A-2</Text></Footnote></Provision><Provision lims:inforce-start-date="2012-05-04" lims:fid="792526" lims:id="792526" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas a purpose of the proposed Regulations is to prevent lands adjacent to or in the vicinity of Kugaaruk Airport from being used or developed in a manner that is, in the opinion of the Minister of Transport, incompatible with the safe operation of an airport or aircraft;</Text></Provision><Provision lims:inforce-start-date="2012-05-04" lims:fid="792527" lims:id="792527" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas a purpose of the proposed Regulations is to prevent lands adjacent to or in the vicinity of facilities used to provide services relating to aeronautics from being used or developed in a manner that would, in the opinion of the Minister of Transport, cause interference with signals or communications to and from aircraft or to and from Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to paragraphs 5.4(2)(b)<FootnoteRef idref="fn_659e_tc_2302">a</FootnoteRef> and (c)<FootnoteRef annexed <XRefExternal reference-type="regulation" link="SOR-2012-95">Kugaaruk Airport Zoning Regulations</XRefExternal>.</Text></Provision></Order><Body lims:inforce-start-date="2012-05-04" lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792531" lims:id="792531"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792532" lims:id="792532">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2013-04-02" lims:fid="792533" lims:id="792533" generate-in-text="no"><Text><DefinedTermEn>airport</DefinedTermEn> means the Kugaaruk Airport, in the vicinity of Kugaaruk, in Nunavut. (<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792534" lims:id="792534" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part 1 of the schedule. (<DefinedTermFr>point de référence de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792535" lims:id="792535" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means an imaginary inclined surface that extends upward and outward from each end of the strip surface and that is described in Part 2 of the schedule. (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792536" lims:id="792536" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means the imaginary surface that is located above and in the immediate vicinity of the airport and that is described in Part 3 of the schedule. (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792537" lims:id="792537" generate-in-text="no"><Text><DefinedTermEn>strip surface</DefinedTermEn> means the imaginary surface that is associated with the airport runway and that is described in Part 4 of the schedule. (<DefinedTermFr>surface de bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792538" lims:id="792538" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined surface that extends upward and outward from the lateral limits of the strip surface and its approach surfaces and that is described in Part 5 of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-04-02" lims:fid="792539" lims:id="792539" generate-in-text="no"><Text><DefinedTermEn>zoning plan</DefinedTermEn> means Plan No. E 3302, prepared by the Department of Public Works and Government Services and dated December 1, 2008. (<DefinedTermFr>plan de zonage</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792540" lims:id="792540" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792541" lims:id="792541"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792542" lims:id="792542">Lands near airport</MarginalNote><Label>2</Label><Text>These Regulations apply in respect of all lands that are adjacent to or in the vicinity of the airport within the limit described in Part 6 of the schedule. For greater certainty, the lands include lands under water and public road allowances.</Text></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792543" lims:id="792543" level="1"><TitleText>Building Restrictions</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792544" lims:id="792544"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792545" lims:id="792545">Prohibition — maximum height</MarginalNote><Label>3</Label><Text>A person must not place, erect or construct, or permit another person to place, erect or construct, on any of the lands, a building, structure or object, or an addition to an existing building, structure or object, any part of which would penetrate any of the following surfaces:</Text><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792546" lims:id="792546"><Label>(a)</Label><Text>an approach surface;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792547" lims:id="792547"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792548" lims:id="792548"><Label>(c)</Label><Text>a transitional surface.</Text></Paragraph></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792549" lims:id="792549" level="1"><TitleText>Interference with Communication</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792550" lims:id="792550"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792551" lims:id="792551">Prohibition — interference</MarginalNote><Label>4</Label><Text>A person must not use or develop, or permit another person to use or develop, any of the lands that are under the outer surface in a manner that causes interference with any signal or communication to and from an aircraft or to and from any facility used to provide services relating to aeronautics.</Text></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792552" lims:id="792552" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792553" lims:id="792553"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792554" lims:id="792554">Prohibition — maximum height</MarginalNote><Label>5</Label><Text>A person must not permit any object of natural growth that is on any of the lands to grow in such a manner as to penetrate any of the following surfaces:</Text><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792555" lims:id="792555"><Label>(a)</Label><Text>an approach surface;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792556" lims:id="792556"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-04-02" lims:fid="792557" lims:id="792557"><Label>(c)</Label><Text>a transitional surface.</Text></Paragraph></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792558" lims:id="792558" level="1"><TitleText>Wildlife Hazard</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792559" lims:id="792559"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792560" lims:id="792560">Prohibition — activities or uses</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2013-04-02" lims:fid="792561" lims:id="792561"><Label>(1)</Label><Text>A person must not use or permit another person to use any of the lands for activities or uses that attract wildlife — particularly birds — that may create a hazard for aviation safety.</Text></Subsection><Subsection lims:inforce-start-date="2013-04-02" lims:fid="792562" lims:id="792562"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792563" lims:id="792563">Exception</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), a person may use or permit another person to use any of the lands as a site for an open water storage reservoir for a period of 48 hours or less.