list-item="no"><Text>Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of National Revenue, pursuant to section 11<FootnoteRef idref="footnotea_e">a</FootnoteRef>, subsection 11.1(3)<FootnoteRef idref="footnoteb_e">b</FootnoteRef> and paragraphs 164(1)(b)<FootnoteRef idref="footnotec_e">c</FootnoteRef>, (i)<FootnoteRef lims:id="704962">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2015-04-01" lims:fid="704963" lims:id="704963" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>. (<DefinedTermFr>Loi </DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704964" lims:id="704964" generate-in-text="no"><Text><DefinedTermEn>authorization</DefinedTermEn> means an authorization, issued by the Minister under section 11.1 of the Act, for a person to present themself in an alternative manner. (<DefinedTermFr>autorisation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704965" lims:id="704965" generate-in-text="no"><Text><DefinedTermEn>authorized person</DefinedTermEn> means a person to whom the Minister has issued an authorization. (<DefinedTermFr>personne autorisée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704966" lims:id="704966" generate-in-text="no"><Text><DefinedTermEn>commercial driver</DefinedTermEn> means a person who operates a commercial highway conveyance. (<DefinedTermFr>routier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704967" lims:id="704967" generate-in-text="no"><Text><DefinedTermEn>commercial goods</DefinedTermEn> means goods imported into Canada for sale or for any commercial, industrial, occupational, institutional or other like use. (<DefinedTermFr>marchandises commerciales</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704968" lims:id="704968" generate-in-text="no"><Text><DefinedTermEn>commercial highway conveyance</DefinedTermEn> means a conveyance designed for hauling freight on highways. (<DefinedTermFr>moyen de transport routier commercial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704969" lims:id="704969" generate-in-text="no"><Text><DefinedTermEn>commercial passenger conveyance</DefinedTermEn> means a conveyance that is used to carry passengers who have paid for passage. (<DefinedTermFr>moyen de transport commercial de passagers</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704970" lims:id="704970" generate-in-text="no"><Text><DefinedTermEn>common-law partner</DefinedTermEn> means, in relation to a person, an individual who has cohabited with the person in a conjugal relationship for a period of at least one year. (<DefinedTermFr>conjoint de fait</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704971" lims:id="704971" generate-in-text="no"><Text><DefinedTermEn>corporate aircraft</DefinedTermEn> means an aircraft that is used for purposes related to the business affairs of a person, that does not carry passengers who have paid for passage and that has aboard on its arrival in Canada no more than 15 persons, including the crew. (<DefinedTermFr>aéronef d’affaires</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704972" lims:id="704972" generate-in-text="no"><Text><DefinedTermEn>designated customs office</DefinedTermEn> means a customs office designated under section 5 of the Act as a customs office where a person may present themself pursuant to section 11 of the Act, or in an alternative manner if the person is so authorized. (<DefinedTermFr>bureau de douane établi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704973" lims:id="704973" generate-in-text="no"><Text><DefinedTermEn>designated holding area</DefinedTermEn> means an area designated by the President for the use of persons arriving in Canada who are in transit to another place in Canada or to a place outside Canada. (<DefinedTermFr>zone d’attente désignée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704974" lims:id="704974" generate-in-text="no"><Text><DefinedTermEn>family member</DefinedTermEn> means, in relation to a person who is serving as a member of the Canadian or American armed forces in a foreign country or at a Canadian or American diplomatic mission or consular post in a foreign country, a spouse, common-law partner or dependent who is identified as such in the document confirming the mission or post. (<DefinedTermFr>membre de la famille</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704975" lims:id="704975" generate-in-text="no"><Text><DefinedTermEn>marine pleasure craft</DefinedTermEn> means a vessel, however propelled, other than a seaplane or other similar conveyance, that is used exclusively for pleasure and that does not carry passengers who have paid for passage. (<DefinedTermFr>embarcation de plaisance</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704976" lims:id="704976" generate-in-text="no"><Text><DefinedTermEn>non-commercial passenger conveyance</DefinedTermEn> means a conveyance that does not carry passengers who have paid for passage, and includes corporate aircraft, private aircraft and marine pleasure craft. (<DefinedTermFr>moyen de transport non commercial de passagers</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704977" lims:id="704977" generate-in-text="no"><Text><DefinedTermEn>parent</DefinedTermEn> in respect of a child, means a parent who, by operation of law, by virtue of a written agreement or under a court order, has custody or parental authority over the child. (<DefinedTermFr>parent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704978" lims:id="704978" generate-in-text="no"><Text><DefinedTermEn>permanent resident of Canada</DefinedTermEn> means a permanent resident within the meaning of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>. (<DefinedTermFr>résident permanent du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-04-01" lims:fid="704979" lims:id="704979" generate-in-text="no"><Text><DefinedTermEn>private aircraft</DefinedTermEn> means an