(<DefinedTermFr>sous-ministre adjoint</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="949564" lims:id="949564" generate-in-text="no"><Text><DefinedTermEn>band</DefinedTermEn> means a band in respect of which a referendum is to be held; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="949565" lims:id="949565" generate-in-text="no"><Text><DefinedTermEn>deputy presiding officer</DefinedTermEn> means a person appointed by the presiding officer pursuant to paragraph 9(1)(a); (<DefinedTermFr>président du scrutin</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="949566" lims:id="949566" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Indian Affairs and Northern Development; (<DefinedTermFr>agent de la paix</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="949568" lims:id="949568" generate-in-text="no"><Text><DefinedTermEn>presiding officer</DefinedTermEn> means a presiding officer appointed pursuant to subsection 4(1); (<DefinedTermFr>président d’élection</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="949569" lims:id="949569" generate-in-text="no"><Text><DefinedTermEn>referendum</DefinedTermEn> means a referendum held under section 10 of the schedule to the <XRefExternal reference-type="act" link="I-6.7">Indian Lands Agreement (1986) Act</XRefExternal> to confirm a specific agreement. (<DefinedTermFr>référendum</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949570" lims:id="949570" level="1"><TitleText>Secret Ballot</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949571" lims:id="949571"><Label>3</Label><Text>A referendum shall be conducted by secret ballot.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949572" lims:id="949572" level="1"><TitleText>Appointment of Presiding Officer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949573" lims:id="949573"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949574" lims:id="949574"><Label>(1)</Label><Text>Where a band proposes to confirm a specific agreement by referendum, the council of the band shall, within 15 days after the band enters into the specific agreement, appoint a presiding officer and inform the Minister of the date on which the referendum is to be held and the name of the presiding officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949575" lims:id="949575"><Label>(2)</Label><Text>On receipt of the information referred to in subsection (1), the Minister may designate an official of the Department of Indian Affairs and Northern Development to be an observer at the referendum and shall inform the council of the band of the name of any official so designated.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949576" lims:id="949576" level="1"><TitleText>Eligible Voters</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949577" lims:id="949577"><Label>5</Label><Text>Every person is an eligible voter and entitled to vote at a referendum who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949578" lims:id="949578"><Label>(a)</Label><Text>is a member of the band;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949579" lims:id="949579"><Label>(b)</Label><Text>is at least 18 years of age; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949580" lims:id="949580"><Label>(c)</Label><Text>is not disqualified from voting at band elections.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949581" lims:id="949581" level="1"><TitleText>Notice of Referendum</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949582" lims:id="949582"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949583" lims:id="949583"><Label>(1)</Label><Text>The presiding officer shall post a notice of the referendum, at least 30 days before the date of the referendum, in at least two public places where the notice is likely to come to the attention of the members of the band.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949584" lims:id="949584"><Label>(2)</Label><Text>The notice referred to in subsection (1) shall set out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949585" lims:id="949585"><Label>(a)</Label><Text>the time and date of the referendum;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949586" lims:id="949586"><Label>(b)</Label><Text>the question to be submitted to the voters; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949587" lims:id="949587"><Label>(c)</Label><Text>the location of the polling stations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949588" lims:id="949588"><Label>(3)</Label><Text>A copy of the specific agreement that is the subject of the referendum shall be attached to the notice referred to in subsection (1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="949590" lims:id="949590">SOR/99-232, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949591" lims:id="949591" level="1"><TitleText>Voters’ List</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949592" lims:id="949592"><Label>7</Label><Text>At least 15 days before the date of the referendum, the presiding officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949593" lims:id="949593"><Label>(a)</Label><Text>prepare a list, in alphabetical order, of every eligible voter that indicates the polling station where each person is to vote; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949594" lims:id="949594"><Label>(b)</Label><Text>post a copy of the list of eligible voters in at least two public places where the list is likely to come to the attention of the members of the band.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949595" lims:id="949595"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949596" lims:id="949596"><Label>(1)</Label><Text>An eligible voter may apply to the presiding officer within 10 days after the posting of the list of voters to have the list revised on the ground that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949597" lims:id="949597"><Label>(a)</Label><Text>the name of an eligible voter has been omitted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949598" lims:id="949598"><Label>(b)</Label><Text>the name of an eligible voter has been incorrectly set out; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949599" lims:id="949599"><Label>(c)</Label><Text>the name of a person not entitled to vote has been included.