give notice to the employees that, by reason of that coming into force, air service operations are to be continued or resumed, as the case may be, and that the employees, when so required, are to continue, or resume without delay, as the case may be, the duties of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400451" lims:id="400451"><Label>(b)</Label><Text>take all reasonable steps to ensure that employees comply with paragraph <XRefInternal>6</XRefInternal>(b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400452" lims:id="400452"><Label>(c)</Label><Text>refrain from any conduct that may encourage employees not to comply with paragraph <XRefInternal>6</XRefInternal>(b).</Text></Paragraph></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400453" lims:id="400453" level="2"><TitleText>Extension of Collective Agreement</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400454" lims:id="400454"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400455" lims:id="400455">Extension</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400456" lims:id="400456"><Label>(1)</Label><Text>The term of the collective agreement is extended to include the period beginning on April 1, 2011 and ending on the day on which a new collective agreement between the employer and the union comes into effect.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400457" lims:id="400457"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400458" lims:id="400458">Collective agreement binding for extended term</MarginalNote><Label>(2)</Label><Text>Despite anything in the collective agreement or in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, the collective agreement, as extended by subsection (1), is effective and binding on the parties to it for the period for which it is extended. However, that Part applies in respect of the collective agreement, as extended, as if that period were the term of the collective agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400459" lims:id="400459"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400460" lims:id="400460">Strikes and lockouts prohibited</MarginalNote><Label>10</Label><Text>Until the day on which the collective agreement, as extended by subsection <XRefInternal>9</XRefInternal>(1), expires, it is prohibited</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400461" lims:id="400461"><Label>(a)</Label><Text>for the employer and for any officer or representative of the employer to declare or cause a lockout against the union;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400462" lims:id="400462"><Label>(b)</Label><Text>for the union and for any officer or representative of the union to declare or authorize a strike against the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400463" lims:id="400463"><Label>(c)</Label><Text>for an employee to participate in a strike against the employer.</Text></Paragraph></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400464" lims:id="400464" level="2"><TitleText>Final Offer Selection</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400465" lims:id="400465"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400466" lims:id="400466">Appointment of arbitrator</MarginalNote><Label>11</Label><Text>The Minister must appoint as arbitrator for final offer selection a person that the Minister considers appropriate.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400467" lims:id="400467"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400468" lims:id="400468">Powers and duties</MarginalNote><Label>12</Label><Text>The arbitrator has, with any modifications that the circumstances require, all the powers and duties of an arbitrator under paragraphs 60(1)(a) and (a.2) to (a.4) and section 61 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400469" lims:id="400469"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400470" lims:id="400470">Obligation to provide final offer</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400471" lims:id="400471"><Label>(1)</Label><Text>Within the time and in the manner that the arbitrator may specify, the employer and the union must each submit to the arbitrator</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400472" lims:id="400472"><Label>(a)</Label><Text>a list of the matters on which the employer and the union were in agreement as of a date specified by the arbitrator and proposed contractual language that would give effect to those matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400473" lims:id="400473"><Label>(b)</Label><Text>a list of the matters remaining in dispute on that date; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400474" lims:id="400474"><Label>(c)</Label><Text>a final offer in respect of the matters referred to in paragraph (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400475" lims:id="400475"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400476" lims:id="400476">Contractual language</MarginalNote><Label>(2)</Label><Text>The final offer must be submitted with proposed contractual language that can be incorporated into the new collective agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400477" lims:id="400477"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400478" lims:id="400478">Arbitrator’s duties</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400479" lims:id="400479"><Label>(1)</Label><Text>Subject to section <XRefInternal>16</XRefInternal>, within 90 days after being appointed, or within any longer period that may be specified by the Minister, the arbitrator must</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400480" lims:id="400480"><Label>(a)</Label><Text>determine the matters on which the employer and the union were in agreement as of the date specified for the purposes of paragraph <XRefInternal>13</XRefInternal>(1)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400481" lims:id="400481"><Label>(b)</Label><Text>determine the matters remaining in dispute on that date;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400482" lims:id="400482"><Label>(c)</Label><Text>select, in order to resolve the matters remaining in dispute, either the final offer submitted by the employer or the final offer submitted by the union; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400483" lims:id="400483"><Label>(d)</Label><Text>make a decision in respect of the resolution of the matters referred to in this subsection and forward a copy of the decision to the Minister, the employer and the union.