link="N-28.3">Nuclear Safety and Control Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817198" lims:id="817198" generate-in-text="no"><Text><DefinedTermEn>activity</DefinedTermEn> means the number of nuclear transformations occurring per unit of time, as measured in becquerels. (<DefinedTermFr>activité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817199" lims:id="817199" generate-in-text="no"><Text><DefinedTermEn>alternative activity limit for an exempt consignment</DefinedTermEn>, in respect of an instrument or article, means an activity limit for a consignment that is above the activity limit for an exempt consignment set out in the IAEA Regulations and that has been approved as meeting the exemption criteria set out in those Regulations for an instrument or article. (<DefinedTermFr>autre limite d’activité pour un envoi exempté</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817200" lims:id="817200" generate-in-text="no"><Text><DefinedTermEn>basic radionuclide value</DefinedTermEn> means either an A<Sub>1</Sub> in TBq, an A<Sub>2</Sub> in TBq, an activity concentration limit for an exempt material in Bq/g or an activity limit for an exempt consignment in Bq, as set out in the IAEA Regulations. (<DefinedTermFr>valeur de base pour un generate-in-text="no"><Text><DefinedTermEn>certificate</DefinedTermEn> means a document issued by the Commission under paragraph 21(1)(h) of the Act or by a designated officer authorized under paragraph 37(2)(a) of the Act, indicating the certification of</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817203" lims:id="817203"><Label>(a)</Label><Text>a package design;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817204" lims:id="817204"><Label>(b)</Label><Text>a design for special form radioactive material;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817205" lims:id="817205"><Label>(c)</Label><Text>a design for low dispersible radioactive material;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817206" lims:id="817206"><Label>(d)</Label><Text>the calculation of a value demonstrating that fissile-excepted radioactive material will remain subcritical;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817207" lims:id="817207"><Label>(e)</Label><Text>the calculation of the basic radionuclide value for radioactive material that has a basic radionuclide value that is not listed in the IAEA Regulations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817208" lims:id="817208"><Label>(f)</Label><Text>the calculation, for an instrument or article that has an alternative activity limit for an exempt consignment, of the alternative activity generate-in-text="no"><Text><DefinedTermEn>excepted package</DefinedTermEn> means a package that is designed in accordance with the applicable requirements of the IAEA Regulations. (<DefinedTermFr>colis excepté</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817219" lims:id="817219" generate-in-text="no"><Text><DefinedTermEn>exclusive use</DefinedTermEn> has the same meaning as in the IAEA Regulations. (<DefinedTermFr>utilisation exclusive</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817220" lims:id="817220" generate-in-text="no"><Text><DefinedTermEn>fissile-excepted radioactive material</DefinedTermEn> means fissile radioactive material that is</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817221" lims:id="817221"><Label>(a)</Label><Text>excepted from being classified as fissile in accordance with the IAEA Regulations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817222" lims:id="817222"><Label>(b)</Label><Text>contained in a package that is excepted from being classified as fissile in accordance with those Regulations. (<DefinedTermFr>matière generate-in-text="no"><Text><DefinedTermEn>IAEA</DefinedTermEn> means the International Atomic Energy Agency. (<DefinedTermFr>AIEA</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817226" lims:id="817226" generate-in-text="no"><Text><DefinedTermEn>IAEA Regulations</DefinedTermEn> means the <XRefExternal reference-type="regulation">Regulations for the Safe Transport of Radioactive Material</XRefExternal>, published by the IAEA, as amended from time to time. (<DefinedTermFr>Règlement de l’AIEA</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817227" lims:id="817227" generate-in-text="no"><Text><DefinedTermEn>instrument or article</DefinedTermEn> means any tool, implement or object, or its components, that encloses nuclear substances and that is fabricated for a particular use other than solely for enclosing those nuclear substances. (<DefinedTermFr>Appareils ou objets</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817228" lims:id="817228" generate-in-text="no"><Text><DefinedTermEn><XRefExternal reference-type="other">International Maritime Dangerous Goods Code</XRefExternal></DefinedTermEn> means the document of that name published by the International Maritime Organization, as amended from time to time. (<DefinedTermFr><XRefExternal reference-type="other">Code maritime international des marchandises dangereuses</XRefExternal></DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817229" lims:id="817229" generate-in-text="no"><Text><DefinedTermEn>large object</DefinedTermEn> means an object that has been decommissioned from a nuclear facility, that is internally contaminated with nuclear substances meeting the requirements applicable to an SCO-I or SCO-II as set out in the IAEA Regulations and that cannot be transported in a type of package described in these Regulations due to its dimensions. (<DefinedTermFr>objet de grande dangereuses</XRefExternal></DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817245" lims:id="817245" generate-in-text="no"><Text><DefinedTermEn>transit</DefinedTermEn> means the process of being transported through Canada after being imported into and before being exported from Canada, in a situation where the place of initial loading and the final destination are outside Canada. (<DefinedTermFr>transit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817246" lims:id="817246" generate-in-text="no"><Text><DefinedTermEn>transport index</DefinedTermEn> has the same meaning as in the IAEA Regulations. (<DefinedTermFr>indice de transport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817247" lims:id="817247" generate-in-text="no"><Text><DefinedTermEn>Type A</DefinedTermEn>, in as either a Type B(U) or a Type B(M) package in accordance with the IAEA Regulations and is designed in accordance with the applicable requirements of those Regulations. (<DefinedTermFr>type of a package, means that the package is designed in accordance with the applicable requirements of the IAEA Regulations. (<DefinedTermFr>type C</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-12" lims:fid="817250" lims:id="817250" generate-in-text="no"><Text><DefinedTermEn>Type H(M)</DefinedTermEn>, in respect of a package, means that the package has a type code of H(M) in accordance with the IAEA Regulations and is an excepted package, Type IP-1 package, Type IP-2 package, Type IP-3 package or Type A package that is designed to contain more than 0.1 kg of uranium hexafluoride that is non-fissile material or is fissile-excepted radioactive material. (<DefinedTermFr>type H(M)</DefinedTermFr>)</Text></Definition><Definition lims:id="817274">Exception</MarginalNote><Label>(2)</Label><Text>These Regulations, except for sections <XRefInternal>6</XRefInternal> and <XRefInternal>7</XRefInternal>, do not apply to the packaging has</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817276" lims:id="817276"><Label>(i)</Label><Text>a specific activity that is less than or equal to 70 kBq/kg, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817277" lims:id="817277"><Label>(ii)</Label><Text>an activity concentration that does not exceed 10 times the activity concentration limit for exempt material values set out in the IAEA Regulations;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817278" lims:id="817278"><Label>(b)</Label><Text>that was implanted in or administered to a person or an animal for medical diagnosis or treatment purposes, or that subsists in their remains;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817279" lims:id="817279"><Label>(c)</Label><Text>that is contained in a sample of material taken for bioassay purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817280" lims:id="817280"><Label>(d)</Label><Text>that is used by a holder of a licence on private property for the purpose of an activity described in paragraphs 26(a) to (c) of the Act that the licence authorizes the holder to carry on, if access to the property is controlled;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817281" lims:id="817281"><Label>(e)</Label><Text>that is contained in human or animal tissue samples or animal remains, or a liquid scintillation medium, if the specific activity of the nuclear substance averaged over the mass of the material does not exceed 10<Sup>-6</Sup> A<Sub>2</Sub>/kg;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817282" lims:id="817282"><Label>(f)</Label><Text>that is contained in a product for which no licence is required under sections 6 to 8 of the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal> following the sale of the product to an end user;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817283" lims:id="817283"><Label>(g)</Label><Text>that is an integral part of a conveyance and is required for transport purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817284" lims:id="817284"><Label>(h)</Label><Text>that has an activity concentration that does not exceed the values for an exempt material set out in the IAEA Regulations or in a certificate for a basic radionuclide value that is not listed in the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817285" lims:id="817285"><Label>(i)</Label><Text>that is in a consignment that has a total activity that does not exceed the values for an activity limit for an exempt consignment set out in the IAEA Regulations, in a certificate for a basic radionuclide value that is not listed in the IAEA Regulations or in a certificate for an instrument or article that has an alternative activity limit for an exempt consignment;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817286" lims:id="817286"><Label>(j)</Label><Text>that is contained in a check source for which no licence is required under section 8.1 of the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal> following the sale of the check source to an end user;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817287" lims:id="817287"><Label>(k)</Label><Text>that is contained in a radiation device for which no licence is required under paragraph 5(1)(c) of the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal> following the sale of the device to an end user;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817288" lims:id="817288"><Label>(l)</Label><Text>that consists of non-radioactive solid objects with radioactive material present on any surface in quantities not exceeding 0.4 Bq/cm<Sup>2</Sup> for beta and gamma emitters and low toxicity alpha emitters and 0.04 Bq/cm<Sup>2</Sup> for all other alpha emitters;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817289" lims:id="817289"><Label>(m)</Label><Text>that is in or on a person