aircraft other than a corporate aircraft that does not carry passengers who have paid for passage and that has aboard on its arrival in Canada no more than 15 persons, including the crew. (<DefinedTermFr>aéronef privé</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-04-01" lims:fid="704981" lims:fid="704982" lims:id="704982" level="1"><Label>PART 1</Label><TitleText>Exceptions</TitleText></Heading><Heading lims:inforce-start-date="2008-01-31" lims:fid="704983" lims:id="704983" level="2"><TitleText>Exceptions to Presentation under Subsection 11(1) of the Act</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704984" lims:id="704984"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704985" lims:id="704985">Exception</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704986" lims:id="704986"><Label>(1)</Label><Text>Persons who arrive in Canada aboard a commercial passenger conveyance, who do not disembark in Canada and who have as their destination a place outside Canada are not required to present themselves in accordance with subsection 11(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704987" lims:id="704987"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704988" lims:id="704988">Circumstances and conditions</MarginalNote><Label>(2)</Label><Text>The following persons, in the following circumstances and conditions, are not required to present themselves in accordance with subsection 11(1) of the Act:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704989" lims:id="704989"><Label>(a)</Label><Text>persons who arrive in Canada aboard a commercial passenger conveyance if they do not disembark at the place of their arrival and have as their destination another place in Canada at which there is a designated customs office, and on arrival at their destination they present themselves without delay at that customs office or if the designated customs office is not open for business, at the nearest one that is open for business;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704990" lims:id="704990"><Label>(b)</Label><Text>persons who arrive in Canada aboard a commercial passenger conveyance if they are transferred under customs control from a designated holding area to another commercial passenger conveyance for departure</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="704991" lims:id="704991"><Label>(i)</Label><Text>to a place outside Canada and they do not leave the designated holding area except to board that other commercial passenger conveyance, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="704992" lims:id="704992"><Label>(ii)</Label><Text>to another place in Canada and at which there is a designated customs office, and on arrival at that place they present themselves without delay at that customs office or, if it is not open for business, at the nearest designated customs office that is open for business;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704993" lims:id="704993"><Label>(c)</Label><Text>persons arriving in Canada aboard a non-commercial passenger conveyance at a designated customs office where the person in charge of the conveyance may present themself and their passengers by radio or telephone, and the person informs an officer by radio or telephone of their arrival and, if required to do so by the officer, presents themself and their passengers at the time and place specified by the officer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704994" lims:id="704994"><Label>(d)</Label><Text>any crew member arriving in Canada aboard a freight train at a designated customs office where presentation may be done by radio or telephone, and the crew member informs an officer by radio or telephone of their arrival and, if required to do so by the officer, presents themself at the time and place specified by the officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="704995" lims:id="704995"><Label>(e)</Label><Text>any person entering Canadian waters, including the inland waters, or the airspace over Canada in circumstances in which none of paragraphs (a) to (d) applies, and who has as their destination a place in Canada at which there is a designated customs office, and on arrival at their destination they present themself without delay at that office.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="704996" lims:id="704996"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="704997" lims:id="704997">Condition — answer questions truthfully</MarginalNote><Label>(3)</Label><Text>For greater certainty, every person who presents themself in accordance with any of paragraphs (2)(a) to (e) is required to answer truthfully any questions asked by an officer in the performance of the officer’s duties under the Act or any other Act of Parliament.</Text></Subsection></Section><Heading lims:inforce-start-date="2008-01-31" lims:fid="704998" lims:id="704998" level="2"><TitleText>Exception to Subsection 11(3) of the Act</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="704999" lims:id="704999"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="705000" lims:id="705000">Commercial passenger conveyances</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="705001" lims:id="705001"><Label>(1)</Label><Text>The person in charge of a commercial passenger conveyance arriving in Canada is not required to ensure that the following persons, in the following circumstances and conditions, are forthwith on arrival transported to a customs office as required by subsection 11(3) of the Act:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705002" lims:id="705002"><Label>(a)</Label><Text>passengers and crew who do not disembark in Canada and who have as their destination a place outside Canada, if only passengers or goods that have come from a designated holding area are taken aboard the conveyance while it is