level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2019-04-01" lims:fid="716975" lims:id="716975"><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2018-04-01" lims:fid="716976" lims:id="716976" generate-in-text="no"><Text><DefinedTermEn>common-law partner</DefinedTermEn>, in relation to an individual, means a person who is cohabiting with the individual in a conjugal relationship at the time of the individual’s death, having so cohabited for a period of at least one year. (<DefinedTermFr>conjoint de fait</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716977" lims:id="716977" generate-in-text="no"><Text><DefinedTermEn>Corporation</DefinedTermEn> means the corporation incorporated under the name Last Post Fund, on June 22, 1921, under the <XRefExternal reference-type="act">Companies Act</XRefExternal>. (<DefinedTermFr>société</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716978" lims:id="716978" generate-in-text="no"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Veterans Affairs. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716979" lims:id="716979" generate-in-text="no"><Text><DefinedTermEn>dependent child</DefinedTermEn> means a dependent child as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>. (<DefinedTermFr>enfant à charge</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="716980" lims:id="1121892"><Text><DefinedTermEn>entitled to a disability award</DefinedTermEn> means, in respect of a person, that the person</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121893" lims:id="1121893"><Label>(a)</Label><Text>has received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121894" lims:id="1121894"><Label>(b)</Label><Text>has not received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of that Act because one of the conditions set out in section 53 of that Act, as it read immediately before April 1, 2019, had not been met as of that day, unless a decision regarding the application for pain and suffering compensation referred to in subsection 174(1) of that Act has been made; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121895" lims:id="1121895"><Label>(c)</Label><Text>but for subsection 54(1) of that Act as it read immediately before April 1, 2019, would have received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of that Act. (<DefinedTermFr>droit à une indemnité d’invalidité</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716984" lims:id="716984" generate-in-text="no"><Text><DefinedTermEn>entitled to a pension</DefinedTermEn>, in respect of a deceased person, means that, at the time of death, the person was receiving a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> or had received a final payment of a pension, or that the Minister had determined that the person was entitled to a pension. (<DefinedTermFr>droit à une pension</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121896" lims:id="1121896"><Text><DefinedTermEn>entitled to pain and suffering compensation</DefinedTermEn> means, in respect of a person, that the person</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121897" lims:id="1121897"><Label>(a)</Label><Text>has received pain and suffering compensation under subsection 45(1) or 47(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121898" lims:id="1121898"><Label>(b)</Label><Text>is referred to in subsection 45(1) of that Act but whose extent of disability has not yet been assessed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121899" lims:id="1121899"><Label>(c)</Label><Text>but for subsection 56.4(1) of that Act, would have received pain and suffering compensation under subsection 45(1) or 47(1) of that Act. (<DefinedTermFr>droit à une indemnité pour douleur et souffrance</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716985" lims:id="716985" generate-in-text="no"><Text><DefinedTermEn>income-qualified civilian</DefinedTermEn> means a civilian as defined in subsection 56(1) of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal> who</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716986" lims:id="716986"><Label>(a)</Label><Text>was at the time of death in receipt of an allowance under subsection 57(1) of that Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716987" lims:id="716987"><Label>(b)</Label><Text>would have been eligible at the time of death for an allowance under that subsection were it not for payments made to the civilian or the civilian’s spouse or common-law partner, or for which the civilian or the civilian’s spouse or common-law partner was eligible under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or similar legislation of another country. (<DefinedTermFr>civil au revenu admissible</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716988" lims:id="716988" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Veterans Affairs. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716989" lims:id="716989" generate-in-text="no"><Text><DefinedTermEn>net assets of the succession</DefinedTermEn> means the net value of the portion of succession to a deceased person’s estate that, in accordance with the laws of the country or the province in which the person was domiciled at the time of death, can be transferred to the heirs by way of bequest or inheritance after the payment of all debts owed by the person or the estate, including the costs of the following: the deceased person’s last sickness, funeral, burial, cremation and gravemarker. (<DefinedTermFr>actif net successoral</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716990" lims:id="716990" generate-in-text="no"><Text><DefinedTermEn>net assets of the survivor</DefinedTermEn> means the net worth of the survivor. (<DefinedTermFr>actif net du survivant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716991" lims:id="716991" generate-in-text="no"><Text><DefinedTermEn>overseas service civilian</DefinedTermEn> means a person referred to in paragraphs (e) to (i) of the definition <DefinitionRef>civilian</DefinitionRef> in subsection 56(1) of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>. (<DefinedTermFr>civil ayant servi outre-mer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716992" lims:id="716992" generate-in-text="no"><Text><DefinedTermEn>pensioned condition</DefinedTermEn> means a disability in respect of which a person is entitled to a pension. (<DefinedTermFr>état indemnisé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="716993" lims:id="716993" generate-in-text="no"><Text><DefinedTermEn>pensioner</DefinedTermEn> means a person who at the time of death was entitled to a pension in respect of a disability payable under, or because of,</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716994" lims:id="716994"><Label>(a)</Label><Text>the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, including a supplementary pension under section 64, 65 or 66 of that Act, but not including a pension that is awarded under subsection 22(2) of that Act or continued under subsection 83(4) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716995" lims:id="716995"><Label>(b)</Label><Text>any of Parts I to III and VI to X of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716996" lims:id="716996"><Label>(c)</Label><Text>paragraph 3(c) of the <XRefExternal reference-type="act">Special Operators War Service Benefits Act</XRefExternal>, R.S.C. 1952, c. 256;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716997" lims:id="716997"><Label>(d)</Label><Text>paragraphs 3(d) and (e) of the <XRefExternal reference-type="act" link="W-11.4">Women’s Royal Naval Services and the South African Military Nursing Service (Benefits) Act</XRefExternal>, R.S.C. 1952, c. 297;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716998" lims:id="716998"><Label>(e)</Label><Text>Veterans Affairs Vote 815 of Schedule C to <XRefExternal reference-type="act">The Appropriation Act, No. 4, 1950</XRefExternal>, S.C. 1950, c. 55 or any other provision enacted by Parliament for the continuation of certain Newfoundland pensions that were not payable under the terms of the union of Canada and Newfoundland; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="716999" lims:id="716999"><Label>(f)</Label><Text>the <XRefExternal reference-type="regulation">Civilian Government Employees (War) Compensation Order</XRefExternal>. (<DefinedTermFr>pensionné</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="717000" lims:id="717000" generate-in-text="no"><Text><DefinedTermEn>survivor</DefinedTermEn> means a survivor as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>. (<DefinedTermFr>survivant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="717001" lims:id="717001" generate-in-text="no"><Text><DefinedTermEn>veteran</DefinedTermEn> means one of the following persons:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717002" lims:id="717002"><Label>(a)</Label><Text>a former member of the Canadian Forces or any predecessor naval, army or air forces of Canada or Newfoundland;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717003" lims:id="717003"><Label>(b)</Label><Text>a Canadian merchant mariner of World War I or World War II within the meaning of subsection 21.1(3) or (4), respectively, of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717004" lims:id="717004"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2014-74, s. 1]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717005" lims:id="717005"><Label>(d)</Label><Text>a Canadian merchant mariner of the Korean War within the meaning of subsection 21.1(5) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717006" lims:id="717006"><Label>(e)</Label><Text>a special operator who is deemed to be a veteran under paragraph 3(a) of the <XRefExternal reference-type="act">Special Operators War Service Benefits Act</XRefExternal>, R.S.C. 1952, c. 256;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717007" lims:id="717007"><Label>(f)</Label><Text>a supervisor who is deemed to be a veteran under paragraph 3(a) of the <XRefExternal reference-type="act">Supervisors War Service Benefits Act</XRefExternal>, R.S.C. 1952, c. 258;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717008" lims:id="717008"><Label>(g)</Label><Text>a person who is deemed to be a veteran under section 3 of the <XRefExternal reference-type="act" link="W-11.4">Women’s Royal Naval Services and the South African Military Nursing Service (Benefits) Act</XRefExternal>, R.S.C. 1952, c. 297;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717009" lims:id="717009"><Label>(h)</Label><Text>a person on whom the benefits of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> may be conferred under section 64, 65 or 66 of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717010" lims:id="717010"><Label>(i)</Label><Text>a person who, as a member of His Majesty’s naval, army or air forces or of similar forces allied with His Majesty, served on active service during World War I or World War II and was resident in Canada at the time he or she became a member of those forces; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717011" lims:id="717011"><Label>(j)</Label><Text>an allied veteran within the meaning of subsection 37(4), (4.1) or (4.2) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>. (<DefinedTermFr>ancien