who is transported for medical treatment because the person has been subject to an accidental or deliberate intake or contamination;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817290" lims:id="817290"><Label>(n)</Label><Text>that is present in a load of waste that is in transport, is not classified as radioactive material and has triggered a radiation monitor alarm if the nuclear substance in the load has been determined only to be one or more of the following medical isotopes and if there is no loss or dispersal of the material during the transport:</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817291" lims:id="817291"><Label>(i)</Label><Text>Chromium 51,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817292" lims:id="817292"><Label>(ii)</Label><Text>Indium 111,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817293" lims:id="817293"><Label>(iii)</Label><Text>Iodine 123, 124 or 131,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817294" lims:id="817294"><Label>(iv)</Label><Text>Gallium 67,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817295" lims:id="817295"><Label>(v)</Label><Text>Technetium 99m,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817296" lims:id="817296"><Label>(vi)</Label><Text>Thallium 201;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817297" lims:id="817297"><Label>(o)</Label><Text>that is being transported to a location for proper characterization in accordance with section <XRefInternal>3</XRefInternal>, if</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817298" lims:id="817298"><Label>(i)</Label><Text>it is present in a load that was already in transport,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817299" lims:id="817299"><Label>(ii)</Label><Text>it is not classified as radioactive material,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817300" lims:id="817300"><Label>(iii)</Label><Text>it has triggered a radiation monitor alarm and the maximum dose rate on any external surface of the vehicle that is transporting it is less than or equal to 500 µSv/h, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817301" lims:id="817301"><Label>(iv)</Label><Text>there is no loss or dispersal of the material during the transport; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817302" lims:id="817302"><Label>(p)</Label><Text>that is being transported by a peace officer to a location for proper characterization, if</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817303" lims:id="817303"><Label>(i)</Label><Text>it is a forensic sample,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817304" lims:id="817304"><Label>(ii)</Label><Text>the peace officer has reason to believe that it is radioactive material,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817305" lims:id="817305"><Label>(iii)</Label><Text>the maximum dose rate on contact is less than or equal to 2 mSv/h on any external surface of the container,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817306" lims:id="817306"><Label>(iv)</Label><Text>there is no loss or dispersal of the material during the transport, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817307" lims:id="817307"><Label>(v)</Label><Text>the Commission is advised immediately of the transport.</Text></Subparagraph></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817308" lims:id="817308"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817309" lims:id="817309">Characterization</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817310" lims:id="817310"><Label>(1)</Label><Text>The nuclear substance referred to in paragraph <XRefInternal>2</XRefInternal>(2)(o) must be characterized at the earliest possible time to determine the extent to which it is subject to these Regulations and the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817311" lims:id="817311"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817312" lims:id="817312">Licensable quantity</MarginalNote><Label>(2)</Label><Text>For the purpose of this section, a licensable quantity of a nuclear substance is a quantity</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817313" lims:id="817313"><Label>(a)</Label><Text>in respect of which the activity exceeds the exemption quantity, as defined in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817314" lims:id="817314"><Label>(b)</Label><Text>in respect of which there is no exemption from licensing under sections 5 to 8.1 of those Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817315" lims:id="817315"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817316" lims:id="817316">Documentation of characterization</MarginalNote><Label>(3)</Label><Text>The person who performs the characterization must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817317" lims:id="817317"><Label>(a)</Label><Text>keep a record documenting the detection of the radiation and the disposal of the nuclear substance for two years;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817318" lims:id="817318"><Label>(b)</Label><Text>file an annual report with the Commission by April 30 that contains a summary of radiation detections for the calendar year before the date of the report; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817319" lims:id="817319"><Label>(c)</Label><Text>immediately notify the Commission if the source of the radioactivity in the load is determined to be a licensable quantity of a nuclear substance.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817320" lims:id="817320"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817321" lims:id="817321">Dose rate greater than 5 µSv/h and less than or equal to 25 µSv/h</MarginalNote><Label>(4)</Label><Text>If the measured dose rate at the time that the alarm is triggered is greater than 5 µSv/h and less than or equal to 25 µSv/h and there is no loss or dispersal of the nuclear substance during the transport, the consignor, the carrier and the consignee must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817322" lims:id="817322"><Label>(a)</Label><Text>immediately make a preliminary report to the Commission indicating the alarm level, the details of the transport, information on the location and circumstances of the detected radiation and any action that they have taken or propose to take in respect of it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817323" lims:id="817323"><Label>(b)</Label><Text>characterize the source of the radiation within 10 days after its detection and make a follow-up report</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817324" lims:id="817324"><Label>(i)</Label><Text>immediately, if the characterization of the source of the radioactivity in the load indicates that it is a licensable quantity of a nuclear substance, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817325" lims:id="817325"><Label>(ii)</Label><Text>within 21 days after the initial detection, if the nuclear substance in the load is determined not to be of a licensable quantity, with a summary of the radiation detection and the disposal of the substance and a confirmation that it is not of a licensable quantity.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817326" lims:id="817326"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817327" lims:id="817327">Dose rate greater than 25 µSv/h and less than or equal to 500 µSv/h</MarginalNote><Label>(5)</Label><Text>If the measured dose rate at the time that the alarm is triggered is greater than 25 µSv/h but less than or equal to 500 µSv/h and there is no loss or dispersal of the nuclear substance during the transport, the consignor, carrier and consignee must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817328" lims:id="817328"><Label>(a)</Label><Text>immediately make a preliminary report to the Commission indicating the alarm level, the details of the transport, information on the location and circumstances of the detected radiation and any action that they have taken or propose to take in respect of it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817329" lims:id="817329"><Label>(b)</Label><Text>isolate the load, prevent dispersal of the nuclear substance and control access to it to ensure that persons are not exposed to effective doses that exceed the limits set out in section 13 of the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817330" lims:id="817330"><Label>(c)</Label><Text>have an expert in radiation protection assess the situation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817331" lims:id="817331"><Label>(d)</Label><Text>report the results of the assessment to the Commission within 10 days after the detection and make a follow-up report</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817332" lims:id="817332"><Label>(i)</Label><Text>immediately, if the characterization of the source of the radioactivity in the load indicates that it is a licensable quantity of a nuclear substance, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817333" lims:id="817333"><Label>(ii)</Label><Text>within 21 days after the initial detection, if the nuclear substance in the load is determined not to be of a licensable quantity, with a summary of the radiation detection and the disposal of the substance and a confirmation that it is not of a licensable quantity.</Text></Subparagraph></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817334" lims:id="817334" level="1"><TitleText>Classification of Material and Packages</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817335" lims:id="817335"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817336" lims:id="817336">General classification</MarginalNote><Label>4</Label><Text>Subject to section <XRefInternal>5</XRefInternal>, packages and radioactive material must be classified in accordance with the IAEA Regulations.</Text></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817337" lims:id="817337"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817338" lims:id="817338">LSA-I material</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817339" lims:id="817339"><Label>(1)</Label><Text>LSA material is classified as LSA-I material if it is either non-fissile material or fissile-excepted radioactive material and if it consists of</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817342" lims:id="817342"><Label>(c)</Label><Text>concentrates of unirradiated thorium, of natural uranium or of depleted uranium, as those terms are defined in the IAEA Regulations, or their unirradiated compounds or mixtures in solid or liquid form;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817343" lims:id="817343"><Label>(d)</Label><Text>any mill tailings, contaminated earth, concrete, rubble, other debris and activated materials in which the radioactive material is essentially uniformly distributed and for which the average specific activity does not exceed 10<Sup>-6</Sup> A<Sub>2</Sub>/g; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817344" lims:id="817344"><Label>(e)</Label><Text>other radioactive lims:id="817348"><Label>(b)</Label><Text>in which the activity is distributed throughout and for which the estimated average specific activity does not exceed 10<Sup>-4</Sup> A<Sub>2</Sub>/g for solids and gases and 10<Sup>-5</Sup> A<Sub>2</Sub>/g for liquids.