His Excellency the Governor General in Council, on the recommendation of the President of the Privy Council and the Chief Electoral Officer, pursuant to subsections 198(1), 202(1) and 204(2) of the Canada Elections Act, as adapted by regulations made by the Chief Electoral Officer on July 14, 1992* pursuant to section 7 of the Referendum Act**, and subsection 198(2) of the Canada Elections Act as that provision applies pursuant to subsection 7(1) of the Referendum Act**, is pleased hereby to make the annexed Tariff of fees, costs, allowances and expenses to be paid and allowed to returning officers and other persons employed at or with respect to a referendum under the Referendum Act, effective July 1, 1992.*SOR/92-430, 1992 Canada Gazette Part II, p. 3126**S.C. 1992, c. 30Short Title

1This Tariff may be cited as the Federal Referendum Fees Tariff.

Interpretation

2In this Tariff,Act means the Referendum Act; (Loi)supervising deputy returning officer means an individual who supervises the deputy returning officers of five or more polling stations located in a central polling place. (scrutateur principal)

General

3The fees, costs, allowances and expenses set out in the schedule shall be paid and allowed to returning officers and other persons employed at or with respect to a referendum under the Act other than persons to whom the Special Voting Rules Referendum Fees Tariff applies.

4The population figures referred to in the schedule shall be based on the most recent census of population under subsection 19(1) of the Statistics Act.

5(1)The rates for travel and living expenses referred to in items 3, 4, 6 and 7 of the schedule are the rates set out in the Treasury Board Travel Directive that are in effect at the time the services are performed.(2)The rates for travel and living expenses referred to in items 1, 5, 12, 14, 16, 27, 31, 32, 35 and 38 of the schedule are the rates set out in the Treasury Board Travel Directive that are in effect at the time writs are issued.

6The Chief Electoral Officer may determine a rate of remuneration and may set fees for the performance of any service performed pursuant to the Act by any person other than those persons referred to in items 1 to 38 of the schedule.

Increases

7Where the amounts provided in any of items 1 to 38 of the schedule do not, by reason of the size or character of the electoral district, or by reason of other special circumstances, constitute sufficient remuneration to referendum officers and other persons employed in connection with the conduct of a referendum, including printers and landlords of premises used for the purpose of the referendum, the Chief Electoral Officer may authorize the payment of an additional amount to provide sufficient remuneration.