combattant</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="717012" lims:id="717012" generate-in-text="no"><Text><DefinedTermEn>World War I</DefinedTermEn> has the meaning assigned in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>. (<DefinedTermFr>Première Guerre mondiale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="717013" lims:id="717013" generate-in-text="no"><Text><DefinedTermEn>World War II</DefinedTermEn> has the meaning assigned in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>. (<DefinedTermFr>Seconde Guerre mondiale</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="717016" lims:id="717016" level="1"><Label>PART 1</Label><TitleText>Financial Assistance</TitleText></Heading><Heading lims:inforce-start-date="2016-10-01" lims:fid="717017" lims:id="717017" level="2"><TitleText>Eligibility for Financial Assistance</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2019-04-01" lims:fid="717018" lims:id="717018"><Label>2</Label><Text>Financial assistance towards last sickness, funeral, burial and cremation costs in accordance with section 3 is payable</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717019" lims:id="717019"><Label>(a)</Label><Text>if there is an insufficiency of funds, as determined under section 4, for the following deceased persons, namely,</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717020" lims:id="717020"><Label>(i)</Label><Text>a pensioner who dies in Canada or elsewhere,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717021" lims:id="717021"><Label>(ii)</Label><Text>a veteran or an income-qualified civilian or an overseas service civilian who dies in Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717022" lims:id="717022"><Label>(iii)</Label><Text>a veteran who is buried or cremated in Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717023" lims:id="717023"><Label>(iv)</Label><Text>a veteran referred to in any of paragraphs (a) to (g) of the definition <DefinitionRef>veteran</DefinitionRef> in section 1 who dies outside Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717024" lims:id="717024"><Label>(v)</Label><Text>an overseas service civilian who dies outside Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717025" lims:id="717025"><Label>(vi)</Label><Text>a veteran or a civilian who dies outside Canada and on the date of death was undergoing a medical examination required by the Minister or by the Veterans Review and Appeal Board;</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717026" lims:id="717026"><Label>(vii) and (viii)</Label><Text><Repealed>[Repealed, SOR/2014-74, s. 2]</Repealed></Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="717027" lims:id="717027"><Label>(b)</Label><Text>in Canada or elsewhere, for the following deceased persons, namely,</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717028" lims:id="717028"><Label>(i)</Label><Text>a pensioner, referred to in any of paragraphs (b) to (f) of the definition of <DefinitionRef>pensioner</DefinitionRef> in section 1, whose death was as a result of an injury or disease or an aggravation of an injury or disease that was attributable to or was incurred during the pensioner’s service,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717029" lims:id="717029"><Label>(ii)</Label><Text>a person in respect of whom a pension is awarded in accordance with paragraph 21(1)(b) or (2)(b) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717030" lims:id="717030"><Label>(iii)</Label><Text>a pensioner who on the date of death was receiving treatment benefits under Part I of the <XRefExternal reference-type="regulation" link="SOR-90-594">Veterans Health Care Regulations</XRefExternal> in respect of a period of acute care for a pensioned condition,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="717031" lims:id="1121901"><Label>(iii.1)</Label><Text>a person who, on the date of death, was receiving treatment benefits under Part I of the <XRefExternal reference-type="regulation" link="SOR-90-594">Veterans Health Care Regulations</XRefExternal> in respect of a period of acute care for a pensioned condition or for an injury or disease in respect of which they are entitled to a disability award or entitled to pain and suffering compensation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717032" lims:id="717032"><Label>(iv)</Label><Text>a person who, on the date of death, was undergoing a medical examination required by the Minister or by the Veterans Review and Appeal Board,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717033" lims:id="717033"><Label>(v)</Label><Text>a pensioner who on the date of death was in receipt of treatment benefits under Part I of the <XRefExternal reference-type="regulation" link="SOR-90-594">Veterans Health Care Regulations</XRefExternal> in respect of hospitalization for a condition in respect of which it is uncertain whether the condition was a pensioned condition, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="717034" lims:id="717034"><Label>(vi)</Label><Text>a person who dies as a result of a service-related injury or disease or a non-service-related injury or disease that was aggravated by service in accordance with the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="717036" lims:id="717036">SOR/2006-50, s. 85; SOR/2014-74, s. lims:inforce-start-date="2013-06-01" lims:fid="717039" lims:id="717039"><Label>(1)</Label><Text>Financial assistance is payable for the following costs:</Text><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717040" lims:id="717040"><Label>(a)</Label><Text>any medical costs of the deceased person’s last sickness that were not otherwise paid by the Minister and