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817349" lims:id="817349"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817350" lims:id="817350">LSA-III material</MarginalNote><Label>(3)</Label><Text>LSA material is classified as LSA-III material if it consists of solid material that is not in powder form and that meets the applicable requirements of the IAEA Regulations.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817351" lims:id="817351" level="1"><TitleText>Licence</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2025-10-30" lims:fid="817352" lims:id="817352"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817353" lims:id="817353">Licensing requirements</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817354" lims:id="817354"><Label>(1)</Label><Text>A person may transport a nuclear substance without a licence issued under subsection 24(2) of the Act for that purpose, except in the following cases:</Text><Paragraph lims:inforce-start-date="2025-10-30" lims:enacted-date="2025-10-30" lims:fid="817355" lims:id="1544796"><Label>(a)</Label><Text>the nuclear substance is a <DefinitionRef>Category I nuclear material</DefinitionRef>, <DefinitionRef>Category II nuclear material</DefinitionRef> or <DefinitionRef>Category III nuclear material</DefinitionRef>, as those terms are defined in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2000-209">Nuclear Security Regulations</XRefExternal>, and is transported outside the area in which it is required, under any of sections 19 to 21 of those Regulations, to be produced, processed, used or stored;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817356" lims:id="817356"><Label>(b)</Label><Text>the nuclear substance is in transit in a package of a certified design or in a package that has been approved as Type B(U)-96, Type C-96 or Type H(U)-96 by a foreign competent authority in accordance with the IAEA Regulations unless, in the case of transport by aircraft or ship, there is no scheduled stop in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817357" lims:id="817357"><Label>(c)</Label><Text>the nuclear substance is contained in a large object;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817358" lims:id="817358"><Label>(d)</Label><Text>the transport of the nuclear substance cannot meet the requirements of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817359" lims:id="817359"><Label>(e)</Label><Text>the transport of the nuclear substance requires a special use vessel; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817360" lims:id="817360"><Label>(f)</Label><Text>the transport of the nuclear substance requires multilateral approval of shipments in accordance with the IAEA Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817361" lims:id="817361"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817362" lims:id="817362">Activity exemptions</MarginalNote><Label>(2)</Label><Text>A person may possess, transfer, import, export or use prescribed equipment without a licence issued under subsection 24(2) of the Act for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817363" lims:id="817363"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817364" lims:id="817364">Packaging exemptions</MarginalNote><Label>(3)</Label><Text>A person may package a nuclear substance without a licence issued under subsection 24(2) of the Act for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817365" lims:id="817365"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817366" lims:id="817366">Prohibitions imposed by section 26 of Act</MarginalNote><Label>(4)</Label><Text>For greater certainty, the exemptions established in subsections (1) to (3) relate only to the packaging and transport of nuclear substances and do not otherwise derogate from the prohibitions imposed by section subsection 24(2) of the Act to transport a nuclear substance must contain</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817369" lims:id="817369"><Label>(a)</Label><Text>the applicable information required by section 3 of the <XRefExternal reference-type="regulation" link="SOR-2000-202">General Nuclear Safety and Control Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-10-30" lims:enacted-date="2025-10-30" lims:fid="817370" lims:id="1544799"><Label>(b)</Label><Text>the information required by section 100 of the <XRefExternal reference-type="regulation" link="SOR-2000-209">Nuclear Security Regulations</XRefExternal> if the substance is a <DefinitionRef>Category I nuclear material</DefinitionRef>, <DefinitionRef>Category II nuclear material</DefinitionRef> or <DefinitionRef>Category III nuclear material</DefinitionRef>, as those terms are defined in section 1 of those Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817371" lims:id="817371"><Label>(c)</Label><Text>the name, postal address and telephone number of each consignor and consignee;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817372" lims:id="817372"><Label>(d)</Label><Text>if the nuclear substance is one of those referred to in paragraph <XRefInternal>6</XRefInternal>(1)(b),</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817373" lims:id="817373"><Label>(i)</Label><Text>a description of the nuclear substance, including the name, chemical form and physical state, the activity — or, in the case of fissile material, the mass — of each nuclear substance in a package and the total activity or mass in the consignment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817374" lims:id="817374"><Label>(ii)</Label><Text>the country of origin of the nuclear substance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817375" lims:id="817375"><Label>(iii)</Label><Text>the reason for selecting a route through Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817376" lims:id="817376"><Label>(iv)</Label><Text>the name of each carrier,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817377" lims:id="817377"><Label>(v)</Label><Text>the dates, times and locations of its arrival into and departure from Canada and of any scheduled stop or transshipment in Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817378" lims:id="817378"><Label>(vi)</Label><Text>the number of the certificate or approval applicable to the package,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817379" lims:id="817379"><Label>(vii)</Label><Text>the number of packages to be transported,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817380" lims:id="817380"><Label>(viii)</Label><Text>the types of conveyance to be used during transit,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817381" lims:id="817381"><Label>(ix)</Label><Text>if a vessel is to be used as a conveyance during transit, the name of the vessel and its flag state,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817382" lims:id="817382"><Label>(x)</Label><Text>the United Nations number for the nuclear substance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817383" lims:id="817383"><Label>(xi)</Label><Text>the reference number of the emergency response assistance plan that is approved under section 7 of the <XRefExternal reference-type="act" link="T-19.01">Transportation of Dangerous Goods Act, 1992</XRefExternal> or a reference to the effect that a plan is not required, as the case may be;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817384" lims:id="817384"><Label>(e)</Label><Text>if the nuclear substance is contained in a large object,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817385" lims:id="817385"><Label>(i)</Label><Text>information that demonstrates that the internal contamination</Text><Clause lims:inforce-start-date="2015-06-12" lims:fid="817386" lims:id="817386"><Label>(A)</Label><Text>is contained within the object and that all openings are sealed,</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817387" lims:id="817387"><Label>(B)</Label><Text>meets the requirements applicable to an SCO-I or SCO-II as set out in the IAEA Regulations,</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817388" lims:id="817388"><Label>(C)</Label><Text>is caused by a substance that is classified as non-fissile or fissile-excepted radioactive material, and</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817389" lims:id="817389"><Label>(D)</Label><Text>is caused by a substance that is in solid form and that any liquid content is negligible,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817390" lims:id="817390"><Label>(ii)</Label><Text>information that demonstrates that the large object</Text><Clause lims:inforce-start-date="2015-06-12" lims:fid="817391" lims:id="817391"><Label>(A)</Label><Text>meets the free drop test requirements set out in the IAEA Regulations for the industrial package type referred to in section <XRefInternal>27</XRefInternal> for the SCO classification determined for the internal contamination,</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817392" lims:id="817392"><Label>(B)</Label><Text>does not have a dose rate on contact of more than 2 mSv/h from the accessible surfaces of the object, as prepared for shipment, and</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817393" lims:id="817393"><Label>(C)</Label><Text>does not have more than 4 Bq/cm<Sup>2</Sup> of contamination on the exterior surfaces,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817394" lims:id="817394"><Label>(iii)</Label><Text>a detailed transport plan covering all activities associated with the shipment, including</Text><Clause lims:inforce-start-date="2015-06-12" lims:fid="817395" lims:id="817395"><Label>(A)</Label><Text>radiation protection,</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817396" lims:id="817396"><Label>(B)</Label><Text>emergency response, and</Text></Clause><Clause lims:inforce-start-date="2015-06-12" lims:fid="817397" lims:id="817397"><Label>(C)</Label><Text>any special precautions or special administrative or operational controls that are to be employed during transport, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817398" lims:id="817398"><Label>(iv)</Label><Text>details of the applicable management system;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817399" lims:id="817399"><Label>(f)</Label><Text>if the transport of the nuclear substance cannot meet the requirements of these Regulations,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817400" lims:id="817400"><Label>(i)</Label><Text>information that demonstrates that the overall level of safety in transport is at least equivalent to that which would be provided if all the applicable requirements of these Regulations were met,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817401" lims:id="817401"><Label>(ii)</Label><Text>a statement of the reasons why the consignment cannot meet the requirements of these Regulations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817402" lims:id="817402"><Label>(iii)</Label><Text>a statement of any special precautions or special administrative or operational controls that are to be employed during transport to compensate for the inability to meet the requirements of these Regulations;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817403" lims:id="817403"><Label>(g)</Label><Text>if the transport of the nuclear substance requires a special use vessel,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817404" lims:id="817404"><Label>(i)</Label><Text>the vessel owner’s and operator’s contact