in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705003" lims:id="705003"><Label>(b)</Label><Text>passengers and crew who do not disembark at the place of arrival in Canada and who have as their destination another place in Canada at which there is a designated customs office, if</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705004" lims:id="705004"><Label>(i)</Label><Text>only passengers or goods that have come from a designated holding area are taken aboard the conveyance while it is in Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705005" lims:id="705005"><Label>(ii)</Label><Text>on arrival at their destination the passengers and crew present themselves without delay at that customs office or, if it is not open for business, at the nearest designated customs office that is open for business;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705006" lims:id="705006"><Label>(c)</Label><Text>passengers and crew who are transferred under customs control to another commercial passenger conveyance for departure</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705007" lims:id="705007"><Label>(i)</Label><Text>to a place outside Canada and the passengers and crew comply with subparagraph 2(2)(b)(i); or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705008" lims:id="705008"><Label>(ii)</Label><Text>to another place in Canada at which there is a designated customs office, and the passengers and crew comply with subparagraph 2(2)(b)(ii); and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705009" lims:id="705009"><Label>(d)</Label><Text>passengers and crew who arrive at a designated customs office where persons may present themselves by radio or telephone, and the person in charge of the commercial passenger conveyance</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705010" lims:id="705010"><Label>(i)</Label><Text>notifies an officer by radio or telephone of the arrival of the conveyance and advises the officer of the number and names of the passengers and crew who disembark at the place, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="705011" lims:id="705011"><Label>(ii)</Label><Text>if required to do so by an officer, ensures that the passengers and crew who disembark at the place are transported at the time and to the place specified by the officer for the purpose of presenting themselves and answering truthfully any questions asked by an officer in accordance with subsection 11(1) of the Act.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="705012" lims:id="705012"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="705013" lims:id="705013">Freight trains</MarginalNote><Label>(2)</Label><Text>On the arrival in Canada of a freight train, the person in charge of it is not required to ensure that the crew members aboard it are forthwith transported to a customs office as is required by subsection 11(3) of the Act if those crew members arrive at a designated customs office where persons may present themselves by radio or telephone, and the person in charge of the freight train</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705014" lims:id="705014"><Label>(a)</Label><Text>notifies an officer by radio or telephone of the arrival of the train and advises the officer of the number and names of the crew members who disembark at the place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="705015" lims:id="705015"><Label>(b)</Label><Text>if required to do so by an officer, ensures that the crew members who disembark at the place are transported at the time and to the place specified by the officer for the purpose of presenting themselves and answering truthfully any questions asked by an officer in accordance with subsection 11(1) of the Act.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2008-01-31" lims:fid="705016" lims:id="705016" level="2"><TitleText>Advance Notification</TitleText></Heading><Section lims:inforce-start-date="2015-05-06" lims:lastAmendedDate="2015-05-06" lims:fid="705017" lims:id="705017"><MarginalNote lims:inforce-start-date="2015-05-06" lims:fid="705018" lims:id="705018">Information to be provided — non-commercial passenger conveyance</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2015-05-06" lims:fid="705019" lims:id="705019"><Label>(1)</Label><Text>The person in charge of a non-commercial passenger conveyance, other than a marine pleasure craft, that will arrive in Canada who intends to present themselves and all other persons on board the conveyance by telephone to an officer at a designated customs office is required under subsection 12.1(1) of the Act to give the Agency the conveyance’s scheduled time and place of arrival in Canada and, if it is different, the conveyance’s place of final destination in Canada and scheduled time of arrival at that destination.</Text></Subsection><Subsection lims:inforce-start-date="2015-05-06" lims:fid="705020" lims:id="705020"><MarginalNote lims:inforce-start-date="2015-05-06" lims:fid="705021" lims:id="705021">Time and manner of providing information</MarginalNote><Label>(1.1)</Label><Text>The person in charge of the conveyance shall give the information by telephone to an officer at a designated customs office at least two but no more than 48 hours before the conveyance arrives in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-05-06" lims:fid="705022" lims:id="705022"><MarginalNote lims:inforce-start-date="2015-05-06" lims:fid="705023" lims:id="705023">Information</MarginalNote><Label>(2)</Label><Text>If required by an officer, the person in charge of a non- commercial passenger conveyance shall</Text><Paragraph lims:inforce-start-date="2015-05-06" lims:fid="705024" lims:id="705024"><Label>(a)</Label><Text>provide any information relating to the other persons aboard the non-commercial passenger conveyance; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-06" lims:fid="705025" lims:id="705025"><Label>(b)</Label><Text>notify