SCHEDULE(Sections 3 to 7)Fees, Costs, Allowances and Expenses Payable to Referendum OfficersReturning Officers and StaffDuring a Referendum1 (1)Each returning officer shall be paid, for services performed by the returning officer during a referendum, a fee based on the population of the electoral district in respect of which the returning officer is appointed, as follows:(a)where a poll is held and the returning officer is appointed in respect of an electoral district in which the population is(i)60,000 or less $ 13,143.00(ii)greater than 60,000 and not greater than 70,000 14,527.00(iii)greater than 70,000 and not greater than 90,000 15,910.00(iv)greater than 90,000 and not greater than 110,000 17,294.00(v)greater than 110,000 18,677.00(b)where a poll is not held and enumeration has taken place 2/3 of the amount payable under paragraph (a)(c)where a poll is not held and enumeration has not taken place 1/3 of the amount payable under paragraph (a)(2)For attending a recount pursuant to section 29 of the Act and subsections 179(1) to (3), sections 181 and 182 and subsection 184(1) of the Canada Elections Act, for each hour of attendance as certified by the judge who recounts the votes, the returning officer shall be paid $ 27.67(3)Each returning officer shall be paid, for expenses incurred by the returning officer during a referendum, as follows:(a)for stationery, postage, telegrams, the rental of office equipment and furniture, telephone services and the transportation of referendum supplies, and other similar incidental expenses the actual and reasonable amount paid, as supported by vouchers(b)for the rental of the returning officer’s office in connection with the conduct of the referendum the actual and reasonable amount incurred, as supported by vouchers(c)for necessary travel in connection with the conduct of the referendum the allowances and expenses referred to in items 33 to 352 (1)Support staff at the office of the returning officer, including the staff required for the handling of ballot boxes and for the tabulation of referendum results immediately after the close of the polls on the ordinary polling day, shall be paid,(a)for the services of full-time support staff(i)where the population of the electoral district is 60,000 or less, one employee, who may be paid for up to a maximum of 338 hours of work, $ 9.50 per hour(ii)where the population of the electoral district is greater than 60,000 and not greater than 90,000, two employees, who may be paid for up to a maximum of 338 hours of work each, $ 19.00 per hour in total for the two employees(iii)where the population of the electoral district is greater than 90,000 and not greater than 110,000, three employees, who may be paid for up to a maximum of 338 hours of work each, $ 28.50 per hour in total for the three employees(iv)where the population of the electoral district is greater than 110,000, four employees, who may be paid for up to a maximum of 338 hours of work each, $ 38.00 per hour in total for the four employees(b)where full-time support staff referred to in paragraph (a) are required to provide services to the public in both official languages, in addition to the amount set out in paragraph (a), 10% of the amount paid under paragraph (a)(2)For the salary cost of additional support staff who may be required on a part-time basis during a referendum, the returning officer shall be provided with an accountable advance, based on the population of the electoral district, of $ 0.04 per person in the population(3)For the salary cost of support staff hired specifically for addressing and mailing the notice of enumeration cards to all electors included in the preliminary lists of electors, the returning officer shall be provided with an accountable advance of $ 0.07 per elector(4)For the salary cost of support staff hired specifically for affixing labels to notice of enumeration cards or detaching notices of enumeration from feed forms, when required, the returning officer shall be provided with an accountable advance of $ 0.02 per electorSpecial Assignments3Where at any time the Chief Electoral Officer requests a returning officer to carry out a special assignment, the returning officer shall be paid(a)a fee for all services performed in connection with that assignment, per hour, of $ 27.67(b)for travel and living expenses in connection with the services referred to in paragraph (a) the allowances and expenses referred to in item 33Information Sessions on Referendum Matters4Where the Chief Electoral Officer requests that a returning officer attend a training session or referendum debriefing session, the officer shall be paid(a)for each day of attendance at a training session $ 175.00(b)for each day of attendance at a referendum debriefing session 225.00(c)for travel between that officer’s place of residence and the place where the training or debriefing session is held, and for accommodation and living expenses at the place where the session is held if that place is not the place of residence of the officer the allowances and expenses referred to in item 33Assistant Returning OfficersDuring a Referendum5Each assistant returning officer shall be paid, for services performed and expenses incurred by the assistant returning officer during a referendum, as follows:(a)for services performed pursuant to the Act 75% of the amount received by a returning officer under subitem 1(1)(b)for necessary travel, other than in urban polling divisions, in connection with the conduct of the referendum the allowances and expenses referred to in item 33Special Assignments6Where at any time the Chief Electoral Officer requests an assistant returning officer to carry out a special assignment, the assistant returning officer shall be paid(a)a fee for all services performed in connection with that assignment, per hour, of $ 20.75(b)for travel and living expenses in connection with the services referred to in paragraph (a) the allowances and expenses referred to in item 33Information Sessions on Referendum Matters7Where the Chief Electoral Officer requests that an assistant returning officer attend a training session or referendum debriefing session, the officer shall be paid(a)for each day of attendance at a training session $ 175.00(b)for each day of attendance at a referendum debriefing session 166.00(c)for travel between that officer’s place of residence and the place where the training or debriefing session is held, and for accommodation and living expenses at the place where the session is held if that place is not the place of residence of the officer the allowances and expenses referred