information, including, as applicable, their names, postal addresses, email addresses, telephone numbers and fax numbers,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817405" lims:id="817405"><Label>(ii)</Label><Text>a copy of the radiation protection program applicable to the shipment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817406" lims:id="817406"><Label>(iii)</Label><Text>details of the consignment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817407" lims:id="817407"><Label>(iv)</Label><Text>information on the stowage arrangements for the duration of the voyage, including for any consignments loaded or unloaded at ports of call en route,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817408" lims:id="817408"><Label>(v)</Label><Text>the dates, times and locations of arrival into and departure from Canada and of any scheduled stop in Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817409" lims:id="817409"><Label>(vi)</Label><Text>a copy of any certificate or approval applicable to packages or materials in the consignment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817410" lims:id="817410"><Label>(vii)</Label><Text>the name of the vessel and its flag state, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817411" lims:id="817411"><Label>(viii)</Label><Text>a copy of any document issued by the competent authority of the vessel’s flag state approving the radiation protection program; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817412" lims:id="817412"><Label>(h)</Label><Text>if the transport of the nuclear substance requires approval of shipment in accordance with the IAEA Regulations,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817413" lims:id="817413"><Label>(i)</Label><Text>the period of time, related to the shipment, for which the approval is sought,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817414" lims:id="817414"><Label>(ii)</Label><Text>information on the radioactive contents, the expected types of conveyance and the probable or proposed route,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817415" lims:id="817415"><Label>(iii)</Label><Text>details of how the precautions and administrative or operational controls referred to in the approval for the package design, if applicable, that was issued in accordance with the IAEA Regulations are to be put into effect,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817416" lims:id="817416"><Label>(iv)</Label><Text>a copy of the applicable approvals for the package design, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817417" lims:id="817417"><Label>(v)</Label><Text>in the case of fissile material, information on the sum of criticality safety indexes and any related safety assessment, emergency response plan and administrative or operational controls.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2025-10-30" lims:enacted-date="2025-10-30" lims:id="817418" level="1"><TitleText>Packaging Requirements</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817419" lims:id="817419"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817420" lims:id="817420">Type H(M) packages</MarginalNote><Label>8</Label><Text>Type H(M) packages must meet the following requirements:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817421" lims:id="817421"><Label>(a)</Label><Text>they must be designed and maintained to meet national or international standards other than the International Organization for Standardization standard ISO 7195 entitled <XRefExternal reference-type="standard">Nuclear Energy — Packaging of uranium hexafluoride (UF6) for transport</XRefExternal>, as amended from time to time, provided that an equivalent level of safety is maintained;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817422" lims:id="817422"><Label>(b)</Label><Text>they must withstand, without leakage and without unacceptable stress, a hydraulic test at an internal pressure of at least 1.38 MPa;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817423" lims:id="817423"><Label>(c)</Label><Text>they must withstand, without loss or dispersal of uranium hexafluoride, the free drop test set out in the IAEA Regulations for normal conditions of transport;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817424" lims:id="817424"><Label>(d)</Label><Text>they must withstand, without rupture of the containment system, the thermal test set out in the IAEA Regulations for accident conditions of transport, unless they are designed to contain 9 000 kg or more of uranium hexafluoride; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817425" lims:id="817425"><Label>(e)</Label><Text>they must not be equipped with pressure relief devices.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817426" lims:id="817426"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817427" lims:id="817427">Type H(U) packages</MarginalNote><Label>9</Label><Text>Type H(U) packages must meet the following requirements:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817428" lims:id="817428"><Label>(a)</Label><Text>they must be designed and maintained to meet the International Organization for Standardization standard ISO 7195 entitled <XRefExternal reference-type="standard">Nuclear Energy — Packaging of uranium hexafluoride (UF6) for transport</XRefExternal>, as amended from time to time;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817429" lims:id="817429"><Label>(b)</Label><Text>they must withstand, without leakage and without unacceptable stress, as specified in standard ISO 7195, as amended from time to time, the hydraulic test set out in the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817430" lims:id="817430"><Label>(c)</Label><Text>they must withstand, without loss or dispersal of uranium hexafluoride, the free drop test set out in the IAEA Regulations for normal conditions of transport;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817431" lims:id="817431"><Label>(d)</Label><Text>they must withstand, without rupture of the containment system, the thermal test set out in the IAEA Regulations for accident conditions of transport; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817432" lims:id="817432"><Label>(e)</Label><Text>they must not be equipped with pressure relief devices.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817433" lims:id="817433" level="1"><TitleText>Certification</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817434" lims:id="817434"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817435" lims:id="817435">Requirement to certify design of prescribed equipment</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817436" lims:id="817436"><Label>(1)</Label><Text>The design of the following types of prescribed equipment must be certified by the Commission or a designated officer before the design is used:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817437" lims:id="817437"><Label>(a)</Label><Text>Type B and Type C packages;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817438" lims:id="817438"><Label>(b)</Label><Text>packages used to transport fissile material;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817439" lims:id="817439"><Label>(c)</Label><Text>packages used to transport 0.1 kg or more of uranium hexafluoride;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817440" lims:id="817440"><Label>(d)</Label><Text>special form radioactive material; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817441" lims:id="817441"><Label>(e)</Label><Text>low dispersible radioactive material.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817442" lims:id="817442"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817443" lims:id="817443">Approval by foreign competent authority</MarginalNote><Label>(2)</Label><Text>The design of the following types of prescribed equipment may be used without being certified if, before the design is used, it is approved by a foreign competent authority in accordance with the IAEA Regulations:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817444" lims:id="817444"><Label>(a)</Label><Text>special form radioactive material, if it is being transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817445" lims:id="817445"><Label>(b)</Label><Text>a Type B(U)-96 or Type C-96 package, if it is in transit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817446" lims:id="817446"><Label>(c)</Label><Text>a Type H(U)-96 package, if it contains 0.1 kg or more of uranium hexafluoride.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817447" lims:id="817447"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817448" lims:id="817448">Certification of subcriticality of fissile-excepted radioactive material</MarginalNote><Label>(3)</Label><Text>The calculation of a value demonstrating that fissile-excepted radioactive material will remain subcritical must be certified by the Commission or a designated officer before the value is used, except in relation to the following materials:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817449" lims:id="817449"><Label>(a)</Label><Text>uranium enriched in uranium-235 to a maximum of 1% by mass and with a plutonium and uranium-233 content not exceeding 1% of the mass of uranium-235, provided that the fissile nuclides are distributed essentially homogeneously throughout the material and any uranium-235 that is present in metallic, oxide or carbide forms must not form a lattice arrangement;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817450" lims:id="817450"><Label>(b)</Label><Text>liquid solutions of uranyl nitrate enriched in uranium-235 to a maximum of 2% by mass, with a plutonium and uranium-233 content not exceeding 0.002% of the mass of uranium, and with a minimum nitrogen to uranium (N/U) atomic ratio of 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817451" lims:id="817451"><Label>(c)</Label><Text>uranium with a maximum uranium enrichment of 5% by mass of uranium-235 provided that</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817452" lims:id="817452"><Label>(i)</Label><Text>there is no more than 3.5 g of uranium-235 per package,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817453" lims:id="817453"><Label>(ii)</Label><Text>the plutonium and uranium-233 content does not exceed 1% of the mass of uranium-235 per package, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817454" lims:id="817454"><Label>(iii)</Label><Text>the amount of fissile nuclides in the consignment is limited to 45 g;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817455" lims:id="817455"><Label>(d)</Label><Text>fissile nuclides with a total mass not greater than 2.0 g per package, provided that the total mass of fissile nuclides in the consignment is limited to 15 g; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817456" lims:id="817456"><Label>(e)</Label><Text>fissile nuclides with a total mass not greater than 45 g per consignment, either packaged or unpackaged, provided that it is transported under exclusive use.