link="W-7.8">Western Grain Transition Payments Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="468823" lims:id="468823" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="468824" lims:id="468824"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468825" lims:id="468825">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2003-01-01" lims:fid="468826" lims:id="468826"><Text><DefinedTermEn>eligible area</DefinedTermEn> means the area comprising Manitoba, Saskatchewan, Alberta and those parts of British Columbia known as the Peace River District and the Creston-Wynndel Areas; (<DefinedTermFr>région désignée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="468827" lims:id="468827"><Text><DefinedTermEn>farmland</DefinedTermEn> means land on which an annual crop of grain was cultivated during 1994 and land that was in summer-fallow during that year and on which an annual crop of grain was cultivated during 1993; (<DefinedTermFr>terre arable</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="468828" lims:id="468828"><Text><DefinedTermEn>grain</DefinedTermEn> has the meaning given that word by section 181.1 of the <XRefExternal reference-type="act">National Transportation Act, 1987</XRefExternal>; (<DefinedTermFr>grain</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="468829" lims:id="468829"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Agriculture and Agri-Food; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="468830" lims:id="468830"><Text><DefinedTermEn>own</DefinedTermEn> means, in respect of farmland, to hold the fee simple in the farmland, unless another interest in the farmland is prescribed, in which case it means to hold that interest; (<DefinedTermFr>propriétaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="468831" lims:id="468831"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulations made by the Governor in Council under section 6. (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="468832" lims:id="468832" level="1"><TitleText>Applications</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="468833" lims:id="468833"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468834" lims:id="468834">Persons who may apply</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468835" lims:id="468835"><Label>(1)</Label><Text>A person who owned farmland in the eligible area at the beginning of the day on February 28, 1995 may apply to the Minister for transition payments.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468836" lims:id="468836"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468837" lims:id="468837">Form and time limit</MarginalNote><Label>(2)</Label><Text>The application must be in a form approved by the Minister and be received by the Minister not later than September 15, 1995, or any later day fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468838" lims:id="468838"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468839" lims:id="468839">Proof of ownership</MarginalNote><Label>(3)</Label><Text>The Minister may require the applicant to provide proof of the applicant’s ownership of the farmland.</Text></Subsection></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="468840" lims:id="468840" level="1"><TitleText>Payments</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="468841" lims:id="468841"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468842" lims:id="468842">Minister may make payments</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468843" lims:id="468843"><Label>(1)</Label><Text>The Minister may make an interim transition payment and a final transition payment to an applicant if the Minister is satisfied that the applicant owned farmland in the eligible area at the beginning of the day on February 28, 1995 and meets the prescribed criteria and conditions.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468844" lims:id="468844"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468845" lims:id="468845">Payment deadlines</MarginalNote><Label>(2)</Label><Text>The Governor in Council may establish deadlines for making the payments.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468846" lims:id="468846"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468847" lims:id="468847">Calculation of amounts</MarginalNote><Label>(3)</Label><Text>The total amount of the interim transition payment and the final transition payment must be calculated in accordance with the regulations on a basis that reflects the productivity of the farmland and its distance from port.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468848" lims:id="468848"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468849" lims:id="468849">Tax treatment</MarginalNote><Label>(4)</Label><Text>For the purposes of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>,</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468850" lims:id="468850"><Label>(a)</Label><Text>a transition payment received in respect of farmland that is capital property of the applicant shall be considered to be an amount required by subsection 53(2) of that Act to be deducted in computing the adjusted cost base of the farmland to the applicant after the payment is received;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468851" lims:id="468851"><Label>(b)</Label><Text>a transition payment received in respect of farmland that was, immediately before its disposition by the applicant, capital property of the applicant shall, where the farmland is disposed of before the payment is received, be considered to be an amount required by subsection 53(2) of that Act to be deducted in computing the adjusted cost base of the farmland to the applicant immediately before the disposition;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468852" lims:id="468852"><Label>(c)</Label><Text>a transition payment to which neither paragraph (a) nor (b) applies, received by the applicant, shall be considered to be assistance received in the course of earning income from a business or property in respect of the cost of the property or in respect of an outlay or an expense; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468853" lims:id="468853"><Label>(d)</Label><Text>where, pursuant to an equitable arrangement referred to in paragraph 6(c), a portion of a transition payment received by an applicant is paid to a person or partnership that is leasing farmland from the applicant, that portion paid to the person or partnership is required to be included in computing the income of the person or partnership from a business for the taxation year of the person or partnership in which it is received and the amount so paid is deemed not to be a transition payment received by the applicant for the purposes of paragraphs (a) to (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="468854" lims:id="468854"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468855" lims:id="468855">Payment limit and apportionment</MarginalNote><Label>(5)</Label><Text>The total amount of all transition payments must not exceed 1.6 billion dollars and the total amount must be apportioned as follows:</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468856" lims:id="468856"><Label>(a)</Label><Text>16.10% for farmland in Manitoba;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468857" lims:id="468857"><Label>(b)</Label><Text>56.42% for farmland in Saskatchewan; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468858" lims:id="468858"><Label>(c)</Label><Text>27.48% for farmland in Alberta and those parts of British Columbia known as the Peace River District and the Creston-Wynndel II, s. 4); 1998, c. 19, s. 303</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="468861" lims:id="468861" level="1"><TitleText>Appropriation</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="468862" lims:id="468862"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468863" lims:id="468863">Appropriation</MarginalNote><Label>5</Label><Text>The amount of 1.6 billion dollars is appropriated for the purposes of this Act, to be paid out of the Consolidated Revenue Fund from time to time as required.</Text></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="468864" lims:id="468864" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="468865" lims:id="468865"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="468866" lims:id="468866">Powers of Governor in Council</MarginalNote><Label>6</Label><Text>The Governor in Council may make regulations for carrying out the purposes of this Act, including regulations prescribing</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468867" lims:id="468867"><Label>(a)</Label><Text>interests in farmland for the purposes of the definition <DefinitionRef>own</DefinitionRef> in section 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468868" lims:id="468868"><Label>(b)</Label><Text>criteria to be used by the Minister in deciding whether applicants are entitled to transition payments;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468869" lims:id="468869"><Label>(c)</Label><Text>conditions to be met prior to receiving a transition payment including the condition that an equitable arrangement must be made by an applicant in respect of any person who or partnership that is leasing the farmland that is the subject of the application for the transition payment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="468870" lims:id="468870"><Label>(d)</Label><Text>how interim and final transition payments are to be calculated, including which port is to be used for the purpose of determining the distance of farmland from port.</Text></Paragraph></Section></Body></Statute>
