His Excellency the Governor General in Council, on the recommendation of the Secretary of State for External Affairs and the Minister of Finance, pursuant to section 5 of the Foreign Missions and International Organizations Act*, is pleased hereby to make the annexed Order respecting the privileges and immunities in Canada of the North Pacific Anadromous Fish Commission.*S.C. 1991, c. 41Short Title

1This Order may be cited as the North Pacific Anadromous Fish Commission Privileges and Immunities Order.

Interpretation

2In this Order,Agreement means the Headquarters Agreement between the Government of Canada and the North Pacific Anadromous Fish Commission, done at Ottawa, October 29, 1993, and at Vancouver, November 3, 1993 (CTS 1993/16), as amended by the Exchange of Notes between the Government of Canada and the North Pacific Anadromous Fish Commission, constituting an agreement amending the Agreement, done at Ottawa, May 15, 1997, and at Vancouver, May 27, 1997 (CTS 1997/14); (Accord)Commission means the North Pacific Anadromous Fish Commission; (Commission)Convention means the Convention on the Privileges and Immunities of the United Nations set out in Schedule III to the Foreign Missions and International Organizations Act. (Convention)Vienna Convention means the Vienna Convention on Diplomatic Relations set out in Schedule I to the Foreign Missions and International Organizations Act. Privileges and Immunities

3(1)The Commission shall have in Canada the legal capacities of a body corporate and, to the extent specified in Articles 1 to 5 of the Agreement, the privileges and immunities set out in Article II of the Convention.(2)Representatives of foreign states that are members of the Commission shall have in Canada, to the extent specified in Article 6 of the Agreement, privileges and immunities comparable to the privileges and immunities accorded in Canada to diplomatic representatives under the Vienna Convention.(3)The President of the Commission, and the Vice-President when acting as President, shall have in Canada, to the extent specified in Article 7 of the Agreement, privileges and immunities comparable to the privileges and immunities accorded in Canada to diplomatic representatives under the Vienna Convention.(4)Officers of the Commission shall have in Canada, to the extent specified in paragraphs 1 to 3 of Article 8 and in Article 10 of the Agreement, the privileges and immunities set out in section 18 of Article V of the Convention.(5)Experts performing missions for the Commission shall have in Canada, to the extent specified in Article 11 of the Agreement, the privileges and immunities set out in Article VI of the Convention.SOR/2003-110, s. 4