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817457" lims:id="817457"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817458" lims:id="817458">Certification of calculation of values</MarginalNote><Label>(4)</Label><Text>The following calculations must be certified by the Commission or a designated officer before the value is used:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817459" lims:id="817459"><Label>(a)</Label><Text>the calculation of the basic radionuclide value for radioactive material that has a basic radionuclide value that is not listed in the IAEA Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817460" lims:id="817460"><Label>(b)</Label><Text>the calculation of the alternative activity limit for an instrument or article that has an alternative activity limit for an exempt consignment.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817461" lims:id="817461"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817462" lims:id="817462">Application for certification of design</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817463" lims:id="817463"><Label>(1)</Label><Text>An application for certification of a design for the types of prescribed equipment referred to in subsection <XRefInternal>10</XRefInternal>(1) must include the information required for the applicable approval under the IAEA Regulations and</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817464" lims:id="817464"><Label>(a)</Label><Text>the number of any applicable approval issued by a foreign competent authority, in accordance with the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817465" lims:id="817465"><Label>(b)</Label><Text>in respect of a package design,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817466" lims:id="817466"><Label>(i)</Label><Text>the recommended inspection and servicing program, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817467" lims:id="817467"><Label>(ii)</Label><Text>instructions for packing, transport, receiving, maintenance and unpacking; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817468" lims:id="817468"><Label>(c)</Label><Text>any other information necessary to demonstrate that the design meets the requirements of these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817469" lims:id="817469"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817470" lims:id="817470">Observing of test</MarginalNote><Label>(2)</Label><Text>An applicant must give the Commission, or a designated officer, a reasonable opportunity to observe any test that the applicant intends to conduct to demonstrate the compliance of a design with these Regulations, including reasonable notice of the date and time of the test.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817471" lims:id="817471"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817472" lims:id="817472">New application for certification</MarginalNote><Label>(3)</Label><Text>No later than 60 days after the day on which the certificate of a design expires, an applicant may make a new application to the Commission or a designated officer to certify the design if the technical specifications of the design have not been modified. The application must include</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817473" lims:id="817473"><Label>(a)</Label><Text>a statement confirming that the drawings and procedures previously submitted have not been modified or, if they have been modified, a copy of the revised drawings and procedures and a statement confirming that the modifications are without technical significance and do not affect the safety of the design;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817474" lims:id="817474"><Label>(b)</Label><Text>a statement confirming that each type of prescribed equipment referred to in subsection <XRefInternal>10</XRefInternal>(1) has been produced and maintained in compliance with the drawings and procedures previously submitted;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817475" lims:id="817475"><Label>(c)</Label><Text>a statement confirming that the instructions previously submitted in respect of the certified design have not been modified;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817476" lims:id="817476"><Label>(d)</Label><Text>unless previously submitted, the model number and drawings of any capsule containing radioactive material;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817477" lims:id="817477"><Label>(e)</Label><Text>a list of the serial numbers used for the certified design, other than a certified design referred to in paragraph (f);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817478" lims:id="817478"><Label>(f)</Label><Text>in respect of a design that was certified after approval by a foreign competent authority in accordance with the IAEA Regulations, a list of the serial numbers currently in use or intended for use in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817479" lims:id="817479"><Label>(g)</Label><Text>a list of the known users in Canada of the latest certified design;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817480" lims:id="817480"><Label>(h)</Label><Text>a summary of the maintenance performed and any operational or maintenance problems encountered with the certified design, including the date, the nature of the problem and any action taken;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817481" lims:id="817481"><Label>(i)</Label><Text>a copy of any applicable approval issued by the foreign competent authority in accordance with the IAEA Regulations since the last certification;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817482" lims:id="817482"><Label>(j)</Label><Text>a copy of the documents submitted to the foreign competent authority to obtain each approval; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817483" lims:id="817483"><Label>(k)</Label><Text>any other information necessary to demonstrate that the design meets the applicable requirements of these Regulations.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817484" lims:id="817484"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817485" lims:id="817485">Application for certification of subcriticality</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817486" lims:id="817486"><Label>(1)</Label><Text>An application for certification of the calculation referred to in subsection <XRefInternal>10</XRefInternal>(3) must include</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817487" lims:id="817487"><Label>(a)</Label><Text>a description of the fissile-excepted radioactive material, including its name, chemical form and physical state;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817488" lims:id="817488"><Label>(b)</Label><Text>the calculation of a value demonstrating that the material will remain subcritical without the need for accumulation control under the conditions described in the IAEA Regulations, including tests performed, principles used, assumptions made, scenarios considered, limitations that should be applied and any data, formulae or analysis tool used;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817489" lims:id="817489"><Label>(c)</Label><Text>in respect of the calculation, a copy of any applicable approval issued by a foreign competent authority in accordance with the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817490" lims:id="817490"><Label>(d)</Label><Text>in respect of a special form radioactive material, a copy of any applicable approval issued by a foreign competent authority in accordance with the IAEA Regulations or a copy of any applicable certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817491" lims:id="817491"><Label>(e)</Label><Text>in respect of low dispersible radioactive material, a copy of any applicable certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817492" lims:id="817492"><Label>(f)</Label><Text>details of the applicable management system;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817493" lims:id="817493"><Label>(g)</Label><Text>details of any actions needed to be taken before shipment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817494" lims:id="817494"><Label>(h)</Label><Text>any other information necessary to demonstrate that the calculation meets the applicable requirements of these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817495" lims:id="817495"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817496" lims:id="817496">New application for certification</MarginalNote><Label>(2)</Label><Text>No later than 60 days after the day on which the certificate expires, an applicant may make a new application for certification to the Commission or a designated officer if the calculation of the value has not been modified. The application must include</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817497" lims:id="817497"><Label>(a)</Label><Text>a statement confirming that the calculation of a value demonstrating that the material will remain subcritical without the need for accumulation control under the conditions described in the IAEA Regulations has not been modified and that the tests performed, principles used, assumptions made, scenarios considered, limitations that should be applied and any data, formulae or analysis tool used have not been modified;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817498" lims:id="817498"><Label>(b)</Label><Text>a copy of any applicable approval issued by the foreign competent authority in accordance with the IAEA Regulations since the last certification;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817499" lims:id="817499"><Label>(c)</Label><Text>a statement confirming that the details of the applicable management system and any actions needed to be taken before shipment that were previously submitted have not been modified; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817500" lims:id="817500"><Label>(d)</Label><Text>any other information necessary to demonstrate that the calculation meets the applicable requirements of these Regulations.