(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871283" lims:id="871283" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part I of the schedule; (<DefinedTermFr>point de repère de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871284" lims:id="871284" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871285" lims:id="871285" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871286" lims:id="871286" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871287" lims:id="871287" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="871288" lims:id="871288" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871289" lims:id="871289"><Label>(2)</Label><Text>For the purposes of these Regulations, the assigned elevation of the airport reference point is 653 feet above sea level.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871290" lims:id="871290" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871291" lims:id="871291"><Label>3</Label><Text>These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871292" lims:id="871292"><Label>(a)</Label><Text>the lands within, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871293" lims:id="871293"><Label>(b)</Label><Text>the lands directly under that portion of an approach surface that extends beyond</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="871294" lims:id="871294"><Text>the outer limits described in Part II of the schedule.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871295" lims:id="871295" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871296" lims:id="871296"><Label>4</Label><Text>No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point, any</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871297" lims:id="871297"><Label>(a)</Label><Text>approach surface;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871298" lims:id="871298"><Label>(b)</Label><Text>outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871299" lims:id="871299"><Label>(c)</Label><Text>transitional surface.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871300" lims:id="871300" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871301" lims:id="871301"><Label>5</Label><Text>Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 4, the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871302" lims:id="871302" level="1"><TitleText>Disposal of Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871303" lims:id="871303"><Label>6</Label><Text>No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal or accumulation of any waste, material or substance edible by or attractive to birds.</Text></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871304" lims:id="871304" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="871305" lims:id="871305"><Label>SCHEDULE</Label><OriginatingRef>(ss. 2 and 3)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="871306" lims:id="871306" level="1"><Label>PART I</Label><TitleText>Description of the Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871307" lims:id="871307" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point is a point commencing at the point of intersection of the centre lines of runways 08-26 and 14-32; THENCE south 03°55′30″ east, a distance of 2,000 feet; THENCE north 86°04′30″ east, a distance of 500 feet, being the airport reference point.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="871308" lims:id="871308" level="1"><Label>PART II</Label><TitleText>Description of the Outer Limits of Lands</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871309" lims:id="871309" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The following described boundaries are the outer limits of lands:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="871310" lims:id="871310" format-ref="indent-2-1" language-align="no" list-item="no"><Text>COMMENCING at the most southerly corner of lot nine hundred and fifteen (915), Group nine hundred and sixty-four (964), Plan 56823 C.L.S.R., 686 L.T.O.; THENCE northwesterly along the southwesterly limit of said lot a distance of sixty-five (65) feet more or less to intersect the imaginary circumference of a circle having a radius of thirteen thousand (13,000) feet, centered at the airport reference point, described in schedule Part I hereto attached; THENCE southwesterly in a clockwise direction along the said circumference to the point of intersection with the easterly limit block five hundred and one (501), Plan 58549 C.L.S.R. 900 L.T.O.; THENCE southerly along the easterly and southeasterly limits of said block and block five hundred and two (502), to the southeasterly corner of lot twenty-five (25), in the said block five hundred and two (502); THENCE northwesterly along the southerly limits of lots twenty-five (25), sixteen (16), and five (5), and their productions across the intervening street, all in said block five hundred and two (502), and the straight production westerly across lot thirty-one (31), and the right-of-way shown on Plan 40399 C.L.S.R. 83 L.T.O. to intersect the northwesterly limit of said right-of-way and its production across roadway to intersect with the straight production southeasterly of the southwesterly limit of the road on the southerly portion of Plan 64044 C.L.S.R.; THENCE northwesterly along the said southwesterly limit and its production a distance of three hundred and twenty (320) feet more or less to its intersection with the imaginary circumference of the above-mentioned circle; THENCE southwesterly in a clockwise direction to its intersection with the westerly limit of the power line right-of-way Plan 3981 C.L.S.R. L.T.O. 621; THENCE southerly following the said westerly limit and its productions across intervening streets and lanes to its intersection with the southern limit of block one hundred and forty-six (146), Plan 58510 C.L.S.R. L.T.O. 863; THENCE northeasterly along the southern limit of said block to the southeasterly corner of block one hundred and forty-four (144), Plan 56856 C.L.S.R. 687 L.T.O.; THENCE easterly along the southern limit of said block to the southwest corner thereof; THENCE westerly and southwesterly along the south and southeasterly limit of lot nine hundred and fifteen (915), group nine hundred and sixty-four (964), Plan 56823 C.L.S.R. 686 L.T.O. to the point of commencement.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="871311" lims:id="871311" level="1"><Label>PART III</Label><TitleText>Description of the Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871312" lims:id="871312" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, shown on Department of Transport Yellowknife Zoning Plan dated March 31, 1978, are surfaces abutting each end of the strips associated with the runways designated 08-26 and 14-32 and are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="871313" lims:id="871313" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>a surface abutting the end of the strip associated with runway approach 08,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="871314" lims:id="871314" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>a surface abutting the end of the strip associated with runway approach 26,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="871315" lims:id="871315" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>a surface abutting the end of the strip associated with runway approach 14, and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="871316" lims:id="871316" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>a surface abutting the end of the strip associated with runway approach 32,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="871317" lims:id="871317" format-ref="indent-0-0" language-align="no" list-item="no"><Text>consisting of an inclined plane having a ratio of one foot measured vertically to 50 feet measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of each strip 1,000 feet measured vertically above the elevation at the end of each strip and 50,000 feet measured horizontally from the end of each strip, the outer ends of each imaginary horizontal line being 8,000 feet from each projected centre line.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="871318" lims:id="871318" level="1"><Label>PART IV</Label><TitleText>Description of the Outer Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871319" lims:id="871319" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, shown on Department of Transport Yellowknife Zoning Plan dated March 31, 1978, is an imaginary surface located at a common plane established at a constant elevation of 150 feet above the assigned elevation of the airport reference point, except where that common plane is less than 30 feet above the surface of the ground, the imaginary surface is located at 30 feet above the surface of the ground.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="871320" lims:id="871320" level="1"><Label>PART V</Label><TitleText>Description of the Strips</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871321" lims:id="871321" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips, shown on Department of Transport Yellowknife Zoning Plan dated March 31, 1978, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="871322" lims:id="871322" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the strip associated with runway 08-26 is 1,000 feet in width, 500 feet being on each side of the centre line of the runway and 6,400 feet in length, 200 feet extending beyond each end of the runway; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="871323" lims:id="871323" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the strip associated with runway 14-32 is 1,000 feet in width, 500 feet being on each side of the centre line of the runway and 8,400 feet in length, 200 feet extending beyond each end of the runway.</Text></Provision></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="871324" lims:id="871324" level="1"><Label>PART VI</Label><TitleText>Description of Each Transitional Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="871325" lims:id="871325" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Each transitional surface, shown on Department of Transport Yellowknife Zoning Plan dated March 31, 1978, is a surface consisting of an inclined plane having a ratio of one foot measured vertically to seven feet measured horizontally at right angles to the centre line and centre line production of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface, an approach surface or another transitional surface of an adjoining strip.</Text></Provision></Schedule></Regulation>