to in item 33Automation Coordinators8Each person appointed by a returning officer to act as a coordinator to establish by a computerized system the preliminary lists of electors shall be paid an hourly rate that does not exceed $ 18.00Printing and ReproductionNotice of Enumeration9In respect of the printing of the notice of enumeration in conformity with the specifications provided by the returning officer, a printer shall be paid an amount in respect of each polling division that does not exceed(a)for the first 100 copies $ 30.10(b)for each additional 50 copies or part thereof 3.54Ballots10In respect of the typesetting, printing, numbering and binding or stitching of ballot papers in accordance with the sample sheet of ballot paper and the specimen book of ballot papers supplied by the Chief Electoral Officer and in conformity with the specifications provided by the returning officer, a printer shall be paid an amount that does not exceed(a)for the first 1,000 ballots 86.78(b)for each additional 1,000 ballots 52.00Other Referendum Documents11In respect of the reproduction of the preliminary lists of electors, the Notice of the Grant of a Poll, and all other referendum documents required to be reproduced, a printer shall be paid for each copy of each original page, when reproduced in accordance with the instructions issued by the returning officer, an amount that does not exceed 0.10EnumerationEnumerators12 (1)Subject to subitem (3), each enumerator shall be paid, for the services performed by the enumerator in connection with the enumeration, a fee that is the greater of(a)an amount of 70.00and(b)an amount that is the sum of(i)in respect of the names of the first 200 electors included in the preliminary list of electors, $ 0.62 per nameand(ii)in respect of the names of electors in excess of 200 included in the preliminary list of electors, $ 0.93 per name(2)In addition to the fee paid under subitem (1), each enumerator shall be paid(a)for the typing of the necessary number of copies of the preliminary list of electors, where requested by the returning officer, $ 0.08 for the name of each elector included in the preliminary list of electors(b)for attending a training session on enumeration procedures arranged by the returning officer $ 25.00(c)for travel and incidental expenses,(i)for the first 70 kilometres or part thereof $ 23.00(ii)for each necessary kilometre in excess of the first 70 kilometres the allowance established by the Treasury Board Travel Directive(d)for all services performed by the enumerator in connection with the revision of the preliminary list of electors in a rural polling division $ 84.00(3)Where an enumerator enumerates more than one polling division, the fee payable to that enumerator shall be calculated on the basis of the number of electors who are in all polling divisions that the enumerator enumerated and whose names appear on the preliminary lists of electors.Stand-by Enumerators13Each stand-by enumerator shall be paid(a)for agreeing to be on stand-by 70.00(b)for attending a training session on enumeration procedures arranged by the returning officer 25.00Supervisory Enumerator14Each supervisory enumerator shall be paid(a)for services performed pursuant to instructions from the returning officer, for each hour of work up to a maximum of 30 hours 9.50(b)for attending a training session on enumeration procedures arranged by the returning officer 25.00(c)for travel and incidental expenses,(i)for the first 70 kilometres or part thereof 23.00(ii)for each necessary kilometre in excess of the first 70 kilometres the allowance established by the Treasury Board Travel DirectiveRevision of Lists of Electors in Urban Polling DivisionsRevising Officers15Each revising officer shall be paid(a)for all services performed by the revising officer, including sitting for revision, a fee that is the greater of(i)for every polling division included in the revisal district in respect of which the revising officer is appointed $  24.65and(ii)an amount of 246.50and(b)for postage the actual and reasonable amount paid, as supported by vouchersRevising Agents16Each revising agent and each stand-by revising agent shall be paid(a)for services the agent is requested to perform by the returning officer or the revising officer, for each hour of work $  7.00(b)for attending a training session on revision procedures arranged by the returning officer 25.00(c)for travel and incidental expenses in the performance of the revising agent’s services, the greater of(i)in respect of the number of kilometres travelled the allowance established by the Treasury Board Travel Directiveand(ii)an amount of $ 60.00Rental of Revisal Offices17Where a building or part thereof is used as a revisal office, the owner of that building shall be paid rent, including the costs of heating, lighting, cleaning and furniture, for each day the revising officer uses those premises, in an amount that does not exceed per day 77.80PollingDeputy Returning Officers and Supervising Deputy Returning Officers18Each person appointed to be a deputy returning officer for an advance poll shall be paid the following fee for all services the deputy returning officer performs, including the counting of the votes on the ordinary polling day 220.0019Each person appointed to be a deputy returning officer for a polling station or for the counting of the votes cast in the office of the returning officer on the ordinary polling day shall be paid the following fee for all services the deputy returning officer performs 139.0020Each person appointed to be a supervising deputy returning officer for a central polling place shall be paid the following fee for all services the supervising deputy returning officer performs 178.0021Each deputy returning officer, supervising deputy returning officer and stand-by deputy returning officer shall be paid the following fee for attending a training session on voting procedure arranged by a returning officer 25.00Poll Clerks22Each person appointed to be a poll clerk for an advance poll shall be paid the following fee for all services the poll clerk performs, including the counting of the votes on the ordinary polling day, 166.0023Each person appointed to be a poll clerk for a polling station or for the counting of the votes cast in the office of the returning officer on ordinary polling day shall be paid the following fee for all services the poll clerk performs 101.1524Each poll clerk and each stand-by poll clerk shall be paid the following fee for attending a training session on voting procedure arranged by a returning officer 25.00Rental of Polling