Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.83Footnote a of the Aeronautics Act, hereby makes the annexed Regulations Concerning Information Required by Foreign States.

Marginal note:Landing in a foreign state
1 For the purposes of section 4.83 of the Aeronautics Act, in the case of an aircraft that is due to land in a foreign state, the information set out in Schedules 1 and 2 relating to persons on board or expected to be on board the aircraft may be provided to a competent authority in that foreign state if the state and authority are set out in Schedule 3. However, the information set out in Schedule 2 may be provided only on request.

2 For the purposes of section 4.83 of the Aeronautics Act, in the case of an aircraft that is due to fly over the United States, the information set out in Schedule 4 relating to passengers on board or expected to be on board the aircraft may be provided to the United States Department of Homeland Security.

SCHEDULE 1(Section 1)
Information About the Passengers and Crew Members
- 1The surname, first name and initial or initials
- 2The date of birth
- 3The citizenship or nationality or, failing these, the country that issued the travel documents for the flight
- 4The gender
- 5The number of the passport and, if applicable, visa or resident alien card
SCHEDULE 2(Section 1)
Information from the Passenger Name Record
- 1The date on which the passenger name record was created
- 2If applicable, a notation that the passenger arrived at the departure gate with a ticket but without a reservation for the flight
- 3If applicable, the names of the travel agency and travel agent that made the travel arrangements
- 4The date on which the ticket for the flight was issued
- 5If applicable, a notation that the passenger exchanged their ticket for the flight
- 6The date, if any, by which the ticket for the flight had to be paid for to avoid cancellation of the reservation or the date, if any, on which the request for a reservation was queued from the operator of the aircraft to the ticketing office
- 7The number assigned to the ticket for the flight
- 8If applicable, a notation that the ticket for the flight is a one-way ticket
- 9If applicable, a notation that the ticket for the flight is valid for one year and that is issued for travel between specified points with no dates or flight numbers assigned
- 10The city or country in which the travel included in the passenger name record begins
- 11The itinerary cities, being all points where the person will embark or disembark
- 12The name of the operator of the aircraft
- 13The names of the operators of aircraft over whose air routes all other segments of air travel included in the passenger name record are undertaken, including, for each segment, the name of any operator of aircraft other than the operator that issued the ticket
- 14The code of the operator of the aircraft and the identification number for the flight
- 15The destination in the foreign state
- 16The travel date for the flight
- 17Any seat assignment on the flight that was selected for the passenger prior to departure
- 18The number of pieces of baggage checked by the person to be carried in the aircraft’s cargo compartment on the flight
- 19The baggage tag numbers
- 20The class of service in respect of the flight
- 21Any stated seat request in respect of the flight
- 22The passenger name record number
- 23The phone numbers of the person and, if applicable, the phone number of the travel agency that made the travel arrangements
- 24The address of the person and, if applicable, of the travel agency that made the travel arrangements
- 25The manner in which the ticket was paid for
- 26If applicable, a notation that the ticket was paid for by a person other than the ticket holder
- 27If applicable, a notation that there are gaps in the itinerary included in the passenger name record that necessitate travel by an undetermined method
- 28Routing information in respect of the travel included in the passenger name record, being the departure and arrival points, codes of the operators of the aircraft, stops and surface segments
- 29If applicable, a notation that the ticket is in electronic form and stored electronically in the reservation system of the operator of the aircraft