an officer of the arrival of the conveyance in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-05-06" lims:fid="705026" lims:id="705026"><MarginalNote lims:inforce-start-date="2015-05-06" lims:fid="705027" lims:id="705027">Change to information</MarginalNote><Label>(3)</Label><Text>A person in charge of a conveyance who gives information in the circumstances set out in this section shall, before the conveyance arrives in Canada, notify an officer at a designated customs office by telephone of any change to the information given unless there are emergency circumstances, in which case they shall notify an officer at a designated customs office of the change and the circumstances when the conveyance arrives in Alternative Manners</TitleText></Heading><Heading lims:inforce-start-date="2008-01-31" lims:fid="705031" lims:id="705031" level="2"><TitleText>Authorizations</TitleText></Heading><Section lims:inforce-start-date="2015-04-01" lims:lastAmendedDate="2015-04-01" lims:fid="705032" lims:id="705032"><MarginalNote lims:inforce-start-date="2015-04-01" lims:fid="705033" lims:id="705033">CANPASS Air program</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2015-04-01" lims:fid="705034" lims:id="705034"><Label>(1)</Label><Text>The Minister may issue an authorization to a person to present themself in an alternative manner described in paragraph 11(a) if the person</Text><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705035" lims:id="705035"><Label>(a)</Label><Text>is</Text><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705036" lims:id="705036"><Label>(i)</Label><Text>a citizen or permanent resident of Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705037" lims:id="705037"><Label>(ii)</Label><Text>a citizen or permanent resident of the United States, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705038" lims:id="705038"><Label>(iii)</Label><Text>a citizen of another country and the following conditions are met:</Text><Clause lims:inforce-start-date="2015-04-01" lims:fid="705039" lims:id="705039"><Label>(A)</Label><Text>the person is a member of a program in that country that allows for an alternative manner of presentation to facilitate or expedite entry into that country, and</Text></Clause><Clause lims:inforce-start-date="2015-04-01" lims:fid="705040" lims:id="705040"><Label>(B)</Label><Text>Canada has a reciprocal arrangement with that country, entered into under paragraph 13(2)(a) of the <XRefExternal reference-type="act" link="C-1.4">Canada Border Services Agency Act</XRefExternal>, in respect of the alternative manner of presentation;</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705041" lims:id="705041"><Label>(b)</Label><Text>is of good character;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705042" lims:id="705042"><Label>(c)</Label><Text>is not inadmissible to Canada under the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal> or its regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705043" lims:id="705043"><Label>(d)</Label><Text>provides their consent in writing to the use by the Minister of biometric data concerning the person for the purposes set out in section 6.3;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705044" lims:id="705044"><Label>(e)</Label><Text>has provided true, accurate and complete information in respect of their application for the authorization; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="705045" lims:id="705045"><Label>(f)</Label><Text>subject to subsection (2), has resided only in one or more of the following countries during the three-year period before the day on which the application was received and until the day on which the authorization is issued:</Text><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705046" lims:id="705046"><Label>(i)</Label><Text>Canada or the United States,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705047" lims:id="705047"><Label>(ii)</Label><Text>if the person is serving as a member of the American armed forces in a foreign country, that foreign country,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705048" lims:id="705048"><Label>(iii)</Label><Text>if the person is a family member of a person who is a member of the Canadian or American armed forces serving in a foreign country, that foreign country, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-04-01" lims:fid="705049" lims:id="705049"><Label>(iv)</Label><Text>if the person is a family member of a person who is serving at a Canadian or American diplomatic mission or consular post in a foreign country, that foreign lims:fid="705091" lims:id="705091"><Label>(d)</Label><Text>is 18 years of age or older; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-01-31" lims:fid="705092" who is not an individual may apply for an authorization on behalf of an employee, contractor, consultant or other business associate of that person if the person conducts business in Canada or the United States and uses corporate aircraft to carry passengers into Canada for purposes related to its business.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="705125"><Label>(1)</Label><Text>A person in charge of a corporate aircraft may apply by telephone to an officer at a designated customs office for the issuance of an authorization on behalf of an individual who is or is expected to be aboard a corporate aircraft that is to arrive in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705126" lims:id="705126"><MarginalNote lims:inforce-start-date="2006-06-23" lims:fid="705127" lims:id="705127">Application</MarginalNote><Label>(2)</Label><Text>An application under subsection (1) shall include, if available, the individual’s name, date of birth, citizenship and place of residence.