(<DefinedTermFr>facteur de bioaccumulation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="655340" lims:id="655340" generate-in-text="no"><Text><DefinedTermEn>bioconcentration factor</DefinedTermEn> means the ratio of the concentration of a substance in an organism to the concentration in water, based only on uptake from the surrounding medium. (<DefinedTermFr>facteur de bioconcentration</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="655341" lims:id="655341" generate-in-text="no"><Text><DefinedTermEn>half-life</DefinedTermEn> means the period it takes the concentration of a substance to be reduced by half, by transformation, in a medium. (<DefinedTermFr>demi-vie</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="655342" lims:id="655342" generate-in-text="no"><Text><DefinedTermEn>octanol-water partition coefficient</DefinedTermEn> means the ratio of the concentration of a substance in an octanol phase to the concentration of the substance in the water phase of an octanol-water mixture. (<DefinedTermFr>coefficient de partage octanol-eau</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655343" lims:id="655343" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655344" lims:id="655344"><Label>2</Label><Text>These Regulations apply to any substance, other than a living organism within the meaning of Part 6 of the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655345" lims:id="655345" level="1"><TitleText>Persistence and Bioaccumulation Determination</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655346" lims:id="655346"><Label>3</Label><Text>A substance is persistent when it has at least one of the following characteristics:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655347" lims:id="655347"><Label>(a)</Label><Text>in air,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="655348" lims:id="655348"><Label>(i)</Label><Text>its half-life is equal to or greater than 2 days, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="655349" lims:id="655349"><Label>(ii)</Label><Text>it is subject to atmospheric transport from its source to a remote area;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655350" lims:id="655350"><Label>(b)</Label><Text>in water, its half-life is equal to or greater than 182 days;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655351" lims:id="655351"><Label>(c)</Label><Text>in sediments, its half-life is equal to or greater than 365 days; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655352" lims:id="655352"><Label>(d)</Label><Text>in soil, its half-life is equal to or greater than 182 days.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655353" lims:id="655353"><Label>4</Label><Text>A substance is bioaccumulative</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655354" lims:id="655354"><Label>(a)</Label><Text>when its bioaccumulation factor is equal to or greater than 5 000;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655355" lims:id="655355"><Label>(b)</Label><Text>if its bioaccumulation factor cannot be determined in accordance with a method referred to in section 5, when its bioconcentration factor is equal to or greater than 5 000; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="655356" lims:id="655356"><Label>(c)</Label><Text>if neither its bioaccumulation factor nor its bioconcentration factor can be determined in accordance with a method referred to in section 5, when the logarithm of its octanol-water partition coefficient is equal to or greater than 5.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655357" lims:id="655357"><Label>5</Label><Text>The determination of persistence and bioaccumulation with respect to a substance under sections 3 and 4 must be made in accordance with generally recognized methods of the Organisation for Economic Co-operation and Development (OECD) or of some other similar organisation or, if no such methods exist, in accordance with generally recognized methods within the scientific community and taking into account the intrinsic properties of the substance, the ecosystem under consideration and the conditions in the environment.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="655358" lims:id="655358" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="655359" lims:id="655359" type="transitional"><Label>6</Label><Text>These Regulations come into force on March 31, 2000.</Text></Section></Body></Regulation>