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400484" lims:id="400484"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400485" lims:id="400485">Guiding principle</MarginalNote><Label>(2)</Label><Text>In making the selection of a final offer, the arbitrator is to take into account the tentative agreement reached by the employer and the union on February 10, 2012 and the report of the conciliation commissioner dated February 22, 2012 that was released to the parties, and is to be guided by the need for terms and conditions of employment that are consistent with those in other airlines and that will provide the necessary degree of flexibility to ensure</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400486" lims:id="400486"><Label>(a)</Label><Text>the short-and long-term economic viability and competitiveness of the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400487" lims:id="400487"><Label>(b)</Label><Text>the sustainability of the employer’s pension plan, taking into account any short-term funding pressures on the employer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400488" lims:id="400488"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400489" lims:id="400489">If no final offer submitted</MarginalNote><Label>(3)</Label><Text>If either the employer or the union fails to provide the arbitrator with a final offer in accordance with paragraph <XRefInternal>13</XRefInternal>(1)(c), the arbitrator must select the final offer provided by the other party.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400490" lims:id="400490"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400491" lims:id="400491">Contractual language</MarginalNote><Label>(4)</Label><Text>The arbitrator’s decision must be drafted in a manner that constitutes a new collective agreement between the employer and the union and, to the extent that it is possible, incorporate the contractual language that is referred to in paragraph <XRefInternal>13</XRefInternal>(1)(a) and that is in the final offer selected by the arbitrator.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400492" lims:id="400492"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400493" lims:id="400493">Proceedings prohibited</MarginalNote><Label>15</Label><Text>No order is to be made, no process is to be entered into and no proceeding is to be taken in court</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400494" lims:id="400494"><Label>(a)</Label><Text>to question the appointment of the arbitrator; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400495" lims:id="400495"><Label>(b)</Label><Text>to review, prohibit or restrain any proceeding or decision of the arbitrator.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400496" lims:id="400496"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400497" lims:id="400497">New collective agreement not precluded</MarginalNote><Label>16</Label><Text>Nothing in this Part precludes the employer and the union from entering into a new collective agreement at any time before the arbitrator makes a decision and, if they do so, the arbitrator’s duties under this Part cease as of the day on which the new collective agreement is entered into.</Text></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400498" lims:id="400498" level="2"><TitleText>New Collective Agreement</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400499" lims:id="400499"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400500" lims:id="400500">New collective agreement</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400501" lims:id="400501"><Label>(1)</Label><Text>Despite anything in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, the arbitrator’s decision constitutes a new collective agreement between the employer and the union that is effective and binding on the parties beginning on the day on which it is made. and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400522" lims:id="400522"><Label>(b)</Label><Text>every employee must, when so required, continue, or resume without delay, as the case may be, the duties of their employment.