that are not insured under a private or provincial health care plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717041" lims:id="717041"><Label>(b)</Label><Text>the costs of the following funeral services:</Text><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717042" lims:id="717042"><Label>(i)</Label><Text>preparation of the remains,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717043" lims:id="717043"><Label>(ii)</Label><Text>provision of a casket that meets the standards specified by the Minister or provision of an urn,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717044" lims:id="717044"><Label>(iii)</Label><Text>provision of ceremonial services,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717045" lims:id="717045"><Label>(iv)</Label><Text>provision of death notices,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717046" lims:id="717046"><Label>(v)</Label><Text>transportation of the remains from the place where the death occurred to a funeral home and to a place of burial or cremation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717047" lims:id="717047"><Label>(vi)</Label><Text>transportation of the remains that requires the services of two funeral homes because the funeral home or place of burial or cremation are not in the same locality as the place where the death occurred;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717048" lims:id="717048"><Label>(c)</Label><Text>if necessary, the cost of any special preparation of the remains for viewing;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717049" lims:id="717049"><Label>(d)</Label><Text>if required, the cost of providing a single grave and reasonable costs of opening and closing the grave and its perpetual care;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717050" lims:id="717050"><Label>(e)</Label><Text>if a grave liner is required by the authorities of the cemetery, municipality or province, the cost of a decomposable or non-decomposable grave liner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717051" lims:id="717051"><Label>(f)</Label><Text>the cost of cremating the remains.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-06-01" lims:fid="717052" lims:id="717052"><Label>(2)</Label><Text>The amount of financial assistance is the least of</Text><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717053" lims:id="717053"><Label>(a)</Label><Text>the aggregate of the amounts for the costs described in subsection (1), adding any goods and services tax, harmonized sales tax or provincial sales tax. In this aggregate amount the costs, before tax, do not exceed</Text><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717054" lims:id="717054"><Label>(i)</Label><Text>in respect of the costs referred to in paragraph (1)(a), $75,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717055" lims:id="717055"><Label>(ii)</Label><Text>in respect of the costs referred to in subparagraphs (1)(b)(i) to (v), $7,376,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717056" lims:id="717056"><Label>(iii)</Label><Text>in respect of the cost referred to in subparagraph (1)(b)(vi), $500,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717057" lims:id="717057"><Label>(iv)</Label><Text>in respect of the cost of any special preparation of the remains under paragraph (1)(c), $210,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717058" lims:id="717058"><Label>(v)</Label><Text>in respect of the cost of a decomposable grave liner under paragraph (1)(e), $200, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-06-01" lims:fid="717059" lims:id="717059"><Label>(vi)</Label><Text>in respect of the cost of a non-decomposable grave liner under paragraph (1)(e), $570;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-06-01" lims:fid="717060" lims:id="717060"><Label>(b)</Label><Text>in the cases described in paragraph 2(a), the amount of any insufficiency of funds, determined under section 4.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-06-01" lims:fid="717061" lims:id="717061"><Label>(3)</Label><Text>Despite paragraph (2)(a), an additional amount may be paid to cover the difference between the cost of a normal casket and the cost of an oversized casket or a hermetically sealed one.</Text></Subsection><Subsection lims:inforce-start-date="2013-06-01" lims:fid="717062" lims:id="717062"><Label>(4)</Label><Text>Financial assistance is payable only if no similar payment has been made by the Government of Canada in respect of the same deceased person.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-06-01" lims:fid="717064" lims:id="717064">SOR/2013-110, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717065" lims:id="717065" level="2"><TitleText>Determination of Insufficiency of Funds</TitleText></Heading><Section lims:inforce-start-date="2016-10-01" lims:lastAmendedDate="2016-10-01" lims:fid="717066" lims:id="717066"><Label>4</Label><Subsection lims:inforce-start-date="2016-10-01" lims:fid="717067" lims:id="717067"><Label>(1)</Label><Text>A determination in respect of an insufficiency of funds to meet costs, for the purpose of the provision of financial assistance, must be made by the Corporation as follows:</Text><Paragraph lims:inforce-start-date="2016-10-01" lims:fid="717068" lims:id="717068"><Label>(a)</Label><Text>if the deceased person has a survivor or a dependent child, the following amounts are deducted from the sum of the net assets of the survivor and the net assets of the succession, namely,</Text><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717069" lims:id="717069"><Label>(i)</Label><Text>$35,279 for the survivor or, if there is no survivor, for