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949600" lims:id="949600"><Label>(2)</Label><Text>Where the presiding officer is satisfied that a revision is necessary to the list of eligible voters, the presiding officer shall revise the list accordingly.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949601" lims:id="949601" level="1"><TitleText>Duties of Presiding Officer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949602" lims:id="949602"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949603" lims:id="949603"><Label>(1)</Label><Text>Before the referendum, the presiding officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949604" lims:id="949604"><Label>(a)</Label><Text>appoint a deputy presiding officer for each polling station to exercise the powers and perform the duties of the presiding officer under sections 10 to 18, subsection 19(1), and sections 21 and 23;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949605" lims:id="949605"><Label>(b)</Label><Text>prepare a sufficient number of ballots that indicate the question to be submitted to the voters;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949606" lims:id="949606"><Label>(c)</Label><Text>procure a ballot box and an adequate supply of lead pencils for marking the ballots for each polling station;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949607" lims:id="949607"><Label>(d)</Label><Text>before a polling station opens, deliver a ballot box, ballots and pencils to the deputy presiding officer at that polling station; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949608" lims:id="949608"><Label>(e)</Label><Text>provide at least one polling booth for each polling station where a voter can mark a ballot free from observation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949609" lims:id="949609"><Label>(2)</Label><Text>The appointment of deputy presiding officers pursuant to paragraph (1)(a) shall be approved by the council of the band.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949610" lims:id="949610"><Label>10</Label><Text>Immediately before a polling station is opened, the presiding officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949611" lims:id="949611"><Label>(a)</Label><Text>open the ballot box in the presence of witnesses and ask every person who is present to witness that it is empty;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949612" lims:id="949612"><Label>(b)</Label><Text>lock and seal the ballot box; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949613" lims:id="949613"><Label>(c)</Label><Text>place the ballot box in public view for the reception of ballots.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949614" lims:id="949614"><Label>11</Label><Text>Where a person arrives at a polling station for the purpose of voting and the presiding officer is satisfied that the person’s name is included on the list of eligible voters, the presiding officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949615" lims:id="949615"><Label>(a)</Label><Text>initial the back of a ballot in such a manner that, when the ballot is folded, the initials can be seen without unfolding the ballot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949616" lims:id="949616"><Label>(b)</Label><Text>give the ballot to that person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949617" lims:id="949617"><Label>(c)</Label><Text>place a mark opposite the name of that person on the list of voters.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949618" lims:id="949618"><Label>12</Label><Text>At the request of a voter at a polling station, the presiding officer shall explain to the voter how to vote.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949619" lims:id="949619"><Label>13</Label><Text>Subject to section 16, the presiding officer shall not allow more than one voter at a time in a polling booth.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949620" lims:id="949620" level="1"><TitleText>Use of Interpreters</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949621" lims:id="949621"><Label>14</Label><Text>Where the presiding officer does not understand the language spoken by a voter, the presiding officer shall appoint an interpreter to communicate to the voter all matters necessary to enable the voter to vote.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949622" lims:id="949622" level="1"><TitleText>Responsibilities of Voter</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949623" lims:id="949623"><Label>15</Label><Text>A person who receives a ballot pursuant to section 11 shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949624" lims:id="949624"><Label>(a)</Label><Text>go immediately to a polling booth;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949625" lims:id="949625"><Label>(b)</Label><Text>place a mark on the ballot beside the word “YES” or “NO” opposite the question stated on the ballot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949626" lims:id="949626"><Label>(c)</Label><Text>fold the ballot in a manner that conceals the person’s mark but exposes the initials on the back of the ballot; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949627" lims:id="949627"><Label>(d)</Label><Text>immediately deliver the ballot to the presiding officer for deposit in the ballot box.