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817501" lims:id="817501"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817502" lims:id="817502">Application for certification of calculated values</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817503" lims:id="817503"><Label>(1)</Label><Text>An application for certification of the calculation referred to in subsection <XRefInternal>10</XRefInternal>(4) must include</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817504" lims:id="817504"><Label>(a)</Label><Text>a description of the nuclear substance, including its name, chemical form and physical state;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817505" lims:id="817505"><Label>(b)</Label><Text>the calculation of the basic radionuclide value, including the principles used, assumptions made, scenarios considered and any data or formulae used to determine the value;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817506" lims:id="817506"><Label>(c)</Label><Text>a copy of any applicable approval issued by a foreign competent authority in accordance with the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817507" lims:id="817507"><Label>(d)</Label><Text>in respect of an instrument or article,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817508" lims:id="817508"><Label>(i)</Label><Text>details of the instrument or article that will contain the nuclear substance, including the identification, details of construction and intended uses of the instrument or article and the location of the nuclear substance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817509" lims:id="817509"><Label>(ii)</Label><Text>the maximum activity of the instrument or article,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817510" lims:id="817510"><Label>(iii)</Label><Text>the maximum external radiation level arising from the instrument or article,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817511" lims:id="817511"><Label>(iv)</Label><Text>details of the management system for the design and production of the instrument or article, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817512" lims:id="817512"><Label>(v)</Label><Text>instructions for the use, inspection, maintenance and disposal of the instrument or article; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817513" lims:id="817513"><Label>(e)</Label><Text>any other information necessary to demonstrate that the calculation meets the applicable requirements of these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817514" lims:id="817514"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817515" lims:id="817515">New application for certification</MarginalNote><Label>(2)</Label><Text>No later than 60 days after the day on which the certificate expires, an applicant may make a new application for certification to the Commission or a designated officer if the calculation has not been modified. The application must include</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817516" lims:id="817516"><Label>(a)</Label><Text>a statement confirming that the calculation of the basic radionuclide value, including the principles used, assumptions made, scenarios considered and any data or formulae used to determine the calculation, has not been modified;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817517" lims:id="817517"><Label>(b)</Label><Text>in respect of an instrument or article, a statement confirming that the information previously submitted has not been modified or, if it has been modified, the revised information and a statement confirming that the modifications are without technical significance and do not affect safety;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817518" lims:id="817518"><Label>(c)</Label><Text>a copy of any applicable approval issued by the foreign competent authority in accordance with the IAEA Regulations since the last certification;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817519" lims:id="817519"><Label>(d)</Label><Text>a statement confirming that the instructions previously submitted in respect of the certified calculation have not been modified; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817520" lims:id="817520"><Label>(e)</Label><Text>any other information necessary to demonstrate that the calculation meets the applicable requirements of these Regulations.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817521" lims:id="817521"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817522" lims:id="817522">Application for certification</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817523" lims:id="817523"><Label>(1)</Label><Text>The applications for certification referred to in sections <XRefInternal>11</XRefInternal> to <XRefInternal>13</XRefInternal> must be made to the Commission or a designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817524" lims:id="817524"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817525" lims:id="817525">Modifications requiring new certification</MarginalNote><Label>(2)</Label><Text>If the certified design or calculation referred to in section <XRefInternal>10</XRefInternal> has been modified in a manner that affects the safety of the prescribed equipment referred to in that section, the certificate is void and a new application for certification must be made.</Text></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817526" lims:id="817526"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817527" lims:id="817527">Notice of refusal to certify</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817528" lims:id="817528"><Label>(1)</Label><Text>The Commission, or the designated officer, must notify a person who has applied for certification of a proposed decision not to certify, as well as the basis for the proposed decision, at least 30 days before making the decision.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817529" lims:id="817529"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817530" lims:id="817530">Right to be heard</MarginalNote><Label>(2)</Label><Text>The notice must include a description of the person’s right to be provided with an opportunity to be heard in accordance with section <XRefInternal>17</XRefInternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817531" lims:id="817531"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817532" lims:id="817532">Notice of decertification</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817533" lims:id="817533"><Label>(1)</Label><Text>The Commission, or the designated officer, must notify a person to whom a certificate has been issued and, in the case of a certificate for a package design, any registered user of a package of that design, of a proposed decision to decertify, as well as the basis for the proposed decision, at least 30 days before making the decision.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817534" lims:id="817534"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817535" lims:id="817535">Right to be heard</MarginalNote><Label>(2)</Label><Text>The notice must include a description of the person’s and the registered user’s right to be provided with an opportunity to be heard in accordance with section <XRefInternal>17</XRefInternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817536" lims:id="817536"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817537" lims:id="817537">Opportunity to be heard</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817538" lims:id="817538"><Label>(1)</Label><Text>The Commission, or the designated officer, must provide the person referred to in section <XRefInternal>15</XRefInternal> or <XRefInternal>16</XRefInternal> or the registered user referred to in section <XRefInternal>16</XRefInternal> with an opportunity, in respect of the proposed decision, to be heard either orally or in writing if, within 30 days after the date of the notice, they request that opportunity.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817539" lims:id="817539"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817540" lims:id="817540">Notification of final decision</MarginalNote><Label>(2)</Label><Text>Every person and registered user who is notified in accordance with section <XRefInternal>15</XRefInternal> or <XRefInternal>16</XRefInternal> must be notified of the final decision and the reasons for it.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817541" lims:id="817541" level="1"><TitleText>Production, Use and Possession of Prescribed Equipment</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817542" lims:id="817542"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817543" lims:id="817543">Producing package of certified design</MarginalNote><Label>18</Label><Text>Every person who produces a package of a certified design must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817544" lims:id="817544"><Label>(a)</Label><Text>produce the package in accordance with the requirements set out in the certificate; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817545" lims:id="817545"><Label>(b)</Label><Text>clearly mark the package with the certificate number, design number and serial number.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817546" lims:id="817546"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817547" lims:id="817547">Application for registration</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817548" lims:id="817548"><Label>(1)</Label><Text>A person who intends to use a package of a certified design must apply to the Commission to register their use of the package.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817549" lims:id="817549"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817550" lims:id="817550">Information for registration</MarginalNote><Label>(2)</Label><Text>The Commission must register the applicant’s intended use of the package on receipt of an application containing the following:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817551" lims:id="817551"><Label>(a)</Label><Text>the applicant’s contact information, including, as applicable, their name, postal address, email address, telephone number and fax number;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817552" lims:id="817552"><Label>(b)</Label><Text>the name of a person who can be contacted for transport purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817553" lims:id="817553"><Label>(c)</Label><Text>the number of any licence that the applicant holds in respect of the contents of the package;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817554" lims:id="817554"><Label>(d)</Label><Text>the number of any applicable approval issued by a foreign competent authority in accordance with the IAEA Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817555" lims:id="817555"><Label>(e)</Label><Text>the package’s design and serial numbers; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817556" lims:id="817556"><Label>(f)</Label><Text>a statement confirming that the applicant possesses the instructions necessary to prepare the package for shipment, as set out in the certificate for the a value demonstrating that the material will remain subcritical must do so in accordance with the requirements set out in the certificate.