Stations25Where a building or a part thereof is used as an advance polling station, the owner of that building shall be paid rent, including the costs of heating, lighting, cleaning and furniture, for the two days that the advance poll is open and for the counting of the votes on the ordinary polling day, in an amount that does not exceed, per advance poll 155.6026Where a building or a part thereof is used as a polling station, the owner of that building shall be paid rent, including the costs of heating, lighting, cleaning and furniture, for the use of the premises, in an amount that does not exceed, per polling station 77.80Messengers27Each messenger appointed by a returning officer with the prior authorization of the Chief Electoral Officer shall be paid(a)for each hour worked 9.50(b)for travel and living expenses at a place other than the messenger’s place of residence the allowances and expenses referred to in item 33Interpreters and Constables28 (1)Each interpreter at an advance polling station or polling station, appointed and sworn by the deputy returning officer and employed while the poll is open, shall be paid the following fee for each hour worked $11.00(2)Each constable at an advance polling station, appointed and sworn by the deputy returning officer or the returning officer and employed while the poll is open, shall be paid the following fee for each hour worked $ 7.00, not to exceed $112.00 in the aggregate(3)Each constable at a polling station, appointed and sworn by the deputy returning officer or the returning officer, shall be paid the following fee for each hour worked $ 7.00, not to exceed $84.00 in the aggregateSecurity Guards29Each returning officer shall be paid, for the services of security guards required by the returning officer during a referendum and hired with the prior authorization of the Chief Electoral Officer, the actual and reasonable amount incurred, as supported by vouchersWitnesses30Each elector called on by a returning officer to be a witness at the official addition of the votes, where there is not a representative present both from a group opposing and from a group supporting the referendum question, shall be paid the following fee for each hour worked $ 8.00Other Referendum OfficersAdditional Assistant Returning Officers31Each assistant returning officer appointed under paragraph 18(2)(a) of the Canada Elections Act shall be paid(a)for all services performed in connection with the conduct of a referendum in the designated area in respect of which the assistant returning officer is appointed, for each hour of work authorized by the returning officer 20.75(b)for necessary support staff services the actual and reasonable amount paid, as supported by vouchers(c)for stationery, postage, telegrams, the rental of office equipment and furniture, telephone services and the transportation of referendum supplies, and other similar incidental expenses the actual and reasonable amount paid, as supported by vouchers(d)for the rental of an office in connection with the conduct of a referendum the actual and reasonable amount incurred, as supporter by vouchers(e)for travel, other than in urban polling divisions, in connection with the conduct of a referendum the allowances and expenses referred to in item 33Assistant Training Officers32Each assistant training officer appointed by the returning officer in electoral districts designated by the Chief Electoral Officer shall be paid(a)for services related to providing training sessions, for each hour of work certified by the returning officer $ 20.75(b)for travel and living expenses at a place other than the assistant training officer’s place of residence the allowances and expenses referred to in item 33Rural Travel Allowances33Each individual who, pursuant to this schedule, is authorized to be paid for expenses incurred in connection with the services the individual is required to perform, shall be paid for travel in a rural area as follows:(a)for travel by means of a private motor vehicle the allowance established by the Treasury Board Travel Directive(b)for travel by means other than a private motor vehicle the actual and reasonable expenses paid, as supported by vouchers(c)for living expenses(i)for lodging the actual and reasonable expenses paid, as supported by vouchers(ii)for meals and incidental expenses the allowances established by the Treasury Board Travel DirectiveUrban Travel Allowances34Each returning officer shall be paid, in respect of travel in an urban area in connection with the services the returning officer is required to perform with respect to a referendum, for each 1,000 of population in the electoral district $ 7.5035Each individual who, pursuant to this schedule, is authorized to be paid a travel allowance and is required to travel from an urban area through a rural area to another urban area in connection with the services the individual is required to perform shall be paid, in respect of the individual’s living and incidental expenses incurred in the urban area to which the individual travels, the allowances and expenses referred to in item 33Accountable Advances36In addition to the accountable advances provided for by subitems 2(2) to (4), the Chief Electoral Officer may make accountable advances to returning officers and to assistant returning officers appointed under paragraph 18(2)(a) of the Canada Elections Act to defray expenses in connection with a referendum, in an amount that does not exceed, in the aggregate per officer, $ 2,000.00Clerical Assistants at a Judicial Recount37Each clerical assistant, other than a returning officer, required to assist with a recount pursuant to section 29 of the Act and subsections 179(1) to (3), sections 181 and 182 and subsection 184(1) of the Canada Elections Act shall be paid for all attendance and services, as certified by the judge who recounts the votes, an hourly rate of $ 12.00Sundry Allowances38Each individual, other than those individuals referred to in items 1 to 37, who is employed in connection with the conduct of a referendum before or after the date of the issue of the writ shall, where requested by the Chief Electoral Officer to travel, be paid the allowances and expenses referred to in item 33Goods and Services Tax39Where a referendum officer who is a supplier of goods or services under this Tariff is not registered under section 241 of the Excise Tax Act and has paid tax under Part IX of that Act in respect of those goods or services, the referendum officer shall be paid, in addition to the amounts set out in items 1 to 38, an amount equal to the amount of that tax paid.