the dependent child,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717070" lims:id="717070"><Label>(ii)</Label><Text>$700 for each additional dependent child,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717071" lims:id="717071"><Label>(iii)</Label><Text>the aggregate of the amounts under paragraphs 3(2)(a) minus any amount already paid for the costs set out in subsection 3(1), if these amounts have not already been considered in the determination of the net assets of the succession,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717072" lims:id="717072"><Label>(iv)</Label><Text>if a gravemarker is not provided under section 5,</Text><Clause lims:inforce-start-date="2016-10-01" lims:fid="717073" lims:id="717073"><Label>(A)</Label><Text>the lesser of the actual cost of a gravemarker and the value of the gravemarker that would have been provided under that section minus the amount already paid for the gravemarker, if this amount has not already been considered in the determination of the net assets of the succession, and</Text></Clause><Clause lims:inforce-start-date="2016-10-01" lims:fid="717074" lims:id="717074"><Label>(B)</Label><Text>a reasonable amount for the perpetual care of the gravemarker, if this amount has not already been considered in the determination of the net assets of the succession,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717075" lims:id="717075"><Label>(v)</Label><Text>an amount equal to the person’s monthly income before their death,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717076" lims:id="717076"><Label>(vi)</Label><Text>if applicable, an amount equal to the market value of a motor vehicle that is ordinarily used by the deceased person’s family as a mode of transportation and that is chosen by the person making the application for financial assistance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717077" lims:id="717077"><Label>(vii)</Label><Text>if applicable, an amount equal to the market value of the residence where the deceased person’s family lives, as chosen by the person making the application for financial assistance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-10-01" lims:fid="717078" lims:id="717078"><Label>(viii)</Label><Text>an amount equal to the market value of the household effects of the deceased person’s family; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-10-01" lims:fid="717079" lims:id="717079"><Label>(b)</Label><Text>if the deceased person does not have a survivor or dependent children, the deductible amounts described in paragraph (a) do not apply, and the net assets of the succession as a whole are to be taken into consideration.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-10-01" lims:fid="717080" lims:id="717080"><Label>(2)</Label><Text>If the amount determined under paragraph (1)(a) or (b) is nil or negative, there is an insufficiency of funds.</Text></Subsection><Subsection lims:inforce-start-date="2016-10-01" lims:fid="717081" lims:id="717081"><Label>(3)</Label><Text>The amount set out in subparagraph 4(1)(a)(i) is to be adjusted on January 1 of each year in accordance with the percentage increase to the Consumer Price Index for the year ending on September 30 of the previous year.</Text></Subsection><Subsection lims:inforce-start-date="2016-10-01" lims:fid="717082" lims:id="717082"><Label>(4)</Label><Text>The Consumer Price Index is the average all-items Consumer Price Index for Canada (not seasonally adjusted) published by Statistics 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717085" lims:id="717085" level="2"><TitleText>Gravemarkers</TitleText></Heading><Section lims:inforce-start-date="2014-03-31" lims:lastAmendedDate="2014-03-31" lims:fid="717086" lims:id="717086"><Label>5</Label><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717087" lims:id="717087"><Label>(1)</Label><Text>If neither a foreign government, nor the Commonwealth War Graves Commission nor any other agency provides a gravemarker, a gravemarker must, subject to subsection (2), be provided and installed for the following persons:</Text><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717088" lims:id="717088"><Label>(a)</Label><Text>in Canada or elsewhere, if there is an insufficiency of funds, as determined under section 4, on application, a person described in any of subparagraphs 2(a)(i) or (iv) to (vi);</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717089" lims:id="717089"><Label>(b)</Label><Text>in Canada, if there is an insufficiency of funds, as determined under section 4, on application, a person described in subparagraph 2(a)(ii) or (iii); and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717090" lims:id="717090"><Label>(c)</Label><Text>in Canada or elsewhere, a person described in paragraph 2(b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717091" lims:id="717091"><Label>(2)</Label><Text>The provision of a gravemarker under these Regulations is subject to the condition that the gravemarker must not be altered or replaced without the prior consent of the lims:inforce-start-date="2006-03-22" lims:fid="717095" lims:id="717095"><Label>(1)</Label><Text>Gravemarkers provided under these Regulations and their inscription must meet the standards specified by the Minister and are to be provided only when acceptable to the applicable cemetery authority and the applicant receiving financial assistance.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717096" lims:id="717096"><Label>(2)</Label><Text>A bronze gravemarker that meets the standards specified by the Minister may be provided only if required by the applicable cemetery authority.