</Text></Subsection><Subsection transport, radioactive material must comply with the requirements of the <XRefExternal reference-type="regulation" link="SOR-2001-286">Transportation of Dangerous Goods whose transport does not meet all of the requirements of these Regulations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817620" lims:id="817620"><Label>(iii)</Label><Text>a nuclear substance whose transport requires a special use vessel,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817621" lims:id="817621"><Label>(iv)</Label><Text>a nuclear substance whose transport requires multilateral approval of shipments in accordance with the IAEA Regulations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817622" lims:id="817622"><Label>(v)</Label><Text>a package that is in transit and is of a design that has been approved as a Type B(U)-96 or Type C-96 package by a foreign competent authority in accordance with the IAEA Regulations;</Text></Subparagraph></Paragraph><Paragraph excluded from the definition of fissile material nor excepted from the provisions applicable to fissile material in the editions of those Regulations issued after 2009, the package may be transported, consignor only and in a conveyance that is not carrying passengers,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817675" lims:id="817675"><Label>(ii)</Label><Text>the package or overpack is transported in a conveyance that displays on each side and on each end a placard for Class <XRefInternal>7</XRefInternal> radioactive materials as set out in the Appendix to Part 4 of the <XRefExternal reference-type="regulation" link="SOR-2001-286">Transportation of Dangerous Goods Regulations</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817676" lims:id="817676"><Label>(iii)</Label><Text>both the package and the overpack, if one is used, are clearly marked with the word “RADIOACTIVE” or “<Language xml:lang="fr">RADIOACTIF</Language>”;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817677" lims:id="817677"><Label>(b)</Label><Text>the package is an excepted package; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817678" lims:id="817678"><Label>(c)</Label><Text>the package or overpack contains only LSA-I material other than uranium hexafluoride and</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817679" lims:id="817679"><Label>(i)</Label><Text>the package or overpack is transported with goods from one consignor only and in a conveyance that is not carrying passengers,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817680" lims:id="817680"><Label>(ii)</Label><Text>the package or overpack is only loaded at the consignor’s location and unloaded at the consignee’s location,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817681" lims:id="817681"><Label>(iii)</Label><Text>the package or overpack is transported by road in a conveyance or freight container that displays on each side and on each end a placard for Class 7 radioactive materials as set out in the Appendix to Part 4 of the <XRefExternal reference-type="regulation" link="SOR-2001-286">Transportation of Dangerous Goods Regulations</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817682" lims:id="817682"><Label>(iv)</Label><Text>both the package and the overpack, if one is used, are clearly marked with the words “RADIOACTIVE LSA-I” or “LSA-I <Language xml:lang="fr">RADIOACTIF</Language>”.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817683" lims:id="817683"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817684" lims:id="817684">Definition</MarginalNote><Label>(3)</Label><Text>For the purpose of subsection (2), <DefinedTermEn>certified</DefinedTermEn> and <DefinedTermEn>exposure device</DefinedTermEn> have the same meaning as in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2000-207">Nuclear Substances and Radiation Devices Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817685" lims:id="817690">Particulars of consignment</MarginalNote><Label>29</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817691" lims:id="817691"><Label>(1)</Label><Text>Every consignor of radioactive material must include in the transport documents for the consignment the particulars of consignment that are required by the IAEA Regulations, which particulars must be clearly and indelibly printed.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817692" lims:id="817692"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817693" lims:id="817693">Exceptions</MarginalNote><Label>(2)</Label><Text>Subsection (1) does not apply</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817694" lims:id="817694"><Label>(a)</Label><Text>to an excepted package if the transport documents contain the following information:</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817695" lims:id="817695"><Label>(i)</Label><Text>the identification of the consignor and consignee,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817696" lims:id="817696"><Label>(ii)</Label><Text>the United Nations number assigned to the material as set out in the IAEA Regulations, preceded by the letters “UN”,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817697" lims:id="817697"><Label>(iii)</Label><Text>the proper shipping name as set out in the IAEA Regulations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817698" lims:id="817698"><Label>(iv)</Label><Text>the identification mark for the certification described in each of sections <XRefInternal>12</XRefInternal> to <XRefInternal>14</XRefInternal>, as applicable, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817699" lims:id="817699"><Label>(v)</Label><Text>the identification mark of any applicable special form radioactive material approval issued by a foreign competent authority in accordance with the IAEA reference-type="other">Technical Instructions for the Safe Transport of Dangerous Goods by Air</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817701" lims:id="817701"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817702" lims:id="817702">Obligation</MarginalNote><Label>(3)</Label><Text>Every carrier who transports a consignment of radioactive material must ensure that it is accompanied by the transport documents referred to in subsection (1) or (2).</Text></Subsection><Subsection devices</MarginalNote><Label>(4)</Label><Text>The transport documents in respect of radioactive material that is in an exposure device, referred to in paragraph <XRefInternal>28</XRefInternal>(2)(a), transported in accordance with that paragraph do not need to meet the requirements set out in the IAEA Regulations for the category of the package and transport transports excepted packages, must implement a radiation protection program and must, as part of that program,</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817713" lims:id="817713"><Label>(a)</Label><Text>keep the amount of exposure to radon progeny and the effective dose and equivalent dose received by and committed to persons as low as reasonably achievable, lims:id="817714"><Label>(i)</Label><Text>management control over work practices,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817715" lims:id="817715"><Label>(ii)</Label><Text>personnel qualification and training,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817716" lims:id="817716"><Label>(iii)</Label><Text>control of exposure to radiation by personnel and the public, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817717" lims:id="817717"><Label>(iv)</Label><Text>planning for unusual situations;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817718" lims:id="817718"><Label>(b)</Label><Text>prevent persons from receiving doses of radiation higher than the radiation dose limits prescribed by the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817719" lims:id="817719"><Label>(c)</Label><Text>assess the radiation at the workplace and</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817720" lims:id="817720"><Label>(i)</Label><Text>conduct workplace or individual monitoring if it may reasonably be expected that the doses of radiation received by persons at the workplace will be 1 mSv or more but less than 5 mSv a year, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817721" lims:id="817721"><Label>(ii)</Label><Text>conduct individual monitoring if it may reasonably be expected that the doses of radiation received by persons at the workplace will be 5 mSv a year or more; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817722" lims:id="817722"><Label>(d)</Label><Text>train the persons referred to in the program on the application of the program.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817723" lims:id="817723"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817724" lims:id="817724">Requirement to keep records</MarginalNote><Label>(2)</Label><Text>Every consignor, carrier or consignee must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817725" lims:id="817725"><Label>(a)</Label><Text>keep a record documenting their radiation protection program and of any information collected under it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817726" lims:id="817726"><Label>(b)</Label><Text>retain the record for a period ending two years after the day on which the information is collected.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817727" lims:id="817727"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817728" lims:id="817728">When dose limit exceeded</MarginalNote><Label>32</Label><Text>Every consignor, carrier or consignee who becomes aware that a dose of radiation received by a person may have exceeded an applicable dose limit prescribed by the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal> must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817729" lims:id="817729"><Label>(a)</Label><Text>immediately notify the person and the Commission of the dose;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817730" lims:id="817730"><Label>(b)</Label><Text>conduct an investigation to determine the magnitude of the dose and to establish the causes of the exposure;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817731" lims:id="817731"><Label>(c)</Label><Text>take any action required to prevent the occurrence of a similar incident; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817732" lims:id="817732"><Label>(d)</Label><Text>within 21 days after becoming aware that the dose limit may have been exceeded, report to the Commission the results of the investigation or the progress that has been made in conducting it.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817733" lims:id="817733"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817734" lims:id="817734">Provision of information</MarginalNote><Label>33</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817735" lims:id="817735"><Label>(1)</Label><Text>Every consignor, carrier or consignee must inform every nuclear energy worker that they employ, in writing,</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817736" lims:id="817736"><Label>(a)</Label><Text>of the fact that the worker is a nuclear energy worker;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817737" lims:id="817737"><Label>(b)</Label><Text>of the risks associated with the radiation to which the worker may be exposed in the course of their work, including the risks associated with the exposure of embryos and foetuses to radiation;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817738" lims:id="817738"><Label>(c)</Label><Text>of the applicable effective dose limits and equivalent dose limits prescribed by sections 13 and 14, respectively, of the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817739" lims:id="817739"><Label>(d)</Label><Text>of the worker’s radiation dose levels.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817740" lims:id="817740"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817741" lims:id="817741">Obligation to inform</MarginalNote><Label>(2)</Label><Text>In the case of a female nuclear energy worker, the consignor, carrier or consignee must</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817742" lims:id="817742"><Label>(a)</Label><Text>inform her, in writing, that she is required, as soon as she is aware that she is pregnant, to inform her employer of that fact in writing;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817743" lims:id="817743"><Label>(b)</Label><Text>inform her, in writing, of the applicable effective dose limits prescribed by the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817744" lims:id="817744"><Label>(c)</Label><Text>on being informed of the pregnancy, make any accommodation that will not result in costs or business inconvenience constituting undue hardship to it to comply with the effective dose limits prescribed by section 13 of the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817745" lims:id="817745"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817746" lims:id="817746">Acknowledgement of information</MarginalNote><Label>(3)</Label><Text>Every consignor, carrier or consignee must obtain from each nuclear energy worker that they employ who is informed of the matters referred to in paragraphs (1)(a) and (b) and subsection (2) a written acknowledgement that the worker has received the information.