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949628" lims:id="949628" level="1"><TitleText>Assistance to Special Voters</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949629" lims:id="949629"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949630" lims:id="949630"><Label>(1)</Label><Text>At the request of a voter who is not able to read or who is incapacitated by blindness or other physical cause, the presiding officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949631" lims:id="949631"><Label>(a)</Label><Text>assist the voter by marking the ballot in the manner directed by the voter and placing the ballot in the ballot box; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949632" lims:id="949632"><Label>(b)</Label><Text>if it is practicable and helpful to do so, provide a template for the use of the voter.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949633" lims:id="949633"><Label>(2)</Label><Text>Where, pursuant to subsection (1), the presiding officer marks a ballot, the officer shall indicate on the list of voters, opposite the name of the voter, that the ballot was marked by the officer at the request of the voter, and the reasons therefor.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949634" lims:id="949634" level="1"><TitleText>Soiled or Spoiled Ballots</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949635" lims:id="949635"><Label>17</Label><Text>Where a voter receives a soiled or improperly printed ballot or inadvertently spoils a ballot in marking it, the voter is entitled to another ballot if the voter returns the original ballot to the presiding officer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949636" lims:id="949636" level="1"><TitleText>Forfeit of Right to Vote</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949637" lims:id="949637"><Label>18</Label><Text>Where a voter who receives a ballot refuses to vote or leaves the polling booth without returning the ballot to the presiding officer, the voter forfeits the right to vote and the presiding officer shall indicate on the list of voters opposite the name of that voter that the voter did not return the ballot or refused to vote, as the case may be.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949638" lims:id="949638" level="1"><TitleText>Hours for Voting</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949639" lims:id="949639"><Label>19</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949640" lims:id="949640"><Label>(1)</Label><Text>Subject to subsection (2), the presiding officer shall keep each polling station open from 9:00 a.m. until 6:00 p.m. on the day set for voting.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949641" lims:id="949641"><Label>(2)</Label><Text>Where the presiding officer is satisfied, after consulting with the chief or a member of the council of the band, that it would be inconvenient to the voters to close the polling stations at 6:00 p.m., the presiding officer or deputy presiding officer may keep them open for up to two additional hours.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949642" lims:id="949642"><Label>20</Label><Text>A voter who is inside a polling station at the time fixed for closing the polling station is entitled to vote before the polling station is closed.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949643" lims:id="949643" level="1"><TitleText>Examination and Counting of Ballots</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949644" lims:id="949644"><Label>21</Label><Text>Immediately after the closing of a polling station, the presiding officer shall examine the ballots in the presence of any members of the council of the band who are present and shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949645" lims:id="949645"><Label>(a)</Label><Text>reject any ballot that was not supplied by the presiding officer and any ballot that does not clearly indicate the decision of the voter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949646" lims:id="949646"><Label>(b)</Label><Text>of the ballots that have not been rejected, count the number of votes that were in favour of and the number of votes that were against the specific agreement.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949647" lims:id="949647"><Label>22</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949648" lims:id="949648"><Label>(1)</Label><Text>The presiding officer shall collect the ballots used in the voting, place them in a sealed envelope and keep them for 60 days.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949649" lims:id="949649"><Label>(2)</Label><Text>After the 60 days referred to in subsection (1), the presiding officer shall destroy the ballots in the presence of two witnesses unless the Assistant Deputy Minister directs the officer not to destroy them.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949650" lims:id="949650" level="1"><TitleText>Maintaining Peace and Order</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949651" lims:id="949651"><Label>23</Label><Text>The presiding officer shall maintain peace and good order during the voting and for that purpose may enlist the assistance of peace officers.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949652" lims:id="949652" level="1"><TitleText>Report on Referendum</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949653" lims:id="949653"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949654" lims:id="949654"><Label>(1)</Label><Text>When the presiding officer knows the results of the voting at all of the polling stations, the presiding officer shall immediately prepare a report that sets out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949655" lims:id="949655"><Label>(a)</Label><Text>the date on which the referendum was held;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949656" lims:id="949656"><Label>(b)</Label><Text>the number of eligible voters;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949657" lims:id="949657"><Label>(c)</Label><Text>the number of eligible voters who voted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949658" lims:id="949658"><Label>(d)</Label><Text>the number of votes in favour of the specific agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949659" lims:id="949659"><Label>(e)</Label><Text>the number of votes against the specific agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949660" lims:id="949660"><Label>(f)</Label><Text>the number of rejected ballots.