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400523" lims:id="400523"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400524" lims:id="400524">Prohibitions</MarginalNote><Label>22</Label><Text>It is prohibited for the employer and for any officer or representative of the employer to</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400525" lims:id="400525"><Label>(a)</Label><Text>in any manner impede any employee from complying with paragraph <XRefInternal>21</XRefInternal>(b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400526" lims:id="400526"><Label>(b)</Label><Text>discharge or in any other manner discipline, or authorize or direct the discharge or discipline of, any employee by reason of the employee having been on strike before the coming into force of this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400527" lims:id="400527"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400528" lims:id="400528">Obligations</MarginalNote><Label>23</Label><Text>The union and each officer and representative of the union must</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400529" lims:id="400529"><Label>(a)</Label><Text>without delay on the coming into force of this Act, give notice to the employees that, by reason of that coming into force, air service operations are to be continued or resumed, as the case may be, and that the employees, when so required, are to continue, or resume without delay, as the case may be, the duties of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400530" lims:id="400530"><Label>(b)</Label><Text>take all reasonable steps to ensure that employees comply with paragraph <XRefInternal>21</XRefInternal>(b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400531" lims:id="400531"><Label>(c)</Label><Text>refrain from any conduct that may encourage employees not to comply with paragraph <XRefInternal>21</XRefInternal>(b).</Text></Paragraph></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400532" lims:id="400532" level="2"><TitleText>Extension of Collective Agreement</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400533" lims:id="400533"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400534" lims:id="400534">Extension</MarginalNote><Label>24</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400535" lims:id="400535"><Label>(1)</Label><Text>The term of the collective agreement is extended to include the period beginning on April 1, 2011 and ending on the day on which a new collective agreement between the employer and the union comes into effect.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400536" lims:id="400536"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400537" lims:id="400537">Collective agreement binding for extended term</MarginalNote><Label>(2)</Label><Text>Despite anything in the collective agreement or in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, the collective agreement, as extended by subsection (1), is effective and binding on the parties to it for the period for which it is extended. However, that Part applies in respect of the collective agreement, as extended, as if that period were the term of the collective agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400538" lims:id="400538"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400539" lims:id="400539">Strikes and lockouts prohibited</MarginalNote><Label>25</Label><Text>Until the day on which the collective agreement, as extended by subsection <XRefInternal>24</XRefInternal>(1), expires, it is prohibited</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400540" lims:id="400540"><Label>(a)</Label><Text>for the employer and for any officer or representative of the employer to declare or cause a lockout against the union;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400541" lims:id="400541"><Label>(b)</Label><Text>for the union and for any officer or representative of the union to declare or authorize a strike against the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400562" lims:id="400562"><Label>(d)</Label><Text>make a decision in respect of the resolution of the matters referred to in this subsection and forward a copy of the decision to the Minister, the employer and the union.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400563" lims:id="400563"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400564" lims:id="400564">Guiding principle</MarginalNote><Label>(2)</Label><Text>In making the selection of a final offer, the arbitrator is to be guided by the need for terms and conditions of employment that are consistent with those in other airlines and that will provide the necessary degree of flexibility to ensure</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400565" lims:id="400565"><Label>(a)</Label><Text>the short-and long-term economic viability and competitiveness of the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400566" lims:id="400566"><Label>(b)</Label><Text>the sustainability of the employer’s pension plan, taking into account any short-term funding pressures on the employer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400567" lims:id="400567"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400568" lims:id="400568">If no final offer submitted</MarginalNote><Label>(3)</Label><Text>If either the employer or the union fails to provide the arbitrator with a final offer in accordance with paragraph <XRefInternal>28</XRefInternal>(1)(c), the arbitrator must select the final offer provided by the other party.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400569" lims:id="400569"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400570" lims:id="400570">Contractual language</MarginalNote><Label>(4)</Label><Text>The arbitrator’s decision must be drafted in a manner that constitutes a new collective agreement between the employer and the union and, to the extent that it is possible, incorporate the contractual language that is referred to in paragraph <XRefInternal>28</XRefInternal>(1)(a) and that is in the final offer selected by the arbitrator.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400571" lims:id="400571"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400572" lims:id="400572">Proceedings prohibited</MarginalNote><Label>30</Label><Text>No order is to be made, no process is to be entered into and no proceeding is to be taken in court</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400573" lims:id="400573"><Label>(a)</Label><Text>to question the appointment of the arbitrator; However, that Part applies in respect of the new collective agreement as if it had been entered into under that Part.