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817747" lims:id="817747" level="2"><TitleText>Personal Information</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817748" lims:id="817748"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817749" lims:id="817749">Collection of personal information</MarginalNote><Label>34</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817750" lims:id="817750"><Label>(1)</Label><Text>If a consignor, carrier or consignee collects personal information, as defined in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>, that may be required to be disclosed to the Commission, another government institution, as defined in that section, or a dosimetry service, the consignor, carrier or consignee must inform the person to whom the information relates of the purpose for which it is being collected.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817751" lims:id="817751"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817752" lims:id="817752">Required information</MarginalNote><Label>(2)</Label><Text>Every nuclear energy worker whose work requires that they engage in activities that are subject to these Regulations must provide the following information to their employer:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817753" lims:id="817753"><Label>(a)</Label><Text>their given names, surname and any previous surname;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817754" lims:id="817754"><Label>(b)</Label><Text>their Social Insurance Number;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817755" lims:id="817755"><Label>(c)</Label><Text>their gender;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817756" lims:id="817756"><Label>(d)</Label><Text>their date, province and country of birth; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817757" lims:id="817757"><Label>(e)</Label><Text>their dose record, as applicable, for the current one-year dosimetry period and five-year dosimetry period as those terms are defined in subsection 1(1) of the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817758" lims:id="817758" level="2"><TitleText>Dangerous Occurrences</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817759" lims:id="817759"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817760" lims:id="817760">Interpretation</MarginalNote><Label>35</Label><Text>For the purpose of sections <XRefInternal>36</XRefInternal> to <XRefInternal>38</XRefInternal>, a dangerous occurrence is any of the following situations:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817761" lims:id="817761"><Label>(a)</Label><Text>a conveyance carrying radioactive material is involved in an accident;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817762" lims:id="817762"><Label>(b)</Label><Text>a package shows evidence of damage, tampering or leakage of its contents, or its integrity is degraded in a manner that may reasonably be expected to impair its ability to comply with these Regulations or its certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817763" lims:id="817763"><Label>(c)</Label><Text>radioactive material is lost, stolen or no longer in the control of a person who is required to have control of it under the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817764" lims:id="817764"><Label>(d)</Label><Text>radioactive material has escaped from a containment system, a package or a conveyance during transport;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817765" lims:id="817765"><Label>(e)</Label><Text>fissile material is outside the confinement system during transport;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817766" lims:id="817766"><Label>(f)</Label><Text>the level of non-fixed contamination, as defined in the IAEA Regulations, during transport exceeds the following limits as applicable when averaged over any area of 300 cm<Sup>2</Sup> of any part of the surface of the package or the conveyance:</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817767" lims:id="817767"><Label>(i)</Label><Text>4 Bq/cm<Sup>2</Sup> for beta and gamma emitters and low toxicity alpha emitters, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817768" lims:id="817768"><Label>(ii)</Label><Text>0.4 Bq/cm<Sup>2</Sup> for all other alpha emitters;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817769" lims:id="817769"><Label>(g)</Label><Text>there is a failure to comply with the provisions of the Act, the provisions of these Regulations or any licence or certificate that is applicable to a package that may reasonably be expected to lead to a situation in which the environment, the health and safety of persons or national security is adversely affected.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817770" lims:id="817770"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817771" lims:id="817771">Obligations in event of dangerous occurrence</MarginalNote><Label>36</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817772" lims:id="817772"><Label>(1)</Label><Text>The consignor, carrier or consignee of a package or radioactive material involved in a dangerous occurrence or any other person who controls any area affected by a dangerous occurrence must immediately</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817773" lims:id="817773"><Label>(a)</Label><Text>limit, to the extent possible, the dispersal of any radioactive material;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817774" lims:id="817774"><Label>(b)</Label><Text>place barriers, signs or personnel at every point of entry into the affected area to control the entry of persons into that area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817775" lims:id="817775"><Label>(c)</Label><Text>record the name, postal address and telephone number of any person who may have been exposed to or contaminated by radioactive material and request that the person remain available for assessment by an expert in radiation protection.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817776" lims:id="817776"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817777" lims:id="817777">Expert assessment</MarginalNote><Label>(2)</Label><Text>As soon as feasible after a dangerous occurrence has occurred the consignor, carrier or consignee of the package or radioactive material involved in the occurrence must have an expert in radiation protection assess the situation. and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817795" lims:id="817795"><Label>(g)</Label><Text>the actions taken to remedy the failure to comply or the dangerous occurrence and to prevent its recurrence.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-06-12" lims:fid="817796" lims:id="817796" level="1"><TitleText>Miscellaneous Provisions</TitleText></Heading><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817797" lims:id="817797"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817798" lims:id="817798"><DefinitionRef>Release</DefinitionRef> under <XRefExternal reference-type="regulation">Transportation of Dangerous Goods Act, 1992</XRefExternal></MarginalNote><Label>39</Label><Text>For the purpose of the definition <DefinitionRef>release</DefinitionRef> in section 2 of the <XRefExternal reference-type="act" link="T-19.01">Transportation of Dangerous Goods Act, 1992</XRefExternal>, the following levels of ionizing radiation are established:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817799" lims:id="817799"><Label>(a)</Label><Text>in respect of a package that is being transported under exclusive use,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817800" lims:id="817800"><Label>(i)</Label><Text>10 mSv/h on the external surface of the package,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817801" lims:id="817801"><Label>(ii)</Label><Text>2 mSv/h on the surface of the conveyance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817802" lims:id="817802"><Label>(iii)</Label><Text>0.1 mSv/h at a distance of 2 m from the surface of the conveyance; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817803" lims:id="817803"><Label>(b)</Label><Text>in respect of a package that is not being transported under exclusive use,</Text><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817804" lims:id="817804"><Label>(i)</Label><Text>2 mSv/h on the external surface of the package,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817805" lims:id="817805"><Label>(ii)</Label><Text>0.1 mSv/h at a distance of 1 m from the package,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817806" lims:id="817806"><Label>(iii)</Label><Text>2 mSv/h on the surface of the conveyance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-12" lims:fid="817807" lims:id="817807"><Label>(iv)</Label><Text>0.1 mSv/h at a distance of 2 m from the surface of the conveyance.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2015-06-12" lims:lastAmendedDate="2015-06-12" lims:fid="817808" lims:id="817808"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817809" lims:id="817809">Opening of packages</MarginalNote><Label>40</Label><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817810" lims:id="817810"><Label>(1)</Label><Text>A person, other than the consignor or the consignee of the package, may open a package only if</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817811" lims:id="817811"><Label>(a)</Label><Text>measures are taken to prevent persons from receiving doses of radiation higher than the radiation dose limits prescribed by the <XRefExternal reference-type="regulation" link="SOR-2000-203">Radiation Protection Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817812" lims:id="817812"><Label>(b)</Label><Text>the package is opened in the presence of an expert in radiation protection.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817813" lims:id="817813"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817814" lims:id="817814">Restoring opened package</MarginalNote><Label>(2)</Label><Text>If a person other than the consignor or the consignee opens a package while in transport, the person must restore the package to a condition that meets the requirements of these Regulations before forwarding it to the consignee.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-12" lims:fid="817815" lims:id="817815"><MarginalNote lims:inforce-start-date="2015-06-12" lims:fid="817816" lims:id="817816">Responsibilities on opening package</MarginalNote><Label>(3)</Label><Text>Every person who receives a package or who opens a package must, at that time, determine if any of the following conditions exist:</Text><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817817" lims:id="817817"><Label>(a)</Label><Text>the package is damaged;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817818" lims:id="817818"><Label>(b)</Label><Text>the package has been tampered with;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-12" lims:fid="817819" lims:id="817819"><Label>(c)</Label><Text>if the package contains fissile material, whether any portion of the fissile material is outside the confinement system;