</Text></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705128" lims:id="705128"><MarginalNote lims:inforce-start-date="2006-06-23" lims:fid="705129" lims:id="705129">Issue</MarginalNote><Label>(3)</Label><Text>The Minister may issue an authorization to an individual described in subsection (1) if all of the following conditions are met:</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705130" lims:id="705130"><Label>(a)</Label><Text>the individual meets the requirements set out in paragraphs 6(a) to (e);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705131" lims:id="705131"><Label>(a.1)</Label><Text>the individual is an employee, contractor, consultant or other business associate of the corporation that is using the aircraft and is travelling for purposes related to the business of the corporation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705132" lims:id="705132"><Label>(b)</Label><Text>the person in charge of the corporate aircraft has not applied on behalf of more than four individuals;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705133" lims:id="705133"><Label>(c)</Label><Text>the person in charge of a corporate aircraft confirms to the Minister that the individual on whose behalf the application is made is aboard the aircraft and provided, at that time, the information described in subsection (2) if it had not been given previously; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705134" lims:id="705134"><Label>(d)</Label><Text>the individual is accompanied on the corporate aircraft by another person who is authorized to present themself by means of the person in charge of the corporate aircraft.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705135" lims:id="705135"><MarginalNote lims:inforce-start-date="2006-06-23" lims:fid="705136" lims:id="705136">No issue after arrival</MarginalNote><Label>(4)</Label><Text>No authorization may be issued after an aircraft has arrived in Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem private aircraft at a public airport that is a designated customs office, by means of the person in charge of the aircraft if that person presents themself and those persons aboard by telephone to an officer at a designated customs office and all persons aboard the aircraft are authorized to present themselves in that manner;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-01-31" lims:fid="705158" lims:id="705158"><Label>(c)</Label><Text>on arrival in Canada aboard a corporate aircraft at a public airport that is a designated customs office, by means of the person in charge of the aircraft, if that person presents themself and those persons aboard by telephone to an officer at a designated customs office and all persons aboard the aircraft are authorized to present themselves in that manner;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-01-31" lims:fid="705159" lims:id="705159"><Label>(d)</Label><Text>on arrival in Canada at a land border crossing,</Text><Subparagraph lims:inforce-start-date="2008-01-31" lims:fid="705160" lims:id="705160"><Label>(i)</Label><Text>if they are commercial drivers who are operating or aboard a commercial highway conveyance, by means of an electronic device at a designated customs office,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-01-31" lims:fid="705161" subsection 12.1(1) of the Act to give the Agency the marine pleasure craft’s scheduled time and place of arrival in Canada and, if it is different, the marine pleasure craft’s final place of lims:id="705237"><Label>(b)</Label><Text>has contravened the Act, the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal>, the <XRefExternal reference-type="act" link="E-19">Export and Import Permits Act</XRefExternal> or the <XRefExternal reference-type="act" link="S-15">Special Import Measures Act</XRefExternal>, or any regulations made under any of those Acts; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705238" lims:id="705238"><Label>(c)</Label><Text>has provided information that was not true, accurate or complete for the purposes of obtaining an authorization.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705239" lims:id="705239"><Label>(2)</Label><Text><Repealed>[Repealed, SOR/2006-154, s. 15]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705240" lims:id="705240"><MarginalNote lims:inforce-start-date="2006-06-23" lims:fid="705241" lims:id="705241">Notice of suspension or cancellation</MarginalNote><Label>(3)</Label><Text>Immediately after cancelling or suspending an authorization of a person, the Minister shall send written notice of, and the reasons for, the cancellation or suspension to the person at their latest known address.</Text></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705242" lims:id="705242"><MarginalNote lims:inforce-start-date="2006-06-23" lims:fid="705243" lims:id="705243">Return of authorization</MarginalNote><Label>(4)</Label><Text>A person whose authorization is cancelled or suspended shall</Text><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705244" lims:id="705244"><Label>(a)</Label><Text>on receiving a notice under subsection (3), immediately and in accordance with it, return to the Minister the written authorization and any other thing relevant to the authorization that is specified in the notice; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-06-23" lims:fid="705245" lims:id="705245"><Label>(b)</Label><Text>on being advised of the suspension or cancellation in person by an officer, immediately return to the officer the written authorization and any other thing relevant to it that is specified by the officer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-06-23" lims:fid="705246" lims:id="705246"><MarginalNote authorization becomes effective on the earlier of the day on which an officer advises in person of the suspension or cancellation and 15 days after the day on which notice of the suspension or