</Text></Subsection></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717097" lims:id="717097" level="2"><TitleText>Standards</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717098" lims:id="717098"><Label>7</Label><Text>The Minister may specify standards for the size and any other characteristics of caskets and gravemarkers provided under these Regulations.</Text></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717099" lims:id="717099" level="1"><Label>PART 2</Label><TitleText>Administration</TitleText></Heading><Heading lims:inforce-start-date="2016-10-01" lims:fid="717100" lims:id="717100" level="2"><TitleText>Applications</TitleText></Heading><Section lims:inforce-start-date="2009-07-30" lims:lastAmendedDate="2019-04-01" lims:fid="717101" lims:id="717101"><Label>8</Label><Subsection lims:inforce-start-date="2009-07-30" lims:fid="717102" lims:id="717102"><Label>(1)</Label><Text>Any person may apply for a gravemarker and for financial assistance for last sickness, funeral, burial and cremation costs on behalf of a deceased person.</Text></Subsection><Subsection lims:inforce-start-date="2009-07-30" lims:fid="717103" lims:id="717103"><Label>(2)</Label><Text>No financial assistance is payable unless an application for it is made within one year after the date that the remains of the deceased person become available for interment.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="717104" lims:id="1121903"><Label>(3)</Label><Text>If an application for financial assistance is received but cannot be acted on as a result of a pending decision as to whether the person is entitled to a disability award or entitled to pain and suffering compensation or as to whether a pension may be awarded under paragraph 21(1)(b) or (2)(b) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, the application is suspended until a decision has been rendered.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="717105" lims:id="1121904"><Label>(4)</Label><Text>If a person is determined to be entitled to a disability award or entitled to pain and suffering compensation or a decision is made to award a pension under paragraph 21(1)(b) or (2)(b) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, the application for financial assistance must be acted on as if the initial decision with respect to eligibility under subparagraph 2(b)(i), (ii) or (vi) had been favourable.</Text></Subsection><Subsection lims:inforce-start-date="2009-07-30" lims:fid="717106" lims:id="717106"><Label>(5)</Label><Text>If more than one person applies for financial assistance in respect of the same death, the order of priority for an application, to the exclusion of all others, is as follows:</Text><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="717107" lims:id="717107"><Label>(a)</Label><Text>the liquidator of the succession of the deceased;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="717108" lims:id="717108"><Label>(b)</Label><Text>the survivor of the deceased;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="717109" lims:id="717109"><Label>(c)</Label><Text>the person who is best able to ensure the burial; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="717110" lims:id="717110"><Label>(d)</Label><Text>the person who lives closest to the place of burial of the deceased.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-07-30" lims:fid="717112" with the Last Post Fund</TitleText></Heading><Section lims:inforce-start-date="2014-03-31" lims:lastAmendedDate="2019-04-01" lims:fid="717114" lims:id="717114"><Label>9</Label><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717115" lims:id="717115"><Label>(1)</Label><Text>For the purpose of facilitating the provision of financial assistance and gravemarkers under Part 1, as well as the administration of these Regulations, the Minister may enter into an agreement with the Corporation by which</Text><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717116" lims:id="717116"><Label>(a)</Label><Text>the Corporation determines the eligibility for and provides, on behalf of the Government of Canada, that assistance and gravemarkers in accordance with these Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717117" lims:id="717117"><Label>(b)</Label><Text>the Minister reimburses the Corporation for any costs incurred under paragraph (a), by Parliamentary appropriation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717118" lims:id="717118"><Label>(2)</Label><Text>An agreement must address</Text><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717119" lims:id="717119"><Label>(a)</Label><Text>the requirements for an application for financial assistance and gravemarkers under Part 1 and the procedure by which the application may be received by the Corporation, including any declarations and undertakings that the Corporation may require the applicant to make;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717120" lims:id="717120"><Label>(b)</Label><Text>the regular channels of communication to be used between the Corporation and the Department;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717121" lims:id="717121"><Label>(c)</Label><Text>the procedure to be followed for obtaining or verifying, from the records of the Department, relevant information concerning a person’s eligibility for financial assistance and gravemarkers under Part 1 or any other information necessary for the administration of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717122" lims:id="717122"><Label>(d)</Label><Text>the procedures to be followed by the Corporation when making determinations concerning a person’s eligibility under paragraph 