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400581" lims:id="400581"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400582" lims:id="400582">Coming into effect of provisions</MarginalNote><Label>(2)</Label><Text>The new collective agreement may provide that any of its provisions are effective and binding on a day that is before or after the day on which the new collective agreement becomes effective and binding.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400583" lims:id="400583"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400584" lims:id="400584">Amendments</MarginalNote><Label>(3)</Label><Text>Nothing in this Part is to be construed so as to limit or restrict the rights of the parties to agree to amend any provision of the new collective agreement, other than a provision relating to its term, and to give effect to the amendment.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400585" lims:id="400585" level="1"><Label>PART 3</Label><TitleText>General</TitleText></Heading><Heading lims:inforce-start-date="2012-03-15" lims:fid="400586" lims:id="400586" level="2"><TitleText>Costs</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400587" lims:id="400587"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400588" lims:id="400588">Costs</MarginalNote><Label>33</Label><Text>All costs incurred by Her Majesty in right of Canada relating to the appointment of an arbitrator and the performance of an arbitrator’s duties under this Act are debts due to Her Majesty in right of Canada and may be recovered as such, in any court of competent jurisdiction, in equal parts from, in the case of an appointment under Part 1, the International Association of Machinists and Aerospace Workers and the employer, and in the case of an appointment under Part 2, the Air Canada Pilots Association and the employer.</Text></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400589" lims:id="400589" level="2"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400590" lims:id="400590"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400591" lims:id="400591">Individuals</MarginalNote><Label>34</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400592" lims:id="400592"><Label>(1)</Label><Text>An individual who contravenes any provision of this Act is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400593" lims:id="400593"><Label>(a)</Label><Text>not more than $50,000 if the individual was acting in the capacity of an officer or representative of the employer, the International Association of Machinists and Aerospace Workers or the Air Canada Pilots Association when the offence was committed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="400594" lims:id="400594"><Label>(b)</Label><Text>not more than $1,000 in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="400595" lims:id="400595"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400596" lims:id="400596">Employer or union</MarginalNote><Label>(2)</Label><Text>If the employer, the International Association of Machinists and Aerospace Workers or the Air Canada Pilots Association contravenes any provision of this Act, it is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of not more than $100,000.</Text></Subsection></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400597" lims:id="400597"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400598" lims:id="400598">No imprisonment</MarginalNote><Label>35</Label><Text>Despite subsection 787(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, no term of imprisonment is to be imposed in default of payment of a fine that is imposed under section <XRefInternal>34</XRefInternal>.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400599" lims:id="400599"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400600" lims:id="400600">Recovery of fines</MarginalNote><Label>36</Label><Text>If a person is convicted of an offence under section <XRefInternal>34</XRefInternal> and the fine that is imposed is not paid when required, the prosecutor may, by filing the conviction, enter as a judgment the amount of the fine and costs, if any, in a superior court of the province in which the trial was held, and the judgment is enforceable against the person in the same manner as if it were a judgment rendered against the person in that court in civil proceedings.</Text></Section><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="400601" lims:id="400601"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="400602" lims:id="400602">Presumption</MarginalNote><Label>37</Label><Text>For the purposes of this Act, the International Association of Machinists and Aerospace Workers and the Air Canada Pilots Association are deemed to be persons.</Text></Section><Heading lims:inforce-start-date="2012-03-15" lims:fid="400603" lims:id="400603" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2012-03-15" lims:lastAmendedDate="2012-03-15" lims:fid="400604" lims:id="400604"><MarginalNote lims:inforce-start-date="2012-03-15" lims:fid="400605" lims:id="400605">Coming into force</MarginalNote><Label><FootnoteRef idref="fn_Ind9E14_hq_12130">*</FootnoteRef>38</Label><Text>This Act comes into force on the expiry of the twenty-fourth hour after the time at which it is assented to.</Text><Footnote id="fn_Ind9E14_hq_12130" placement="section" status="editorial"><Label>*</Label><Text>[Note: Act in force March 16, 2012.]</Text></Footnote></Section></Body></Statute>