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949661" lims:id="949661"><Label>(2)</Label><Text>The report shall be prepared in triplicate and be signed by the presiding officer and by the chief or a member of the council of the band.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949662" lims:id="949662"><Label>(3)</Label><Text>The presiding officer shall submit a copy of the report to the chief or a member of the council of the band and to the Assistant Deputy Minister.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949663" lims:id="949663"><Label>25</Label><Text>Within seven days after a referendum is held, an observer designated under subsection 4(2) shall submit a written report to the Minister that sets out the information referred to in paragraphs 24(1)(a) to (f).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949664" lims:id="949664"><Label>26</Label><Text>The Assistant Deputy Minister shall inform the Attorney General of Ontario of the results of the vote within 15 days after receipt of the report referred to in section 24.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949665" lims:id="949665" level="1"><TitleText>Approval Requirement for Confirmation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949666" lims:id="949666"><Label>27</Label><Text>Where a majority of all eligible voters of a band vote in a referendum, a specific agreement is confirmed if a majority of those who vote assent to it.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949667" lims:id="949667" level="1"><TitleText>Subsequent Referendum</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949668" lims:id="949668"><Label>28</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949669" lims:id="949669"><Label>(1)</Label><Text>Where a majority of all eligible voters of a band did not vote in a referendum, the council of the band may, if the proposed specific agreement was assented to by a majority of those who voted, call another referendum to be held in accordance with these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949670" lims:id="949670"><Label>(2)</Label><Text>Where under a referendum that is called under subsection (1) the proposed specific agreement is assented to by a majority of those who vote, the specific agreement is confirmed.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949671" lims:id="949671" level="1"><TitleText>Appeal</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949672" lims:id="949672"><Label>29</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949673" lims:id="949673"><Label>(1)</Label><Text>Any person who voted at a referendum may file an appeal if that person believes on reasonable grounds that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949674" lims:id="949674"><Label>(a)</Label><Text>there was a contravention of these Regulations that may have affected the results of the referendum; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="949675" lims:id="949675"><Label>(b)</Label><Text>there occurred a corrupt practice in connection with the referendum.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949676" lims:id="949676"><Label>(2)</Label><Text>An appeal under subsection (1) shall be filed by sending by registered mail to the Assistant Deputy Minister, within seven days after the date of the referendum, a notice of appeal stating the grounds and particulars of the appeal.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949677" lims:id="949677"><Label>30</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949678" lims:id="949678"><Label>(1)</Label><Text>Not later than 21 days after receipt of a notice of appeal, the Assistant Deputy Minister shall send a copy of the notice of appeal by registered mail to the presiding officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949679" lims:id="949679"><Label>(2)</Label><Text>Not later than 10 days after receipt of a copy of a notice of appeal, the presiding officer shall send to the Assistant Deputy Minister by registered mail a statutory declaration that contains an answer to the particulars stated in the notice of appeal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949680" lims:id="949680"><Label>(3)</Label><Text>On receipt of the declaration provided by the presiding officer pursuant to subsection (2), the Assistant Deputy Minister shall forward the notice of appeal and the declaration to the Minister.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949681" lims:id="949681"><Label>31</Label><Text>The Minister may, if the material filed under subsections 29(2) and 30(2) is not sufficient to decide the validity of the grounds of appeal, conduct a further investigation.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949682" lims:id="949682"><Label>32</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949683" lims:id="949683"><Label>(1)</Label><Text>Where the Minister is satisfied that the grounds for an appeal are established and that the result of the referendum was thereby affected, the Minister shall allow the appeal, direct that another referendum be conducted, and notify the council of the band of the decision.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="949684" lims:id="949684"><Label>(2)</Label><Text>Where the Minister is of the opinion that the grounds for an appeal are not established or did not affect the results of the referendum, the Minister shall dismiss the appeal and notify the council of the band of the decision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="949686" lims:id="949686">SOR/99-232, s. 4(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="949687" lims:id="949687" level="1"><TitleText>Forms</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="949688" lims:id="949688"><Label>33</Label><Text>The Minister may prescribe such forms as are required for the purposes of these Regulations.</Text></Section></Body></Regulation>