2(a), including</Text><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717123" lims:id="717123"><Label>(i)</Label><Text>the identification of the representatives of the Corporation duly authorized to render those determinations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717124" lims:id="717124"><Label>(ii)</Label><Text>the provision of any determination to the applicant, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717125" lims:id="717125"><Label>(iii)</Label><Text>the provision of a notice to the applicant respecting any internal appeal process established by the Corporation;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717126" lims:id="717126"><Label>(e)</Label><Text>the procedures to be followed by the Corporation in respect of applications under paragraph 2(b), including</Text><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717127" lims:id="717127"><Label>(i)</Label><Text>referrals to the Department,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717128" lims:id="717128"><Label>(ii)</Label><Text>the provision of any determination to the applicant, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717129" lims:id="717129"><Label>(iii)</Label><Text>the provision to the applicant of any review of a determination;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717130" lims:id="717130"><Label>(f)</Label><Text>the documentation and records to be kept by the Corporation in respect of applications, and the transfer of those documents and records to the Department;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717131" lims:id="717131"><Label>(g)</Label><Text>the determination and reimbursement to be made of the Corporation’s administrative and operating expenses by Parliamentary appropriation;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717132" lims:id="717132"><Label>(h)</Label><Text>the financial procedures to be used for reimbursing the Corporation, including</Text><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717133" lims:id="717133"><Label>(i)</Label><Text>the determination of the amounts and frequency of reimbursements to the Corporation, including refunds for expenditures made in a previous fiscal year,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717134" lims:id="717134"><Label>(ii)</Label><Text>the statistical and accounting information on which the reimbursements are to be based and the manner, form and frequency with which the Corporation must report that information,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717135" lims:id="717135"><Label>(iii)</Label><Text>the manner in which deductions may be made from reimbursements to the Corporation in respect of overpayments of financial assistance that are being recovered by the Corporation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717136" lims:id="717136"><Label>(iv)</Label><Text>the conditions and manner in which reimbursements to the Corporation may be made in advance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-03-31" lims:fid="717137" lims:id="717137"><Label>(v)</Label><Text>the standards by which the estimates and the budget of the Corporation must be prepared and its accounts must be kept;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717138" lims:id="717138"><Label>(i)</Label><Text>the business plans, operating budgets, capital budgets and performance reports to be submitted by the Corporation to the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717139" lims:id="717139"><Label>(j)</Label><Text>the audit of the Corporation’s accounts, the access that auditors and evaluators may have to the Corporation’s records relating to its functions under the agreement and the evaluation of the Corporation’s performance in light of the agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717140" lims:id="717140"><Label>(k)</Label><Text>the safeguarding of any personal information as defined in the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal> that may be collected by the Department or the Corporation for the purposes of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717141" lims:id="717141"><Label>(l)</Label><Text>the exercise by the Corporation of the rights or powers that the Minister has in respect of burial in any cemeteries and burial plots owned or controlled by the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717142" lims:id="717142"><Label>(m)</Label><Text>the assumption or exclusion of any obligations or liabilities that might be incurred by the Corporation in connection with any function or procedure under the agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717143" lims:id="717143"><Label>(n)</Label><Text>the notice to be given and the formalities required for a termination of the agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717144" lims:id="717144"><Label>(o)</Label><Text>the specification of which law governs the agreement and its interpretation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717145" lims:id="717145"><Label>(3)</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717146" lims:id="717146"><Label>(a)</Label><Text>terminate an agreement at any time after the notice and formalities required by the agreement have been given and may enter into similar agreements with one or more other bodies, in which case a reference to the corporation in section 4, 9 and 10 shall be read as a reference to the other body or bodies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717147" lims:id="717147"><Label>(b)</Label><Text>assign any of the functions referred to in this section to be carried out by employees of the Department.