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-05-04" lims:fid="792564" lims:id="792564" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792565" lims:id="792565"><MarginalNote lims:inforce-start-date="2013-04-02" lims:fid="792566" lims:id="792566">Requirements — s. 5.6(2) of <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal></MarginalNote><Label><FootnoteRef idref="fn_Ind1D89_hq_12464">*</FootnoteRef>7</Label><Text>These Regulations come into force on the day on which the requirements prescribed in subsection 5.6(2) of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal> are met.</Text><Footnote id="fn_Ind1D89_hq_12464" placement="section" status="editorial"><Label>*</Label><Text>[Note: Regulations in force April 2, 2013.]</Text></Footnote></Section></Body><Schedule lims:inforce-start-date="2013-04-02" lims:lastAmendedDate="2013-04-02" lims:fid="792567" lims:id="792567" spanlanguages="no" bilingual="no"><ScheduleFormHeading lims:inforce-start-date="2013-04-02" lims:fid="792568" lims:id="792568"><Label>SCHEDULE</Label><OriginatingRef>(Sections 1 and 2)</OriginatingRef></ScheduleFormHeading><Provision lims:inforce-start-date="2013-04-02" lims:fid="792569" lims:id="792569" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>In this schedule, all grid coordinates are in metres (m) and refer to the 1983 North American Datum, Zone 16, Universal Transverse Mercator (UTM) projection. Grid coordinates have been computed using a combined average scale factor of 0.99975895.</Text></Provision><Provision lims:inforce-start-date="2013-04-02" lims:fid="792570" lims:id="792570" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>In this schedule, all elevation values are in metres (m) and are based on the Canadian Geodetic Vertical Datum (CGVD28).</Text></Provision><Heading lims:inforce-start-date="2013-04-02" lims:fid="792571" lims:id="792571" level="1"><Label>PART 1</Label><TitleText>Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2013-04-02" lims:fid="792572" lims:id="792572" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point, as shown on the zoning plan, is the geometric centre of the runway thresholds, at grid coordinates 7 605 223.935 N, 385 471.969 E (latitude 68°32′09″ N, longitude 89°48′19″ W). It is located on the centre line of the strip surface at a distance of 823.55 m from the end of the strip surface associated with runway 05-23, and its assigned elevation is 10.63 m above sea level.</Text></Provision><Heading lims:inforce-start-date="2013-04-02" lims:fid="792573" lims:id="792573" level="1"><Label>PART 2</Label><TitleText>Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2013-04-02" lims:fid="792574" lims:id="792574" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, as shown on the zoning plan, are described as follows:</Text><Provision lims:inforce-start-date="2013-04-02" lims:fid="792575" lims:id="792575" format-ref="indent-1-1" language-align="no" list-item="no"><Text>(a) an imaginary inclined surface abutting the end of the strip surface associated with runway approach 05 and ascending, from an assigned elevation of 17.70 m above sea level, at a ratio of 1 m measured vertically to 25 m measured horizontally, to an imaginary horizontal line drawn at right angles to the projected centre line of the strip surface and distant 2 500 m measured horizontally from the end of the strip surface; the outer ends of the imaginary horizontal line being 280 m from the projected centre line and 100 m above the assigned elevation at the end of the strip surface associated with runway approach 05; and</Text></Provision><Provision lims:inforce-start-date="2013-04-02" lims:fid="792576" lims:id="792576" format-ref="indent-1-1" language-align="no" list-item="no"><Text>(b) an imaginary inclined surface abutting the end of the strip surface associated with runway approach 23 and ascending, from an assigned elevation of 8.32 m above sea level, at a ratio of 1 m measured vertically to 25 m measured horizontally, to an imaginary horizontal line drawn at right angles to the projected centre line of the strip surface and distant 2 500 m measured horizontally from the end of the strip surface; the outer ends of the imaginary horizontal line being 280 m from the projected centre line and 100 m above the assigned elevation at the end of the strip surface associated with runway approach 23.</Text></Provision></Provision><Provision lims:inforce-start-date="2013-04-02" lims:fid="792577" lims:id="792577" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The elevation of an approach surface at any point is equal to the elevation of the nearest point on the centre line of that approach surface. The elevation of an approach surface centre line is calculated from the elevation of the abutting end of the strip surface, and increases at the constant ratios set out in this Part.</Text></Provision><Heading lims:inforce-start-date="2013-04-02" lims:fid="792578" lims:id="792578" level="1"><Label>PART 3</Label><TitleText>Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2013-04-02" lims:fid="792579" lims:id="792579" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, as shown on the zoning plan, is an imaginary surface extending outward from the airport reference point to a radius of 4 000 m. It is situated at a constant elevation of 45 m above the airport reference point, but at 9 m above the ground when that elevation would place the outer surface at less than 9 m above the ground.</Text></Provision><Heading lims:inforce-start-date="2013-04-02" lims:fid="792580" lims:id="792580" level="1"><Label>PART 4</Label><TitleText>Strip Surface</TitleText></Heading><Provision lims:inforce-start-date="2013-04-02" lims:fid="792581" lims:id="792581" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The elevation of a strip surface at any point is equal to the elevation of the nearest point on the centre line of that strip surface. The elevation of the strip surface centre line between the strip surface end and the closest strip surface threshold is equal to the elevation of the strip surface end. The strip surface centre line between the strip surface thresholds is divided into segments, each of which has a slope that increases or decreases at the constant ratio set out in Column 7 of the table to this Part. The elevation of any point along a segment is calculated using the data set out in that table.</Text></Provision><Provision lims:inforce-start-date="2013-04-02" lims:fid="792582" lims:id="792582" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strip surface, as shown on the zoning plan, is an imaginary rectangular surface described as follows:</Text><Provision lims:inforce-start-date="2013-04-02" lims:fid="792583" lims:id="792583" format-ref="indent-1-1" language-align="no" list-item="no"><Text>the strip surface associated with runway 05-23 is 60 m in total width, being 30 m on either side of the centre line of the runway. The strip surface commences 60 m to the southwest of threshold 05 and ends 60 m to the northeast of threshold 23, having a total length of 1 647.10 m. The 05 end of the strip surface has an assigned elevation of 17.70 m and the 23 end of the strip surface has an elevation of 8.32 m. The azimuth of the centre line of runway 05-23 is N 51°11′57″ E.