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717148" lims:id="717148"><Label>(4)</Label><Text>An agreement may be amended or replaced by subsequent agreements.</Text></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717149" lims:id="717149"><Label>(5)</Label><Text>The Minister must determine whether the conditions set out in paragraph (b) of the definition <DefinedTermEn>income-qualified civilian</DefinedTermEn> in section 1 or under subparagraph 2(b)(i), (ii) or (vi) are met and inform the Corporation of the determination.</Text></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717150" lims:id="717150"><Label>(6)</Label><Text>The Minister must advise the Corporation whether any deceased person was, at the time of death,</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="717151" lims:id="1121907"><Label>(a)</Label><Text>a person entitled to a disability award, entitled to pain and suffering compensation or entitled to a pension; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717152" lims:id="717152"><Label>(b)</Label><Text>a person referred to in paragraph (a) of the definition <DefinedTermEn>income-qualified civilian</DefinedTermEn> in section 1 or a person referred to in any of subparagraphs 2(b)(ii) to (iv).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-03-31" lims:fid="717153" lims:id="717153"><Label>(7)</Label><Text>The Minister must make available on request to the public</Text><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717154" lims:id="717154"><Label>(a)</Label><Text>the agreements in force and of any amendments to them; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-03-31" lims:fid="717155" lims:id="717155"><Label>(b)</Label><Text>the standards specified under section 7.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-03-31" lims:fid="717158" lims:id="717158" level="2"><TitleText>Review of Determination</TitleText></Heading><Section lims:inforce-start-date="2006-04-01" lims:lastAmendedDate="2006-04-01" lims:fid="717159" lims:id="717159"><Label>10</Label><Subsection lims:inforce-start-date="2006-04-01" lims:fid="717160" lims:id="717160"><Label>(1)</Label><Text>A person who is dissatisfied with a final determination of the Corporation, or with a determination with respect to eligibility made under subparagraph 2(b)(i), (ii) or (vi), may, within 60 days after receiving that determination or, if circumstances beyond the control of the person necessitate a longer period, within the longer period, apply in writing to the Minister for a review of that determination.</Text></Subsection><Subsection lims:inforce-start-date="2006-04-01" lims:fid="717161" lims:id="717161"><Label>(2)</Label><Text>If, after the review, the Minister concludes that the final determination made by the Corporation was in error, the Minister may take any steps to remedy the error that the Minister considers necessary in the circumstances.</Text></Subsection><Subsection lims:inforce-start-date="2006-04-01" lims:fid="717162" lims:id="717162"><Label>(3)</Label><Text>In lieu of the review referred to in subsection (1), if a person is dissatisfied with a determination with respect to eligibility referred to in subparagraphs 2(b)(i) or (ii), the person may within 60 days after receiving the determination or, if circumstances beyond the control of the person necessitate a longer period, within the longer period, apply to the Minister for a decision under paragraph 21(1)(b) or (2)(b) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, unless an application for that purpose has previously been made.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-04-01" lims:fid="717164" lims:id="717164">SOR/2006-50, s. Corporation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717166" lims:id="717166"><Label>11</Label><Text>Nothing in these Regulations precludes the Corporation from providing financial assistance and a gravemarker similar to the financial assistance and gravemarker referred to under Part 1 for any deceased person who is ineligible under these Regulations</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717167" lims:id="717167"><Label>(a)</Label><Text>on the Corporation’s own initiative and at its own expense; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717168" lims:id="717168"><Label>(b)</Label><Text>on the request and at the expense of any department of the Government of Canada, the government of any province, any municipality, any foreign government or agency, or any other person, corporation or agency.</Text></Paragraph></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717169" lims:id="717169" level="2"><TitleText>Gravemarker Maintenance</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717170" lims:id="717170"><Label>12</Label><Text>If a gravemarker or financial assistance towards funeral, burial and cremation costs have been provided under these Regulations or under predecessor enactments dealing with the same subject-matter, all necessary maintenance of the gravemarker must be provided by the Minister, including the replacement or refurbishment of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717171" lims:id="717171"><Label>(a)</Label><Text>the gravemarker in any cemetery or block of graves owned by the Government of Canada and allocated to former members of the armed forces or the merchant navy or any persons who engaged in pursuits relating to war on behalf of Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717172" lims:id="717172"><Label>(b)</Label><Text>a gravemarker, of the standard referred to in subsection 6(1), in the cemetery where the original gravemarker or burial was provided.</Text></Paragraph></Section><Heading lims:inforce-start-date="2016-10-01" lims:fid="717173" lims:id="717173"
